【摘要】：研究民辦學(xué)校舉辦者的辦學(xué)動(dòng)機(jī),可以找到發(fā)揮其主體性和規(guī)范其行為的路徑,為國(guó)家制訂相關(guān)政策提供依據(jù)。以人性假設(shè)理論為工具,運(yùn)用質(zhì)化訪談法研究發(fā)現(xiàn),民辦學(xué)校舉辦者具有經(jīng)濟(jì)人、社會(huì)人、自我實(shí)現(xiàn)人和復(fù)雜人等多種辦學(xué)利益訴求。然而,法律賦予舉辦者的財(cái)產(chǎn)與非財(cái)產(chǎn)類權(quán)利與其訴求之間還存在著一定的差距,由此引發(fā)了舉辦者的短期行為和過(guò)度控制行為�；�解國(guó)家需要與舉辦者利益訴求之間的矛盾,應(yīng)在新《民辦教育促進(jìn)法》分類管理的框架下,明確舉辦者的權(quán)利內(nèi)容,建立權(quán)利救濟(jì)制度,健全權(quán)力監(jiān)督制度,完善義務(wù)責(zé)任制度,從而實(shí)現(xiàn)兩者利益的最優(yōu)化。
[Abstract]:By studying the motivation of the private school organizers, we can find the way to give full play to their subjectivity and standardize their behavior, and provide the basis for the country to formulate relevant policies. Using the theory of human nature hypothesis as a tool, we can find out by using qualitative interview method. The organizers of private schools have a variety of interests, such as economic person, social person, self-actualization person and complex person, etc. However, there is still a certain gap between the property rights and non-property rights conferred by law on the organizers and their demands. This leads to the short-term behavior and excessive control of the organizers. In order to resolve the contradiction between the national needs and the interests of the organizers, it is necessary to clarify the content of the organizers' rights under the framework of the classified management of the new Private Education Promotion Law. Establish the system of right relief, perfect the system of power supervision, perfect the system of obligation and responsibility, and realize the optimization of both interests.
