作為法律原則的相互原則:從國際水道法及中國跨界水條約實踐探究相互原則的作用

作為社會交往中的基本現(xiàn)象與國際法中的基本法律原則,相互原則的重要性再怎么強(qiáng)調(diào)也不為過。有鑒于此,本文擬首先明確相互原則在國際法中的作用,并基于此審慎地分析其對國際水道法產(chǎn)生的影響。通常,可以從三個層面理解相互原則在國際法中的功能:第一,作為一種發(fā)展國際法的機(jī)制;第二,作為一種條約機(jī)制;第三,作為一種爭端解決與實施機(jī)制。與這三個層面分別對應(yīng),相互原則在國際水道法中發(fā)揮著如下作用:第一,將限領(lǐng)土主權(quán)原則確立為習(xí)慣國際法;第二,明確實體規(guī)則中相應(yīng)的權(quán)利與義務(wù);第三,考慮到跨界水領(lǐng)域中更強(qiáng)調(diào)爭端的避免,而非規(guī)則的遵行,相互原則還進(jìn)一步推動著程序與爭端解決規(guī)則的發(fā)展。具體而言,在相互原則的作用下,一國所提出的訴求也能夠被其他國家主張,這就有效抑制了一國提出過分且不合理的主張的可能性。通過這種作用機(jī)制,相互原則推動著習(xí)慣國際法的發(fā)展!肮胶侠砝谩焙汀氨苊庵卮髶p害的義務(wù)”這兩大實體規(guī)則經(jīng)常被認(rèn)為偏袒著上游或下游國家一方。然而,我們明顯可以看到它們實際上規(guī)定了具有相互性的權(quán)利與義務(wù),以保證法律適用者對它們的解釋并不會偏好上游或下游的任一沿岸國同理的,與實體規(guī)則相輔相成的程序規(guī)則,如信息互換事先通知...
