中華老字號(hào)知識(shí)產(chǎn)權(quán)的國(guó)際保護(hù)

【摘要】:中華老字號(hào)是具有廣泛的知名度和美譽(yù)度的字號(hào),它不但是中華民族優(yōu)秀傳統(tǒng)文化重要組成部分,而且還是中華老字號(hào)企業(yè)重要的無(wú)形財(cái)產(chǎn)。自從入世以來(lái),國(guó)際貿(mào)易的交往日趨頻繁,中國(guó)也進(jìn)一步地融入經(jīng)濟(jì)全球化的浪潮中來(lái),這對(duì)我國(guó)經(jīng)濟(jì)發(fā)展起到重大推動(dòng)作用。然而,在實(shí)行中國(guó)企業(yè)“走出去”的戰(zhàn)略過(guò)程中,由于很多中華老字號(hào)企業(yè)在開(kāi)拓國(guó)內(nèi)外市場(chǎng)中沒(méi)有形成良好廣闊的國(guó)際視野,以及對(duì)自身知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)重視不足等原因,因此,導(dǎo)致頻繁出現(xiàn)海內(nèi)外競(jìng)爭(zhēng)主體侵犯中華老字號(hào)知識(shí)產(chǎn)權(quán)權(quán)益現(xiàn)象的發(fā)生,比如老字號(hào)被搶注、被“搭便車(chē)”等,這給老字號(hào)信譽(yù)帶來(lái)重度毀損,嚴(yán)重的阻礙了老字號(hào)的健康發(fā)展。可見(jiàn),中華老字號(hào)企業(yè)的知識(shí)產(chǎn)權(quán)保護(hù)問(wèn)題逐漸成為這些企業(yè)參與國(guó)際競(jìng)爭(zhēng)所面臨的重大現(xiàn)實(shí)挑戰(zhàn)。因此,我國(guó)應(yīng)致力于提出中華老字號(hào)知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)的切實(shí)可行的對(duì)策和方案,以解中華老字號(hào)企業(yè)參與國(guó)際競(jìng)爭(zhēng)時(shí)所面臨的知識(shí)產(chǎn)權(quán)保護(hù)問(wèn)題之困。 知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)制度是國(guó)際政治、國(guó)際經(jīng)濟(jì)、國(guó)際技術(shù)水平、國(guó)際貿(mào)易發(fā)展到一定歷史階段的必然產(chǎn)物,它發(fā)展最顯著的表現(xiàn)形式就是知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)公約或協(xié)議的建立,并通過(guò)國(guó)內(nèi)知識(shí)產(chǎn)權(quán)制度來(lái)實(shí)現(xiàn)的。我國(guó)知識(shí)產(chǎn)權(quán)保護(hù)與國(guó)際知識(shí)產(chǎn)權(quán)保護(hù)是一榮俱榮、一損俱損的相互關(guān)系,只有我國(guó)中華老字號(hào)知識(shí)產(chǎn)權(quán)的立法積極地向國(guó)際知識(shí)產(chǎn)權(quán)法律制度標(biāo)準(zhǔn)靠攏,中華老字號(hào)的企業(yè)才能地獲得更先進(jìn)水平的國(guó)際知識(shí)產(chǎn)權(quán)保護(hù)。商號(hào)權(quán)是各國(guó)法律的重要內(nèi)容,在當(dāng)前日趨頻繁的國(guó)際貿(mào)易中受到更為廣泛和嚴(yán)格的法律保護(hù)。然而,當(dāng)前我國(guó)對(duì)商號(hào)權(quán)的立法是處于真空狀態(tài),因此,我國(guó)應(yīng)該致力于商號(hào)權(quán)方面的立法,積極地向國(guó)際知識(shí)產(chǎn)權(quán)保護(hù)標(biāo)準(zhǔn)靠攏,以尋求知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)公約或條約的保護(hù)。同時(shí),中華老字號(hào)企業(yè)也應(yīng)該注重從中華老字號(hào)著作權(quán)保護(hù)、商業(yè)秘密權(quán)保護(hù)、馳名商標(biāo)保護(hù)等多元角度加強(qiáng)自身知識(shí)產(chǎn)權(quán)保護(hù)的建設(shè)。這是因?yàn)橹鳈?quán)保護(hù)、商業(yè)秘密權(quán)保護(hù)、馳名商標(biāo)保護(hù)都是國(guó)際知識(shí)產(chǎn)權(quán)保護(hù)的重要內(nèi)容,只是在之前的中華老字號(hào)企業(yè)知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)不到位,忽略這些保護(hù)的途徑而已。因此,通過(guò)對(duì)中華老字號(hào)知識(shí)產(chǎn)權(quán)國(guó)際保護(hù)的研究,首先,可以為中華老字號(hào)企業(yè)積極地參與國(guó)際市場(chǎng)競(jìng)爭(zhēng)提供有力的法律支撐;其次,以國(guó)際知識(shí)產(chǎn)權(quán)保護(hù)制度為參考,加強(qiáng)中華老字號(hào)商號(hào)權(quán)的立法,構(gòu)建我國(guó)中華老字號(hào)知識(shí)產(chǎn)權(quán)保護(hù)體系,可促使我國(guó)民商法律制度與國(guó)際法律制度的接軌,并有利于打破發(fā)展中國(guó)家與發(fā)達(dá)國(guó)家對(duì)知識(shí)產(chǎn)權(quán)保護(hù)水平的不平衡性;最后,可以避免我國(guó)動(dòng)輒上百年的中華老字號(hào)的民族優(yōu)秀傳統(tǒng)文化在激烈的國(guó)際競(jìng)爭(zhēng)中毀于一旦的厄運(yùn)。
[Abstract]:As an important part of the excellent traditional culture of the Chinese nation and an important intangible property of the Chinese old-name enterprises, the Chinese old-name has a wide range of popularity and good reputation, and it is not only an important part of the excellent traditional culture of the Chinese nation. Since China's entry into WTO, the exchanges of international trade have become more and more frequent, and China has also been further integrated into the tide of economic globalization, which has played an important role in promoting China's economic development. However, in the process of implementing the strategy of "going out" by Chinese enterprises, many well-known Chinese enterprises have not formed a good and broad international vision in opening up domestic and foreign markets, as well as insufficient attention to their own awareness of intellectual property protection, and so on. As a result, frequent violations of the intellectual property rights and interests of traditional Chinese brands by competitors at home and abroad have occurred, for example, old names have been scrambled for registration and "hitchhiked", and so on, which has seriously damaged the reputation of old brands. It has seriously hindered the healthy development of old brands. It can be seen that the intellectual property protection of Chinese established enterprises has gradually become a major practical challenge for these enterprises to participate in international competition. Therefore, our country should strive to put forward feasible countermeasures and plans for the international protection of the intellectual property rights of Chinese old-name enterprises, in order to solve the problems of intellectual property protection faced by the Chinese old-name enterprises when they participate in the international competition. The international protection system of intellectual property rights is the inevitable product of international politics, international economy, international technical level, and the development of international trade to a certain historical stage. The most remarkable manifestation of its development is the establishment of the Convention or Agreement on the International Protection of intellectual property Rights. And through the domestic intellectual property system to achieve. The protection of intellectual property rights in China and the protection of international intellectual property rights are prosperous and damaged. Only the legislation of intellectual property rights of old Chinese brands in China is actively close to the legal system standards of international intellectual property rights. Chinese established enterprises can obtain a more advanced level of international intellectual property protection. Trade name right is an important part of the laws of various countries, which is protected by more extensive and strict laws in the increasingly frequent international trade. However, at present, the legislation of trade name right in our country is in a vacuum state. Therefore, our country should devote ourselves to the legislation of trade name right and actively move closer to the international intellectual property protection standard. Therefore, through the study of the international protection of intellectual property rights of old Chinese brands, first of all, it can provide strong legal support for Chinese established enterprises to actively participate in the international market competition. Secondly, taking the international intellectual property protection system as a reference, strengthening the legislation of the right of old Chinese brands and constructing the intellectual property protection system of Chinese old brands can promote the integration of China's civil and commercial legal system with the international legal system.
