【摘要】:互聯(lián)網(wǎng)金融作為傳統(tǒng)金融模式的創(chuàng)新在近年來(lái)受到人們的普遍關(guān)注,成為普通民眾廣泛熱議的話(huà)題;ヂ(lián)網(wǎng)金融有別于傳統(tǒng)金融模式在于互聯(lián)網(wǎng)金融是依托于互聯(lián)網(wǎng)大數(shù)據(jù)技術(shù)、移動(dòng)通信技術(shù)在傳統(tǒng)金融模式上進(jìn)行的升級(jí),來(lái)實(shí)現(xiàn)資金的融通、支付和信息中介發(fā)展起來(lái)的新金融模式。其本身在不斷發(fā)展過(guò)程中既呈現(xiàn)出互聯(lián)網(wǎng)發(fā)展過(guò)程中的風(fēng)險(xiǎn)特點(diǎn)同時(shí)又具備了傳統(tǒng)金融發(fā)展中的風(fēng)險(xiǎn)特點(diǎn),這就決定了互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)比傳統(tǒng)金融風(fēng)險(xiǎn)更復(fù)雜性、風(fēng)險(xiǎn)治理難度更加困難。我國(guó)互聯(lián)網(wǎng)金融發(fā)展時(shí)間還比較短,在不斷發(fā)展過(guò)程中存在互聯(lián)網(wǎng)金融立法規(guī)范不完善、互聯(lián)網(wǎng)金融企業(yè)市場(chǎng)準(zhǔn)入標(biāo)準(zhǔn)低、混業(yè)經(jīng)營(yíng)等問(wèn)題,但是,從當(dāng)前我國(guó)互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)治理來(lái)看,互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)仍然處于可控范圍之內(nèi)。構(gòu)建互聯(lián)網(wǎng)金融法律治理體系為互聯(lián)網(wǎng)金融創(chuàng)新提供法律支撐,降低互聯(lián)網(wǎng)金融創(chuàng)新風(fēng)險(xiǎn),促進(jìn)互聯(lián)網(wǎng)金融更好發(fā)展應(yīng)該是當(dāng)前防范互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)工作的首要目標(biāo)。黨的十八屆四中全會(huì)提出全面依法治國(guó)的基本方略,這也就為我國(guó)互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)治理提供了法律理論依據(jù),在互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)治理過(guò)程中以我國(guó)現(xiàn)有傳統(tǒng)金融行業(yè)相關(guān)立法為基礎(chǔ)加快互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)治理方面立法,同時(shí)我們還可以借鑒歐美等國(guó)家在互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)治理相關(guān)法律經(jīng)驗(yàn)來(lái)規(guī)范互聯(lián)網(wǎng)金融行業(yè)創(chuàng)新體制來(lái)制定適合我國(guó)互聯(lián)網(wǎng)金融健康發(fā)展的立法監(jiān)管制度;ヂ(lián)網(wǎng)金融立法在堅(jiān)持互聯(lián)網(wǎng)金融創(chuàng)新的基礎(chǔ)上充分發(fā)揮互聯(lián)網(wǎng)金融對(duì)經(jīng)濟(jì)發(fā)展的推動(dòng)作用,保持互聯(lián)網(wǎng)金融行業(yè)持續(xù)發(fā)展,維護(hù)互聯(lián)網(wǎng)金融消費(fèi)者合法權(quán)益。本文除了引言和結(jié)語(yǔ)外文章主要有五部分內(nèi)容。第一部分,主要闡述互聯(lián)網(wǎng)金融的基本定義和分類(lèi)。從互聯(lián)網(wǎng)金融的定義和分類(lèi)進(jìn)行分析便于在對(duì)我國(guó)互聯(lián)網(wǎng)金融清晰認(rèn)識(shí)的基礎(chǔ)上來(lái)預(yù)判互聯(lián)網(wǎng)金融在發(fā)展過(guò)程中可能出現(xiàn)的風(fēng)險(xiǎn)問(wèn)題。第二部分,主要分析我國(guó)互聯(lián)網(wǎng)金融在發(fā)展過(guò)程中呈現(xiàn)出的風(fēng)險(xiǎn);ヂ(lián)網(wǎng)金融作為一種新型金融模式其既有互聯(lián)網(wǎng)技術(shù)本身的特點(diǎn)同時(shí)傳統(tǒng)金融本身的特點(diǎn),從互聯(lián)網(wǎng)金融技術(shù)風(fēng)險(xiǎn)入手來(lái)進(jìn)一步闡述互聯(lián)網(wǎng)金融在發(fā)展過(guò)程中存在的法律風(fēng)險(xiǎn)、監(jiān)管風(fēng)險(xiǎn)、資金流動(dòng)性風(fēng)險(xiǎn),為互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)立法、互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)法律治理體系的構(gòu)建具有目標(biāo)導(dǎo)向作用。第三部分,介紹了我國(guó)當(dāng)前互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)法律治理的現(xiàn)狀。從互聯(lián)網(wǎng)金融企業(yè)本身和互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)法律制度這兩個(gè)層面來(lái)分析互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)治理過(guò)程中存在的互聯(lián)網(wǎng)金融企業(yè)技術(shù)風(fēng)險(xiǎn)、互聯(lián)網(wǎng)金融企業(yè)市場(chǎng)準(zhǔn)入標(biāo)準(zhǔn)風(fēng)險(xiǎn)、互聯(lián)網(wǎng)金融企業(yè)信息披露問(wèn)題、互聯(lián)網(wǎng)金融征信法規(guī)問(wèn)題、互聯(lián)網(wǎng)金融管制法規(guī)欠缺、互聯(lián)網(wǎng)金融監(jiān)管主體不明確、互聯(lián)網(wǎng)金融企業(yè)缺乏市場(chǎng)準(zhǔn)入法律機(jī)制做引導(dǎo)等現(xiàn)狀。第四部分,主要研究的是美國(guó)、英國(guó)和歐盟這三個(gè)國(guó)家和地區(qū)對(duì)于互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)治理的經(jīng)驗(yàn)。美國(guó)對(duì)于互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)治理?yè)碛型晟频娘L(fēng)險(xiǎn)治理法律框架、加強(qiáng)聯(lián)邦政府和地方各州共同監(jiān)管、完善互聯(lián)網(wǎng)金融消費(fèi)者保護(hù)機(jī)制系等措施來(lái)治理互聯(lián)網(wǎng)互聯(lián)網(wǎng)金融風(fēng)險(xiǎn);歐盟則是通過(guò)變革原有的互聯(lián)網(wǎng)金融監(jiān)管法律體系、加強(qiáng)歐洲央行的監(jiān)管和互聯(lián)網(wǎng)金融企業(yè)行業(yè)自律意識(shí)來(lái)治理互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)。英國(guó),一方面充分發(fā)揮互聯(lián)網(wǎng)金融行業(yè)自律協(xié)會(huì)的作用,由互聯(lián)網(wǎng)金融行業(yè)自律協(xié)會(huì)來(lái)加強(qiáng)對(duì)互聯(lián)網(wǎng)金融主體的監(jiān)管,同時(shí)英國(guó)政府也加強(qiáng)對(duì)互聯(lián)網(wǎng)金融主體采取分部門(mén)有針對(duì)性的監(jiān)管。通過(guò)比較美國(guó)、歐盟和英國(guó)對(duì)于互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)不同的治理措施,借鑒和吸收有利于我國(guó)互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)防范、治理的建設(shè)性經(jīng)驗(yàn),為我國(guó)互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)法律治理體系的建立和完善提出借鑒性的建議。第五部分,主要是對(duì)我國(guó)互聯(lián)金融風(fēng)險(xiǎn)法律治理提出的具體建議。由于傳統(tǒng)的金融監(jiān)管法律體系很難適用于互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)監(jiān)管,應(yīng)該結(jié)合互聯(lián)網(wǎng)金融的特點(diǎn)及特有的風(fēng)險(xiǎn),從互聯(lián)網(wǎng)金融風(fēng)險(xiǎn)監(jiān)管立法、征信體系建設(shè)、地方政府對(duì)于互聯(lián)網(wǎng)金融企業(yè)監(jiān)管、互聯(lián)網(wǎng)金融企業(yè)行業(yè)自律建設(shè)等方面相關(guān)制度上對(duì)我國(guó)互聯(lián)網(wǎng)金融的發(fā)展提出了相關(guān)立法建議。
