深圳市大部制改革后的食品安全監(jiān)管體制建設(shè)研究

【摘要】:食品是特殊的產(chǎn)品,食品安全一直以來都是社會關(guān)注的熱點(diǎn)和焦點(diǎn)問題。隨著社會經(jīng)濟(jì)的發(fā)展,食品安全問題層出不窮,嚴(yán)重危害人民群眾的身體健康和政府監(jiān)管形象。原有的“分段管理、多頭管理”的食品安全監(jiān)管體制已明顯不能適應(yīng)監(jiān)管形勢發(fā)展的需要,要對現(xiàn)有的食品安全監(jiān)管體制進(jìn)行改革和完善,已成為國家和各級政府的共識。2009年,深圳市實(shí)施“大部制”改革,組建深圳市市場監(jiān)督管理局,承擔(dān)食品安全監(jiān)管的重任,打通了生產(chǎn)、流通、餐飲的三個(gè)環(huán)節(jié)食品安全監(jiān)管壁壘,建立起全過程、全覆蓋、無縫隙、可追溯的監(jiān)管責(zé)任鏈條,在全國范圍內(nèi)形成了獨(dú)一無二的食品安全監(jiān)管體制,對我國深化食品安全大部制改革、構(gòu)建新型食品安全監(jiān)管體系提供參考和借鑒。本文首先對現(xiàn)有食品安全監(jiān)管體制的相關(guān)研究進(jìn)行梳理,分別描述了自上世紀(jì)80年代至今我國和深圳市食品安全監(jiān)管體制的歷史沿革過程。其次,對深圳市大部制改革后的食品安全監(jiān)管體制分別從機(jī)構(gòu)設(shè)置、職能分工、人員編制、檢驗(yàn)資源和監(jiān)管數(shù)據(jù)方面予以詳細(xì)介紹。隨后,結(jié)合實(shí)際的監(jiān)管案例,分析了改革前深圳市分段管理的食品安全監(jiān)管體制存在著執(zhí)法力量分散、監(jiān)管漏洞繁多、部門短板制約和邊緣化趨勢明顯等問題。再次,通過效能對比、系統(tǒng)分析等方法,總結(jié)出在新的監(jiān)管體制下,食品安全監(jiān)管存在“大市場、大部門、大監(jiān)管、大服務(wù)”等明顯監(jiān)管優(yōu)勢,并客觀分析得出新的監(jiān)管體制目前存在法規(guī)體系滯后和執(zhí)法體系不統(tǒng)一、責(zé)任邊界不清晰、隊(duì)伍素質(zhì)難以適應(yīng)監(jiān)管需要、上級部門多頭對口和監(jiān)管優(yōu)勢未完全發(fā)揮等問題。最后,通過借鑒國外先進(jìn)國家如丹麥、英國和加拿大的食品安全單部門監(jiān)管模式的先進(jìn)經(jīng)驗(yàn),提出完善建設(shè)深圳市食品安全監(jiān)管體制的建議:推進(jìn)法制建設(shè)的深入化、厘清監(jiān)管責(zé)任邊界、加強(qiáng)配置監(jiān)管資源、提高監(jiān)管隊(duì)伍專業(yè)素質(zhì)和推進(jìn)監(jiān)管手段信息化等。
[Abstract]:Food is a special product, food safety has always been the focus of attention. With the development of social economy, food safety problems emerge in endlessly, seriously endangering the people's health and the image of government supervision. The original food safety supervision system of "segmented management, multi-management" has obviously failed to meet the needs of the development of the regulatory situation. It has become a consensus of the state and governments at all levels to reform and improve the existing food safety regulatory system. Shenzhen has implemented the "big ministry" reform, set up the Shenzhen Municipal Market Supervision and Administration Bureau, shouldered the heavy responsibility of food safety supervision and control, has broken through the food safety supervision barriers in the three links of production, circulation and catering, and has established a whole process and full coverage. The seamless and traceable chain of supervision responsibility has formed a unique food safety supervision system in the whole country, which provides a reference and reference for deepening the reform of food safety and constructing a new type of food safety supervision system in our country. In this paper, the current research on food safety supervision system is firstly reviewed, and the historical evolution process of food safety supervision system in China and Shenzhen is described respectively from the 1980s to now. Secondly, the food safety supervision system of Shenzhen after the reform is introduced in detail from the aspects of organization setting, function division, personnel establishment, inspection resources and supervision data. Then, combining with the actual supervision cases, this paper analyzes the problems of the food safety supervision system in Shenzhen before the reform, such as scattered law enforcement power, various regulatory loopholes, the obvious trend of department shortboard restriction and marginalization, and so on. Thirdly, through the methods of efficiency comparison and systematic analysis, it is concluded that under the new regulatory system, there are obvious regulatory advantages in food safety supervision, such as "large market, large department, large supervision, large service" and so on. The objective analysis shows that the new regulatory system is lagging behind and the law enforcement system is not unified, the boundary of responsibility is not clear, the quality of the team is difficult to adapt to the need of supervision, and the superior department has not fully brought into full play its advantages. Finally, by learning from the advanced experience of the food safety single sector supervision model of the advanced countries such as Denmark, Britain and Canada, the paper puts forward some suggestions to perfect the food safety supervision system in Shenzhen: to promote the deepening of the legal system, To clarify the boundary of supervision responsibility, to strengthen the allocation of supervision resources, to improve the professional quality of the supervision team and to promote the informatization of supervision means, etc.
