【摘要】：現(xiàn)有的政治制度與法律制度都缺乏對后世人權(quán)利的關(guān)懷。"現(xiàn)世人同意"的現(xiàn)代民主制度,存在后世人這一主體的集體缺位;以此為基礎(chǔ)建構(gòu)起來的現(xiàn)代法律制度,以補償性正義原則貫徹始終。補償性正義原則的核心思想是"維持現(xiàn)有的狀態(tài)",導致保障后世人權(quán)益法律保護制度在現(xiàn)代社會的缺失。自然權(quán)利及其相關(guān)理論認為,后世人具有權(quán)利,現(xiàn)世人具有保障該權(quán)利的義務(wù),保護后世人權(quán)利的法律制度應(yīng)該且必須建立。我們應(yīng)建立對"現(xiàn)世人同意"民主決策的審查機制;用風險控制原則補充補償性正義原則;以風險控制原則為指導,審視訴訟主體資格、損害事實與因果關(guān)系、法律責任等現(xiàn)有相關(guān)法律規(guī)定,以建構(gòu)后世人權(quán)利法律保護制度。
[Abstract]:Neither the existing political system nor the legal system is concerned about the rights of later generations. " The modern democratic system in which the earthly people agree, there exists the collective absence of the subject of the later generation, and the modern legal system constructed on the basis of it has always been based on the principle of compensatory justice. The core idea of the principle of compensatory justice is to "maintain the present state", which leads to the lack of the legal protection system of protecting the rights and interests of later generations in the modern society. The natural right and its related theories hold that the later generation has the right, the earthly person has the duty to protect the right, and the legal system of protecting the rights of the later generation should and must be established. We should establish a review mechanism for democratic decision-making of "earthly consent"; supplement the compensatory justice principle with risk control principle; examine the qualification of litigation subject under the guidance of risk control principle, and damage the relationship between fact and causality. Legal liability and other existing relevant legal provisions in order to construct the legal protection system of human rights.
