【摘要】:隨著涉及到域外法查明的民商事案件的增多,域外法查明途徑問題愈發(fā)受到司法實(shí)踐的重視,針對(duì)該問題作專門研究的重要性也在相應(yīng)增加。目前,可供實(shí)踐采用的域外法查明途徑較之以往豐富,除了使領(lǐng)館查明途徑、司法協(xié)助查明途徑、專家查明途徑、第三方法律查明機(jī)構(gòu)途徑等傳統(tǒng)途徑,還出現(xiàn)了通過互聯(lián)網(wǎng)查明域外法等新的途徑。本文擬針對(duì)我國(guó)以上這些域外法查明途徑的立法發(fā)展與司法實(shí)踐情況進(jìn)行總結(jié)和評(píng)價(jià),然后分析出現(xiàn)有的域外法查明途徑的問題與不足,從而針對(duì)不同域外法查明途徑存在的問題與不足提出一些完善的建議。除了引言和結(jié)語,正文共分為四個(gè)部分。第一部分對(duì)域外法查明途徑問題的立法特點(diǎn)、立法缺陷及司法困境作全局性分析,提出我國(guó)現(xiàn)有的相關(guān)立法不甚完善、使領(lǐng)館查明途徑及司法協(xié)助查明途徑在實(shí)踐中被束之高閣而應(yīng)用較少、第三方法律查明平臺(tái)的實(shí)踐正快速發(fā)展等主要觀點(diǎn)。第二部分圍繞使領(lǐng)館查明途徑的立法演變及實(shí)踐效果作評(píng)析,并提出通過完善相應(yīng)的程序規(guī)范、明確交接機(jī)構(gòu)、與其他域外法查明途徑相互借鑒與結(jié)合的方式來解決使領(lǐng)館查明途徑啟動(dòng)難、進(jìn)展慢等難題的主要觀點(diǎn)。第三部分對(duì)我國(guó)司法協(xié)助查明途徑的立法及現(xiàn)有的雙邊民商事司法協(xié)助條約情況進(jìn)行了評(píng)述,分析了兩類國(guó)際合作機(jī)制并總結(jié)了司法協(xié)助查明途徑的立法特點(diǎn)和實(shí)踐效果,提出通過完善送達(dá)環(huán)節(jié)、完善條約規(guī)定、補(bǔ)充相應(yīng)的配套程序來解決司法協(xié)助查明途徑的查明周期過長(zhǎng)、查明費(fèi)用規(guī)定不統(tǒng)一、查明結(jié)果難以適用問題的主要觀點(diǎn)。最后一部分針對(duì)專家查明途徑和第三方法律查明機(jī)構(gòu)途徑這兩種域外法查明途徑進(jìn)行了立法發(fā)展、司法應(yīng)用、專家責(zé)任承擔(dān)與分配三個(gè)方面的分析,提出了我國(guó)立法有必要對(duì)專家資格等重要問題進(jìn)行明確規(guī)制、專家遴選應(yīng)設(shè)定最低資格標(biāo)準(zhǔn)、法院通過引入第三方法律查明平臺(tái)建立起常態(tài)合作機(jī)制有利于實(shí)現(xiàn)域外法查明的規(guī)范化及制度化、專家因過錯(cuò)出具錯(cuò)誤的域外法意見時(shí)需對(duì)此承擔(dān)相應(yīng)的侵權(quán)責(zé)任等主要觀點(diǎn)。
[Abstract]:With the increase of civil and commercial cases involving the ascertainment of extraterritorial law, the problems of the method of extraterritorial identification are becoming more and more important in judicial practice. The importance of special research on this issue is also increasing. At present, the ways to find out the extraterritorial methods used in practice are more abundant. In addition to identifying the ways of the consulate, judicial assistance to Cha Mingtu The path, the expert ascertains the way, the third party law ascertains the mechanism way and so on traditional way, also appears the new way to ascertain the extraterritorial law through the Internet. This article is intended to summarize and evaluate the legislative development and judicial practice of these extraterritorial methods of our country and above, and then analyze the problems of finding out the ways of some extraterritorial law. In addition to the introduction and conclusion, the text is divided into four parts. The first part analyzes the legislative characteristics, the legislative defects and the judicial plight of the problems of the extraterritorial method, and puts forward that the relevant legislation in China is not perfect, The ways to find out the consulate and the ways to find out the judicial assistance are put on the shelf in practice, and the main points of view of the third party legal identification platform are being developed rapidly. The second part focuses on the legislative evolution and practical effects of the identification of the ways of the consulate, and proposes to improve the corresponding procedural norms and clear the handover organization. The main points of view that the consulate can be found difficult to start and slow progress are solved by the way of reference and combination with other extraterritorial methods. The third part reviews the legislation of our judicial assistance and the existing bilateral treaty of civil and commercial judicial assistance, and analyzes the two types of international cooperation mechanisms. The legislative characteristics and practical effects of the way of judicial assistance find out, and put forward the main point of view that the period is too long to be solved by perfecting the delivery link, perfecting the treaty provisions, supplementing the corresponding supporting procedures to solve the long period of the identification of judicial assistance, finding out the ununification of the cost provisions and finding out the difficulties in applying the questions. The way and the third party law to find out the ways of the two extraterritorial methods have carried on the legislative development, the judicial application, the analysis of the three aspects of the responsibility and distribution of the expert responsibility, and put forward that it is necessary for our legislation to make clear regulation on the important issues such as expert qualification, and the minimum qualification standard should be set by the expert selection, and the court through the introduction of third. The establishment of a normal cooperation mechanism by the method law is conducive to the standardization and institutionalization of the extraterritorial law. The experts need to bear the corresponding tort liability and other main points of view when the experts issue erroneous extraterritorial opinions on the basis of fault.
