【摘要】：隨著經(jīng)濟(jì)和全球化的不斷發(fā)展,人們更加深刻的意識(shí)到法治在市場(chǎng)經(jīng)濟(jì)社會(huì)發(fā)展中有著重要的作用。世界經(jīng)濟(jì)的發(fā)展實(shí)踐能夠證明,實(shí)現(xiàn)經(jīng)濟(jì)市場(chǎng)的跨越式發(fā)展是靠政府的主導(dǎo)性力量,有機(jī)整合市場(chǎng)和社會(huì)自組織兩種力量的聯(lián)合推進(jìn)去實(shí)現(xiàn)的,不能單獨(dú)依靠其中的任何一種力量。因此在法治背景下加快構(gòu)建一個(gè)有能力的民族自治地方政府顯得很重要。本文起初對(duì)相關(guān)概念進(jìn)行論述,對(duì)本文的研究對(duì)象做出了明確的相關(guān)理論界定,并在研究大量相關(guān)文獻(xiàn)的基礎(chǔ)上,探討了建設(shè)社會(huì)主義法治國(guó)家對(duì)民族自治地方政府能力的影響。其次是結(jié)合民族自治地方的特殊性及實(shí)際狀況,了解法治背景下民族自治地方政府能力建設(shè)的現(xiàn)狀及不足情況,即:自治能力的建設(shè)存在不完善,實(shí)施還不到位:經(jīng)濟(jì)建設(shè)轉(zhuǎn)型發(fā)展理念有待完善;財(cái)政能力相對(duì)較弱;依法行使文化建設(shè)的能力有待加強(qiáng);社會(huì)控制與維穩(wěn)能力有待提高。研究分析其形成的原因,即:有關(guān)法律法規(guī)體系不健全;對(duì)民族區(qū)域自治法的研究嚴(yán)重滯后;依法自主與自治能力較弱;政府的運(yùn)行方式不合理:資源相對(duì)缺乏。從而發(fā)現(xiàn)要素中應(yīng)該突出的是的依法自主與自治能力、公共政策能力、資源提取能力、學(xué)習(xí)與創(chuàng)新能力、社會(huì)控制與管理能力。唯有把以上能力最先建設(shè)及發(fā)展好,才能符合民族自治地方的實(shí)際要求,并可以保持經(jīng)濟(jì)與社會(huì)的快速、均衡、健康發(fā)展。最后,提出了提高能力建設(shè)的主要途徑,包括內(nèi)部途徑:必須鞏固和發(fā)展政府的權(quán)威性建設(shè),必須加強(qiáng)人力資源建設(shè),必須加快推動(dòng)電子政務(wù)建設(shè),必須保證財(cái)政資源與稅收的穩(wěn)定增長(zhǎng);外部途徑:加強(qiáng)地方政府的扶持和支援,加強(qiáng)地區(qū)之間的對(duì)口支援,建立和完善公共政策信息系統(tǒng),強(qiáng)化創(chuàng)建驅(qū)動(dòng)體系。
[Abstract]:With the continuous development of economy and globalization, people are more deeply aware that the rule of law plays an important role in the development of market economy society. The development practice of the world economy can prove that the rule of law plays an important role in the development of market economy. The leapfrog development of the economic market is realized by the combination of the leading forces of the government, the organic integration of the market and the social self-organization. Therefore, it is very important to accelerate the construction of a capable national autonomous local government under the background of the rule of law. On the basis of studying a large number of relevant literature, this paper makes a clear definition of the relevant theory. This paper probes into the influence of building a socialist country ruled by law on the government capacity of national autonomous areas. Secondly, combining with the particularity and actual situation of national autonomous areas, the author understands the present situation and deficiency of the government capacity building of national autonomous areas under the background of rule of law. That is, the construction of autonomous capacity is not perfect, the implementation is not in place: the concept of economic construction transformation and development needs to be improved; the financial capacity is relatively weak; the ability to exercise cultural construction according to law needs to be strengthened; The reasons for the formation of social control and stability need to be improved, that is, the system of relevant laws and regulations is not perfect, the study of regional national autonomy law is seriously lagging behind, the ability of autonomy and autonomy according to law is weak; The operating mode of the government is unreasonable: the resources are relatively lacking. Thus, it is found that the ability of autonomy and autonomy according to law, the ability of public policy, the ability of resource extraction, the ability of learning and innovation should be prominent among the elements. The ability of social control and management. Only by building and developing these abilities first can we meet the actual requirements of national autonomous areas, and can we maintain the rapid, balanced and healthy development of the economy and society. The main ways to improve capacity building, including internal ones, are suggested: the need to consolidate and develop the authority of governments, the need to strengthen human resources, and the need to accelerate the promotion of e-government, The external ways are to strengthen the support and support of the local government, to strengthen the regional counterpart support, to establish and perfect the public policy information system, and to strengthen the establishment of the driving system.
