刑事司法協(xié)助中的中央機關(guān)

【摘要】：司法協(xié)助中的中央機關(guān)聯(lián)系機制的發(fā)展在一些國際公約、雙邊條約以及中外國內(nèi)立法中有較清晰的反映。各國中央機關(guān)的設置,特別是數(shù)量上存在不少差異,客觀上對于司法協(xié)助在地區(qū)和全球范圍的規(guī)范化和標準化造成了巨大困難。從國際公約的發(fā)展看,中央機關(guān)的設置呈現(xiàn)出統(tǒng)一性趨勢。目前國內(nèi)關(guān)于中央機關(guān)的職能主要包括對外聯(lián)系、程序性確認以及對內(nèi)協(xié)調(diào)等三個方面的觀點值得推敲。中央機關(guān)應當重點履行輔助決策、服務執(zhí)法、組織協(xié)調(diào)、實施監(jiān)督四個方面的職能。在政治經(jīng)濟一體化和互信程度較高的歐洲,司法協(xié)助程序的扁平化趨勢日益明顯,中央機關(guān)聯(lián)系機制已經(jīng)遭到前所未有的挑戰(zhàn)。
[Abstract]:The development of central organ contact mechanism in mutual legal assistance is clearly reflected in some international conventions, bilateral treaties and domestic and foreign legislation. There are many differences in the establishment of central organs in various countries, especially in quantity, which objectively causes great difficulties to the standardization and standardization of mutual legal assistance at the regional and global levels. From the development of international conventions, the establishment of central organs shows a unified trend. At present, the functions of central organs mainly include external contact, procedural confirmation and internal coordination. Central organs should focus on supporting decision-making, serving law enforcement, organizing and coordinating, and carrying out supervision. In Europe, where the degree of political and economic integration and mutual trust is high, the flattening trend of mutual legal assistance procedure is becoming more and more obvious, and the contact mechanism of central authorities has been challenged unprecedented.
