【摘要】:隨著科技的高速發(fā)展,人類社會(huì)已經(jīng)告別傳統(tǒng)的工業(yè)時(shí)代,進(jìn)入知識(shí)經(jīng)濟(jì)時(shí)代,科技創(chuàng)新已經(jīng)成為推動(dòng)社會(huì)和經(jīng)濟(jì)發(fā)展的關(guān)鍵因素。企業(yè)作為全球化技術(shù)競(jìng)爭(zhēng)的主體,現(xiàn)代發(fā)明創(chuàng)造的主導(dǎo)力量,成為我國(guó)技術(shù)創(chuàng)新的推動(dòng)力量。職務(wù)發(fā)明報(bào)酬制度作為職務(wù)發(fā)明制度的重要組成部分,直接關(guān)系到企業(yè)與發(fā)明人之間的利益分配問(wèn)題,其本身的科學(xué)合理性在很大程度上決定了企業(yè)創(chuàng)造和運(yùn)用知識(shí)產(chǎn)權(quán)的積極性。我國(guó)職務(wù)發(fā)明獎(jiǎng)酬制度散落于各項(xiàng)法規(guī)中,無(wú)論是從理論基礎(chǔ)還是從制度設(shè)計(jì)角度,都缺乏合理性,隨著《職務(wù)發(fā)明條例(草案)》的公布,職務(wù)發(fā)明獎(jiǎng)酬制度進(jìn)一步成為社會(huì)各界關(guān)注的熱點(diǎn)。然而,現(xiàn)有理論討論及制度安排主要站在傳統(tǒng)工業(yè)領(lǐng)域的角度,與工業(yè)時(shí)代相適應(yīng),較少的考慮知識(shí)經(jīng)濟(jì)時(shí)代的特點(diǎn),沒(méi)有考慮到技術(shù)領(lǐng)域的新變化。隨著科技的發(fā)展,人類社會(huì)已經(jīng)開(kāi)始告別傳統(tǒng)的工業(yè)經(jīng)濟(jì)時(shí)代,進(jìn)入知識(shí)經(jīng)濟(jì)時(shí)代,網(wǎng)絡(luò)技術(shù)、基因技術(shù)、電子技術(shù)、新材料技術(shù)深刻影響著人類社會(huì)的發(fā)展。專利制度是與科技創(chuàng)新聯(lián)系最為密切的法律制度,專利制度的建設(shè)要順應(yīng)技術(shù)領(lǐng)域的發(fā)展,從而對(duì)技術(shù)創(chuàng)新起到積極地推動(dòng)作用。因此,我們應(yīng)該加快專利制度的創(chuàng)新,適應(yīng)知識(shí)經(jīng)濟(jì)時(shí)代的新特征。本文通過(guò)對(duì)國(guó)內(nèi)外文獻(xiàn)及相關(guān)案例的梳理,分析了強(qiáng)化并提高職務(wù)發(fā)明人獲得報(bào)酬比例的理論邏輯漏洞,重新認(rèn)識(shí)現(xiàn)代企業(yè)專利資產(chǎn)經(jīng)營(yíng)管理過(guò)程及專利制度的宗旨。進(jìn)而指出,現(xiàn)行制度的各項(xiàng)設(shè)計(jì)與學(xué)者的優(yōu)化建議也并不是圍繞通說(shuō)理論展開(kāi)的,不僅難以實(shí)現(xiàn)利益的均衡分配,在實(shí)踐中還會(huì)將發(fā)明人與企業(yè)推向?qū)α用?容易引發(fā)糾紛。最后,本文在結(jié)合英國(guó)、德國(guó)、美國(guó)等立法技術(shù)較高國(guó)家相關(guān)做法的基礎(chǔ)上,建議從理論上重新認(rèn)識(shí)了職務(wù)發(fā)明人獲得報(bào)酬權(quán)的法律性質(zhì),構(gòu)建職務(wù)發(fā)明分類體系,探討合理的發(fā)明成果利益分配機(jī)制。
[Abstract]:With the rapid development of science and technology, human society has said goodbye to the traditional industrial era and entered the era of knowledge economy. Scientific and technological innovation has become the key factor to promote social and economic development. As the main body of global technology competition and the leading force of modern invention and creation, enterprises have become the driving force of technological innovation in China. As an important part of the job invention system, the compensation system of job invention is directly related to the distribution of interests between the enterprise and the inventor. To a large extent, its scientific rationality determines the enthusiasm of enterprises to create and use intellectual property rights. The system of reward and reward for job inventors in our country is scattered in various laws and regulations, which is lack of reasonableness in terms of both theoretical basis and system design. With the publication of the regulations on Job Invention (draft), The system of job invention award and reward has become the focus of attention from all walks of life. However, the existing theoretical discussions and institutional arrangements mainly stand in the traditional industrial field, adapt to the industrial era, less consider the characteristics of the era of knowledge economy, and do not take into account the new changes in the field of technology. With the development of science and technology, human society has begun to bid farewell to the traditional era of industrial economy, entering the era of knowledge economy, network technology, gene technology, electronic technology, new material technology has a profound impact on the development of human society. Patent system is the legal system which is most closely related to scientific and technological innovation. The construction of patent system should conform to the development of the technical field and thus play an active role in promoting technological innovation. Therefore, we should speed up the innovation of patent system to adapt to the new characteristics of the era of knowledge economy. By combing the domestic and foreign literature and related cases, this paper analyzes the theoretical logic loophole of strengthening and improving the proportion of remuneration to the job inventors, and reunderstands the management process of patent assets and the purpose of patent system in modern enterprises. Furthermore, it is pointed out that the design of the current system and the optimization suggestions of scholars are not carried out around the theory of general theory, which is not only difficult to realize the balanced distribution of benefits, but also pushes the inventor and the enterprise to the opposite level in practice, which can easily lead to disputes. Finally, on the basis of the relevant practices of the United Kingdom, Germany, the United States and other countries with relatively high legislation technology, it is suggested that the legal nature of the right of the duty inventor to receive remuneration should be reunderstood in theory, and the classification system of the job invention should be constructed. To explore a reasonable mechanism for the distribution of benefits of invention achievements.
