【摘要】：國際貨物買賣是發(fā)生在不同的國家或地區(qū)間的貨物交易行為和過程,一般具有數(shù)量多、環(huán)節(jié)多、手續(xù)繁、運(yùn)程遠(yuǎn)、周期長等特點(diǎn)。由此不難看出,國際貨物買賣活動的實(shí)際履約難度和面臨的風(fēng)險機(jī)會也會隨之加大,本文主要闡述了違反國際貨物買賣合同時,各國普遍實(shí)行的幾種違約救濟(jì)方法的內(nèi)容及其特點(diǎn)。從國際、各國及中國立法三個方面上對違約救濟(jì)制度進(jìn)行了比較研究。文章通過分析、借鑒國際及國外違約救濟(jì)制度的先進(jìn)立法,清晰地勾勒出完善中國合同相關(guān)立法的基本思路,并提出了一系列的立法建議。
[Abstract]:International trade of goods is a kind of behavior and process of goods transaction which takes place in different countries or regions. Generally, it has the characteristics of more quantity, more links, complicated formalities, long transportation course and long cycle, and so on. From this, it is not difficult to see that the actual performance difficulty and the risk opportunities of international goods trading activities will also increase accordingly. This article mainly expounds the breach of the international contract for the sale of goods. The contents and characteristics of several kinds of remedies for breach of contract widely implemented in various countries. This paper makes a comparative study on the remedy system of breach of contract from three aspects: international, national and Chinese legislation. By analyzing, drawing lessons from the advanced legislation of international and foreign remedies for breach of contract, this paper clearly outlines the basic ideas of perfecting the relevant legislation of contracts in China, and puts forward a series of legislative suggestions.
