【摘要】:改革開放以后,我國經(jīng)濟迅速發(fā)展,隨著人們生活水平的提高,越來越多的人們開始重視身體健康與營養(yǎng)保健,在此情況下,在上世紀80年代末我國保健食品行業(yè)逐漸開始發(fā)展,作為一種新興行業(yè),在初期并沒有得到足夠重視,行業(yè)的發(fā)展也經(jīng)歷了幾番起落,F(xiàn)在保健康食品行業(yè)逐漸形成規(guī)模,已經(jīng)成為國民經(jīng)濟發(fā)展中不可或缺的一部分,伴隨著行業(yè)的不斷發(fā)展壯大,出現(xiàn)一些問題也是在所難免的。因此,研究我國保健食品行業(yè)的政府監(jiān)管很有必要。本文在梳理保健食品行業(yè)政府監(jiān)管的相關研究后,明確文章研究的內(nèi)容,通過對我國保健食品行業(yè)的發(fā)展歷程以及目前的發(fā)展趨勢進行分析,認為法律法規(guī)出臺不及時、保健食品質(zhì)量標準體系不完善、準入審批與后期監(jiān)管相脫節(jié)、對保健食品行業(yè)虛假宣傳等違法違規(guī)現(xiàn)象監(jiān)管無力、保健食品質(zhì)量檢驗檢測能力低、產(chǎn)品標簽和說明書管理不規(guī)范等是目前我國保健食品行業(yè)政府監(jiān)管存在的主要問題。針對這些問題,提出造成這些問題的原因主要有以下幾個方面,我國保健食品行業(yè)發(fā)展起步晚、評價標準難以有效界定、產(chǎn)品監(jiān)管主體不明確、對違法違規(guī)行為打擊力度不夠、對檢驗檢測機構的投入不足、缺乏對行業(yè)從業(yè)人員和消費者的培訓與教育。通過對比借鑒日本和美國保健食品行業(yè)的政府監(jiān)管措施,對我國保健食品行業(yè)施行分類管理和對保健食品宣傳內(nèi)容加以限定在我國應用的可行性進行探索,進一步提出要加強我國保健食品行業(yè)的政府監(jiān)管,需要盡快建立健全相關的行政法律法規(guī)和行業(yè)標準,完善保健食品行業(yè)政府監(jiān)管機制,強化政府監(jiān)管的技術支撐,加強對政府監(jiān)管人員、企業(yè)人員、消費者的培訓與宣傳工作。
[Abstract]:After the reform and opening up, the economy of our country develops rapidly. With the improvement of people's living standard, more and more people begin to pay attention to their health and nutrition. At the end of the 1980s, the health food industry in our country began to develop gradually. As a new industry, it did not receive enough attention at the initial stage, and the development of the industry also experienced several ups and downs. Now the health food industry is gradually taking shape in scale. Has become an indispensable part of the national economic development, with the continuous development of the industry, there are some problems are inevitable. It is necessary to study the government supervision of the health food industry in China. After combing the relevant research on the government supervision of the health food industry, this paper clarifies the content of the article. Based on the analysis of the development course and the current development trend of the health food industry in China, it is concluded that the laws and regulations are not issued in time, the quality standard system of the health food is not perfect, and the entrance examination and approval is out of step with the later supervision. The supervision of illegal phenomena such as false propaganda in the health food industry is weak, and the ability of inspection and detection of health food quality is low, The nonstandard management of product labels and instructions is the main problem existing in the government supervision of the health food industry in China at present. In view of these problems, the main reasons for these problems are put forward in the following aspects. The development of health food industry in our country started late, the evaluation standard is difficult to define effectively, the main body of product supervision is not clear, the crackdown on illegal and illegal behavior is not enough, and the investment in inspection and inspection organization is insufficient. Lack of training and education for industry workers and consumers. By comparing government regulatory measures for the health food industry in Japan and the United States, This paper explores the feasibility of classifying the health food industry and limiting the content of health food propaganda in our country, and further proposes to strengthen the government supervision of the health food industry in China. It is necessary to establish and improve relevant administrative laws and regulations and industry standards as soon as possible, perfect the government supervision mechanism of health food industry, strengthen the technical support of government supervision, and strengthen the training and propaganda work for government supervisors, enterprise personnel and consumers.
