【摘要】：全文共分五章,對(duì)檢察機(jī)關(guān)技術(shù)偵查措施進(jìn)行初步探討,介紹有關(guān)技術(shù)偵查措施的概念、分類(lèi)、法律性質(zhì),并結(jié)合國(guó)外情況對(duì)其予以立法規(guī)范的具體內(nèi)容的闡述,總結(jié)出我國(guó)檢察機(jī)關(guān)技術(shù)偵查措施應(yīng)當(dāng)遵循的原則。最后針對(duì)我國(guó)司法體制和司法實(shí)踐提出關(guān)于在我國(guó)檢察機(jī)關(guān)中配置技術(shù)偵查措施的立法構(gòu)想。 第一章檢察機(jī)關(guān)配置技術(shù)偵查措施的法律依據(jù),本章分三個(gè)部分：第一部分對(duì)《聯(lián)合國(guó)反腐敗公約》做出簡(jiǎn)要概述；第二部分介紹《聯(lián)合國(guó)反腐敗公約》中關(guān)于技術(shù)偵查手段的規(guī)定；第三部分簡(jiǎn)述我國(guó)關(guān)于檢察機(jī)關(guān)配置技術(shù)偵查措施的立法實(shí)踐。 第二章對(duì)技術(shù)偵查措施的概念、分類(lèi)做出詳細(xì)論述,指出技術(shù)偵查措施的四種法律性質(zhì),即秘密性、技術(shù)性、侵權(quán)性、次位性。 第三章結(jié)合世界各國(guó)立法情況簡(jiǎn)述我國(guó)檢察機(jī)關(guān)配置技術(shù)偵查措施時(shí)應(yīng)適用的四種原則,即使用范圍特定原則、必要性原則、相關(guān)性原則、審批原則。 第四章提出我國(guó)檢察機(jī)關(guān)配置技術(shù)偵查措施的立法構(gòu)想,分別從技術(shù)偵查措施的適用范圍、適用條件、適用對(duì)象、實(shí)施程序及實(shí)施技術(shù)偵查措施所獲證據(jù)材料的保全、使用、銷(xiāo)毀等方面提出一些意見(jiàn)。 第五章針對(duì)我國(guó)目前檢察機(jī)關(guān)職務(wù)犯罪案件偵查面臨的困難,借鑒已有的理論研究成果,分析和探討如何克服這些難題,提出一些建議與改革措施,以進(jìn)一步增強(qiáng)檢察機(jī)關(guān)的職務(wù)犯罪偵查能力。
[Abstract]:The full text is divided into five chapters. This paper makes a preliminary discussion on the technical investigation measures of the procuratorial organs, introduces the concept, classification, legal nature of the technical investigation measures, and expounds the specific contents of its legislative norms in combination with the foreign situation, and summarizes the principles that should be followed by the technical investigation and measures of the procuratorial organs of our country. Finally, it aims at the judicial system of our country. And judicial practice, putting forward the legislative conception of setting up technical investigation measures in our procuratorial organs.
The first chapter is the legal basis for the procuratorial organs to configure the technical investigation measures. This chapter is divided into three parts: the first part makes a brief overview of the United Nations Convention against corruption; the second part introduces the provisions of the United Nations Convention against corruption on the means of technical investigation; the third part gives a brief account of the technical investigation measures of the procuratorial organs in China. Legislative practice.
The second chapter makes a detailed discussion on the concept and classification of the technical investigation measures, and points out the four legal properties of the technical investigation measures, namely, the secret, the technology, the infringement and the secondary.
The third chapter gives a brief account of the four principles that should be applied to the configuration of technical investigation measures by the procuratorial organs of our country, that is, the specific principles of the scope of use, the principle of necessity, the principle of relevance and the principle of examination and approval.
The fourth chapter puts forward the legislative conception of the procuratorial organ in our country to configure the technical investigation measures, and puts forward some opinions from the scope of application, applicable conditions, applicable objects, the application procedure and the implementation of the technical investigation measures and the preservation of the evidence materials obtained by the implementation of technical investigation measures.
The fifth chapter, in view of the difficulties faced by the investigation of the criminal cases in the procuratorial organs of our country at present, draws on the existing theoretical research results, analyzes and discusses how to overcome these problems, and puts forward some suggestions and reform measures in order to further enhance the investigative ability of the procuratorial organ's duty crime.
