【摘要】：近些年來(lái),網(wǎng)絡(luò)技術(shù)的快速發(fā)展,給人們的生活帶來(lái)巨大改變,國(guó)家的運(yùn)行與外交均與網(wǎng)絡(luò)聯(lián)系十分緊密。網(wǎng)絡(luò)空間中必然會(huì)出現(xiàn)各種各樣的問題,其中最顯著的問題就是與網(wǎng)絡(luò)空間相關(guān)的法律問題,法律問題主要表現(xiàn)為一方面是關(guān)于網(wǎng)絡(luò)空間的國(guó)內(nèi)法律法規(guī)的問題,另一方面則是網(wǎng)絡(luò)空間中的國(guó)家主權(quán)問題,即是網(wǎng)絡(luò)主權(quán)的問題。全文共分四個(gè)部分展開。第一部分闡釋了網(wǎng)絡(luò)主權(quán)概念的提出與背景,分析了網(wǎng)絡(luò)主權(quán)提出的合理性,網(wǎng)絡(luò)空間的可規(guī)制性和真實(shí)性,再以信息主權(quán)是國(guó)家主權(quán)的焦點(diǎn)得出網(wǎng)絡(luò)主權(quán)提出的具有重要的意義。第二部分闡述了網(wǎng)絡(luò)主權(quán)與國(guó)家主權(quán)的關(guān)系,分析國(guó)家主權(quán)的理論發(fā)展,從古典主權(quán)概念的形成到近代主權(quán)概念的理論發(fā)展,以及當(dāng)前的國(guó)家主權(quán)理論,從國(guó)家主權(quán)理論的歷史演進(jìn),我們對(duì)主權(quán)得到的一些啟發(fā)。網(wǎng)絡(luò)主權(quán)的內(nèi)容,主要從網(wǎng)絡(luò)主權(quán)的界定,網(wǎng)絡(luò)主權(quán)包括獨(dú)立權(quán)、平等權(quán)、自衛(wèi)權(quán)與管轄權(quán),從國(guó)家主權(quán)到網(wǎng)絡(luò)主權(quán)的分析,網(wǎng)絡(luò)主權(quán)的理論基礎(chǔ)以及性質(zhì)。第三部分分析了網(wǎng)絡(luò)主權(quán)理論發(fā)展的必要性,因國(guó)家合作與網(wǎng)絡(luò)空間發(fā)展的矛盾以及出現(xiàn)的問題,解決這些問題網(wǎng)絡(luò)主權(quán)理論的發(fā)展是十分必要的。第四部分對(duì)網(wǎng)絡(luò)主權(quán)的法律界定,并對(duì)網(wǎng)絡(luò)主權(quán)的法治化的分析,最后提出“尊重網(wǎng)絡(luò)主權(quán),構(gòu)建網(wǎng)絡(luò)空間命運(yùn)共同體,共同維護(hù)和平安全,促進(jìn)開放合作,建立良好秩序”。希望面對(duì)歷久彌新的主權(quán)觀念和日新月異的網(wǎng)絡(luò)空間,包容自由、法治、民主的網(wǎng)絡(luò)主權(quán)給予世界一大貢獻(xiàn)。
[Abstract]:In recent years, the rapid development of network technology has brought great change to people's life, running and foreign countries are closely connected with the network. There must be various problems in the network space, one of the most significant problem is that related to the legal issues in cyberspace, the law is the main problem of network is on hand the domestic laws and regulations, on the other hand is the issue of national sovereignty in cyberspace, the network that is the sovereignty issue. The full text is divided into four parts. The first part explains the background and network of the concept of sovereignty, analyzes the rationality of the proposed network sovereignty in cyberspace, regulation and real then, with the information sovereignty is the focus of national sovereignty that has the important significance of the network sovereignty. The second part expounds the relationship between the network sovereignty and the national sovereignty, analysis The theory of the development of national sovereignty, the theory of development from the formation of the classical concept of sovereignty to the modern concept of sovereignty, and the current national sovereignty theory, from the historical evolution of the theory of national sovereignty, we get some inspiration to the sovereign. The sovereignty of the network content, mainly from the definition of the main power network, including the network sovereignty independence, equal rights the right of self-defense, and jurisdiction, from the analysis of national sovereignty to the sovereignty of the network, the theoretical basis and the nature of Internet sovereignty. The third part analyzes the necessity of developing the network sovereignty theory, the contradiction of national cooperation and network space development and problems to solve these problems, the development of the network sovereignty theory is very necessary. The definition of the fourth part of the legal network sovereignty, and analysis of the network sovereignty of the rule of law, and finally put forward the "respect for the sovereignty of the network, constructing the network space to fate, common maintenance Peace and security, promoting openness and cooperation, establish a good order. Hope in the face of timeless sovereignty and change rapidly in cyberspace, inclusive of freedom, the rule of law, democracy and the network sovereignty give to the world a great contribution.
