【摘要】:全球化的迅猛發(fā)展使得各國(guó)間的關(guān)系更加緊密,國(guó)與國(guó)之間的人員來(lái)往也日益頻繁,由此也就出現(xiàn)了諸如中外通婚、出國(guó)留學(xué)、探親訪友、跨國(guó)移民和收養(yǎng)等跨國(guó)人員流動(dòng)現(xiàn)象。而所有的這些現(xiàn)象無(wú)一不觸及到自然人的國(guó)籍問(wèn)題。由于國(guó)籍立法在現(xiàn)階段還是各國(guó)根據(jù)自己的政治經(jīng)濟(jì)狀況和傳統(tǒng)習(xí)慣,在維護(hù)本國(guó)國(guó)家利益的基礎(chǔ)上進(jìn)行的國(guó)內(nèi)立法,國(guó)際社會(huì)到目前為止并沒(méi)有統(tǒng)一的標(biāo)準(zhǔn),這又勢(shì)必導(dǎo)致國(guó)籍沖突的出現(xiàn),其中公民的雙重國(guó)籍現(xiàn)象是困擾各國(guó)政府的重大難題。針對(duì)本國(guó)公民出現(xiàn)的雙重國(guó)籍,以前的大多數(shù)國(guó)家多是采取一種抵制的態(tài)度,不承認(rèn)公民的雙重國(guó)籍,但是隨著國(guó)際新形勢(shì)的發(fā)展,以往否定雙重國(guó)籍的國(guó)家,為了本國(guó)利益轉(zhuǎn)而對(duì)雙重國(guó)籍采取了寬容態(tài)度,或明確承認(rèn),或加以默認(rèn),或?qū)ζ溆袟l件的接納。我國(guó)既是世界上經(jīng)濟(jì)發(fā)展最快的發(fā)展中大國(guó),又是人口最多的發(fā)展中大國(guó)。隨著改革開(kāi)放的進(jìn)一步深入和對(duì)外交流的日益頻繁,人才的引進(jìn)和海外移民的增多使我國(guó)所面臨的雙重國(guó)籍現(xiàn)象更為嚴(yán)重,而我國(guó)于1980年頒布的《國(guó)籍法》一直堅(jiān)持單一國(guó)籍原則,不承認(rèn)公民的雙重國(guó)籍,這一規(guī)定在解決新形勢(shì)下我國(guó)所面臨的雙重國(guó)籍問(wèn)題明顯力不從心。在對(duì)待華人國(guó)籍問(wèn)題上,建國(guó)初,我國(guó)政府為了華人的利益和國(guó)家的安全,采取了不允許華人擁有雙重國(guó)籍的政策,這在當(dāng)時(shí)確有積極作用;但是現(xiàn)在,隨著我國(guó)國(guó)際地位的提高,海外華人的生存環(huán)境已經(jīng)沒(méi)有那么糟糕,相反他們大多都具備了較強(qiáng)的經(jīng)濟(jì)實(shí)力,并且有著投資祖國(guó)建設(shè),為祖國(guó)統(tǒng)一大業(yè)出力獻(xiàn)策的愛(ài)國(guó)之心,為此他們迫切希望重新獲得中國(guó)國(guó)籍。面對(duì)這些新情況,我國(guó)在當(dāng)前加快和平崛起的進(jìn)程中,應(yīng)該以更長(zhǎng)遠(yuǎn)的眼光、以海納百川的胸懷對(duì)公民的雙重國(guó)籍采取有限承認(rèn)的原則,只有這樣才能滿(mǎn)足一些特殊群體對(duì)雙重國(guó)籍的迫切呼喚;只有這樣才能更好地為我國(guó) 的發(fā)展吸納人才,才可以為我國(guó)的經(jīng)濟(jì)迅猛發(fā)展創(chuàng)造良好的國(guó)際環(huán)境。 本文在闡述國(guó)籍基本理論的基礎(chǔ)上,對(duì)國(guó)籍沖突,尤其是雙重國(guó)籍進(jìn)行了詳細(xì)研究,并通過(guò)分析國(guó)外處理雙重國(guó)籍的實(shí)踐,對(duì)我國(guó)在解決這一問(wèn)題所遇到的困難和具體處理辦法給出了自己的分析與建議。
[Abstract]:With the rapid development of globalization, the relations between countries have become closer and more frequent among countries. As a result, such as intermarriage, studying abroad, visiting relatives and friends have emerged. The phenomenon of intercountry migration and adoption. All these phenomena touch upon the nationality of natural persons. As nationality legislation is still domestic legislation carried out by various countries at this stage on the basis of their own political and economic conditions and traditional customs and on the basis of safeguarding their national interests, so far the international community has no unified standards. This is bound to lead to the emergence of nationality conflicts, in which dual citizenship is a major problem puzzling governments. In view of the dual nationality of their citizens, most of the countries in the past adopted a resistance attitude and did not recognize the dual citizenship of their citizens. However, with the development of the new international situation, countries that had previously denied dual nationality, In the interest of their own country, they have adopted a tolerant attitude towards dual nationality, either explicitly recognized, acquiesced in, or conditionally accepted. China is not only the fastest developing country in the world, but also the most populous one. With the further deepening of reform and opening up and the increasing frequency of foreign exchanges, the introduction of talents and the increase of overseas immigrants have made the phenomenon of dual nationality in China more serious. However, the nationality Law promulgated in 1980 has always adhered to the principle of single nationality and refused to recognize the dual nationality of citizens. This provision is obviously unable to cope with the problem of dual nationality faced by our country under the new situation. On the issue of Chinese nationality, at the beginning of the founding of the people's Republic of China, the Chinese government adopted a policy of not allowing Chinese to have dual nationality for the sake of the interests of the Chinese people and national security. This did play a positive role at that time; but now, With the improvement of our country's international status, the living environment of overseas Chinese has not been so bad. On the contrary, most of them have strong economic strength, and they have the patriotic heart of investing in the construction of the motherland and contributing to the great cause of the reunification of the motherland. To that end, they were eager to regain Chinese citizenship. In the face of these new circumstances, in the current process of speeding up the peaceful rise of our country, we should adopt the principle of limited recognition of dual citizenship of citizens with a longer-term perspective and with the mind of all rivers in the sea. Only in this way can we satisfy the urgent call of some special groups for dual nationality, and only in this way can we better serve our country. Only by absorbing talents can we create a good international environment for the rapid economic development of our country. On the basis of expounding the basic theory of nationality, this paper makes a detailed study on the conflict of nationality, especially dual nationality, and analyzes the practice of dealing with dual nationality in foreign countries. This paper gives our own analysis and suggestions on the difficulties and concrete solutions to this problem in our country.
