小產(chǎn)權(quán)房買賣的法律問題

【摘要】:隨著最近十幾年各地房價(jià)飛漲,有購買需求的居民礙于購買能力的不足,紛紛將目光轉(zhuǎn)向的特殊的小產(chǎn)權(quán)房。小產(chǎn)權(quán)房地處農(nóng)村和城市交界,價(jià)格低廉,盡管沒有法律保障,仍然吸引眾多購買者。最近幾年,小產(chǎn)權(quán)房發(fā)展速度越來越快,交易中產(chǎn)生的各種糾紛層出不窮。筆者認(rèn)為,小產(chǎn)權(quán)房在農(nóng)村的發(fā)展阻礙了城市化進(jìn)程,盡快解決小產(chǎn)權(quán)房問題是當(dāng)務(wù)之急。此外,法律對(duì)于小產(chǎn)權(quán)房交易行為的性質(zhì)、相關(guān)爭議點(diǎn)沒有相關(guān)規(guī)定;在司法實(shí)踐中也都認(rèn)定小產(chǎn)權(quán)房買賣合同無效。為了深入研究小產(chǎn)權(quán)房買賣中的各種法律問題,本文首先通過引入案例、分析案例中的具體問題從而深入分析小產(chǎn)權(quán)房產(chǎn)生的制度、社會(huì)和直接原因;其次,為了探求小產(chǎn)權(quán)房買賣合同的效力,筆者從《物權(quán)法》、《憲法》等多個(gè)角度對(duì)合同的效力問題進(jìn)行了分析,同時(shí)對(duì)其它的法律爭議問題進(jìn)行了探討。最后,在研究分析的基礎(chǔ)上對(duì)如何解決小產(chǎn)權(quán)房問題提出了自己的建議。筆者認(rèn)為,小產(chǎn)權(quán)房不斷地發(fā)展不僅有損法律權(quán)威,也不能保證民眾的權(quán)益,同時(shí)會(huì)對(duì)農(nóng)村集體土地的正常使用流轉(zhuǎn)產(chǎn)生影響,這些都是城鎮(zhèn)化背景下必須解決的問題。本文分別根據(jù)小產(chǎn)權(quán)房的產(chǎn)生原因和現(xiàn)有法律制度兩個(gè)角度提出了建議,一方面期望從根源上解決小產(chǎn)權(quán)房,另一方面希望從現(xiàn)有角度遏制其發(fā)展,在相關(guān)法律制度完善之前作為過渡。
[Abstract]:As housing prices have skyrocketed in recent decades, residents with buying needs have turned their eyes to special small property houses, which are located at the border between rural and urban areas, despite the lack of legal protection, because of the lack of purchasing power. Still attract many buyers. In recent years, the development of small property houses is growing faster and faster, and various disputes arising in the transactions emerge in endlessly. I believe that the development of small property houses in rural areas has hindered the process of urbanization. It is urgent to solve the problem of small property right as soon as possible. In addition, the law has no relevant provisions on the nature of the transaction of small property rights; In the judicial practice, the contract of purchase and sale of small property houses is also found to be invalid. In order to deeply study various legal problems in the sale of small property houses, this paper first introduces a case study. Analyzing the specific problems in the case to analyze the system, the society and the direct causes of the small property right house; secondly, in order to explore the effectiveness of the contract for the sale and purchase of the small property house, The author analyzes the validity of the contract from several angles, such as Real right Law, Constitution, and so on. At the same time, the author probes into other legal disputes. On the basis of research and analysis, the author puts forward his own suggestions on how to solve the problem of small property housing. The author believes that the continuous development of small property houses not only harms the legal authority, but also cannot guarantee the rights and interests of the public. At the same time, it will have an impact on the normal use and circulation of rural collective land, which must be solved under the background of urbanization. On the one hand, we hope to solve the problem of small property right from the root, on the other hand, we hope to curb its development from the existing angle, as a transition before the relevant legal system is perfected.
