【摘要】：改革開放以來,環(huán)境保護部門在傳統(tǒng)的行政管理體制下,其弱勢地位導(dǎo)致大量的環(huán)境監(jiān)察執(zhí)法問題頻現(xiàn),突出地表現(xiàn)在:一方面環(huán)境監(jiān)察執(zhí)法機構(gòu)存在比較嚴(yán)重的地方割據(jù),呈現(xiàn)橫向分散、縱向分離的特色,很多環(huán)境破壞行為和環(huán)境污染問題屢禁不止,被處理企業(yè)消極應(yīng)付,群眾對此意見很大,另一方面環(huán)境監(jiān)察執(zhí)法部門的工作經(jīng)費、工作設(shè)備、人事關(guān)系歸屬地方政府,長期受制于地方政府,在環(huán)境執(zhí)法過程中,環(huán)境監(jiān)察執(zhí)法部門很難挺直腰桿。黨的十八屆五中全會提出,實行省以下環(huán)境監(jiān)察執(zhí)法機構(gòu)垂直管理是我國未來環(huán)境管理體制改革的重大舉措。該論文即從實現(xiàn)垂直管理后,如何有效提升執(zhí)法效能的角度出發(fā),以漯河市為考察對象,查找生態(tài)環(huán)境行政管理體制設(shè)置不合理、生態(tài)環(huán)境監(jiān)察執(zhí)法能力普遍不強、環(huán)境監(jiān)察執(zhí)法監(jiān)督機制不健全和環(huán)境教育的缺乏導(dǎo)致環(huán)境監(jiān)察執(zhí)法難以獲得社會的支持等制約效能提升的因素,深挖問題產(chǎn)生的原因,提出理順管理職能的重新分配、擴展環(huán)境行政執(zhí)法方式、加強環(huán)境監(jiān)察執(zhí)法外部保障制度的建設(shè)、有效引導(dǎo)企業(yè)主動守法和公眾積極護法、提高環(huán)境監(jiān)察執(zhí)法能力和完善垂直管理后的管理機制等對策及建議,進而為垂直管理后的省以下環(huán)境監(jiān)察執(zhí)法機構(gòu)提升效能提供理論和現(xiàn)實參考。
[Abstract]:Since the reform and opening up, environmental protection departments in the traditional administrative system, its weak position led to a large number of environmental supervision and law enforcement problems frequently. Outstanding performance is: on the one hand, environmental monitoring and law enforcement agencies exist more serious local segregation, showing horizontal dispersion, vertical separation characteristics, many environmental damage behavior and environmental pollution problems are not prohibited. On the other hand, the working funds, working equipment and personnel relations of the environmental supervision and law enforcement departments belong to the local government and are subject to the local government for a long time. In the process of environmental law enforcement, it is difficult for environmental supervision and law enforcement departments to stand up straight. The Fifth Plenary session of the 18 CPC Central Committee put forward. The implementation of vertical management of environmental supervision and law enforcement agencies below provincial level is an important measure in the future environmental management system reform in China. This paper starts from the point of view of how to effectively enhance the effectiveness of law enforcement after realizing vertical management. Taking Luohe city as the object of investigation, it is not reasonable to find out the system of ecological environment administration and management, and the law enforcement ability of ecological environment supervision is generally not strong. Environmental monitoring law enforcement and supervision mechanism is not perfect and the lack of environmental education leads to environmental monitoring law enforcement difficult to obtain social support and other factors restricting the effectiveness of the promotion of the causes of deep-digging problems. It is proposed to rationalize the redistribution of management functions, expand the way of environmental administrative law enforcement, strengthen the construction of external safeguard system of environmental supervision and law enforcement, and effectively guide enterprises to take the initiative to abide by the law and protect the law actively by the public. To improve the law enforcement ability of environmental supervision and improve the management mechanism after vertical management, and provide a theoretical and practical reference for the vertical management of environmental monitoring law enforcement agencies after vertical management to enhance the effectiveness of environmental monitoring law enforcement agencies.
