【摘要】：一項(xiàng)國(guó)家層面的制度的誕生,往往是以一個(gè)國(guó)家長(zhǎng)期累積的社會(huì)頑疾為誘因,融匯了這個(gè)國(guó)家最深層的文化樣態(tài)和最熟能生巧的治理手法。環(huán)境污染和生態(tài)破壞是我國(guó)在經(jīng)歷三十年經(jīng)濟(jì)高速發(fā)展后產(chǎn)生的頑疾,約談背后反應(yīng)的則是我國(guó)深層的官本文化思維,而環(huán)保行政約談制度則是正在進(jìn)行的之于環(huán)境保護(hù)的一大治理突破環(huán)節(jié)。在轉(zhuǎn)變政府職能、創(chuàng)新行政管理方式的改革快車道中,在新公共管理、行政民主等理論的渲染下,如何將行政約談的優(yōu)勢(shì)發(fā)揮在環(huán)境保護(hù)領(lǐng)域成為響應(yīng)生態(tài)文明建設(shè)和法治中國(guó)建設(shè)的一大亮點(diǎn)。雖然行政約談目前只是散見在效力層級(jí)較低的法律文件中,但其在實(shí)踐應(yīng)用中已經(jīng)相當(dāng)廣泛,但由于上位立法的缺失和學(xué)界研究的遲滯,環(huán)保行政約談的理論建構(gòu)遭遇到了不暢,諸如對(duì)行政約談的定性,學(xué)界對(duì)其呈分庭抗禮之態(tài)勢(shì)。但可以肯定的是,行政約談自身的柔性行政特征決定了它區(qū)別于強(qiáng)制性行政手段的法律屬性,而類行政指導(dǎo)行為是目前對(duì)于行政約談的最為妥當(dāng)?shù)亩ㄐ�。類行政指�?dǎo)行為的定性又導(dǎo)致環(huán)保行政約談制度的完善角度必須落腳在非訴救濟(jì)機(jī)制上。筆者將在明晰環(huán)保行政約談性質(zhì)的前提下,在總結(jié)現(xiàn)行制度所困桎梏的基礎(chǔ)上,從法律制定、機(jī)制運(yùn)行、救濟(jì)手段三個(gè)梯次探討環(huán)保行政約談制度的完善方式。
[Abstract]:The birth of a system at the national level is often caused by a country's long-term accumulated social ills, which combines the deepest cultural patterns and the most practical and perfect governance techniques. Environmental pollution and ecological destruction are the persistent diseases of our country after three decades of rapid economic development, and the reflection behind the interviews is the deep-seated official cultural thinking in our country. The environmental protection administrative interview system is a breakthrough in environmental protection. In the fast-track reform of transforming government functions and innovating administrative methods, under the rendering of new public management, administrative democracy and other theories, How to bring the advantages of administrative interview into full play in the field of environmental protection has become a bright spot in response to the construction of ecological civilization and rule of law in China. Although the administrative interview is only scattered in the lower level of validity of the legal documents, but it has been widely used in practice, but due to the lack of upper legislation and the delay of academic research. The construction of the theory of environmental protection administrative interview has encountered difficulties, such as the nature of administrative interview, the academic community is equal to its trend. But we can be sure that the flexible administrative characteristics of administrative interview determine its legal attribute which is different from compulsory administrative means, and the administrative guidance behavior is the most appropriate characterization of administrative interview at present. The qualitative nature of administrative guidance behavior leads to the perfection of environmental protection administrative interview system, which must be based on the non-litigation relief mechanism. On the premise of clarifying the nature of environmental protection administrative interview and on the basis of summarizing the shackles of the current system, the author will discuss the perfect way of environmental protection administrative interview system from three echelons of law making, mechanism operation and relief means.
