【摘要】:互聯(lián)網(wǎng)金融在新世紀(jì)后呈現(xiàn)出迅猛發(fā)展態(tài)勢,并且逐漸成為了傳統(tǒng)金融業(yè)中必不可缺的部分,存在諸多貢獻(xiàn),例如居民財富管理方式的多元化、小微企業(yè)融資扶持以及實(shí)體經(jīng)濟(jì)發(fā)展助力等等。然而在互聯(lián)網(wǎng)金融發(fā)展的同時,一些局部金融風(fēng)險開始逐漸產(chǎn)生,且不斷增幅,并且受到了社會各界的廣泛關(guān)注。本質(zhì)上來看,金融風(fēng)險存在一定的傳染性,若是出現(xiàn)局部金融風(fēng)險,且沒有合理應(yīng)對或是處理的話,勢必造成全局性系統(tǒng)性風(fēng)險的產(chǎn)生。這就需要進(jìn)一步加強(qiáng)理論研究,為完善政府現(xiàn)有的金融監(jiān)管職能提供科學(xué)的理論指導(dǎo)。理性經(jīng)濟(jì)人假設(shè)能夠推動個人利己主義行為在"看不見的手"之下,對市場均衡狀態(tài)實(shí)行調(diào)整與構(gòu)建,只要是市場信息,就都能夠利用均衡市場價格的方式予以體現(xiàn)。在此作用下,互聯(lián)網(wǎng)金融監(jiān)管開始愈發(fā)放任,然而,在其達(dá)到理想假設(shè)之前,市場中依舊有著各類非有效因素,造成了互聯(lián)網(wǎng)金融無監(jiān)管形勢的局限,令之不具備可能性。對此,我們應(yīng)當(dāng)了解到,作為金融創(chuàng)新和風(fēng)險防控的互聯(lián)網(wǎng)金融,存在著一定的矛盾性與依賴性,在對金融創(chuàng)新予以強(qiáng)調(diào)之時,同時存在著提高風(fēng)險防控能力與水平的要求,并對互聯(lián)網(wǎng)金融監(jiān)管力度予以強(qiáng)化,通過風(fēng)險防范,實(shí)現(xiàn)二者平衡狀態(tài)的把控與維持。我國金融業(yè)創(chuàng)新開始迅速發(fā)展,各類金融產(chǎn)品不斷被研發(fā)和生產(chǎn),金融活動類別愈發(fā)多元化,其表現(xiàn)形式則開始變得復(fù)雜、多樣和隱蔽,這也造成了各類問題及弊端的產(chǎn)生,例如監(jiān)管局限、監(jiān)管真空等等,在此形勢下,傳統(tǒng)監(jiān)管體系、宏觀審慎管理開始面對新要求。另外則是對于互聯(lián)網(wǎng)金融監(jiān)管力度與金融監(jiān)管體制變革的深化,盡可能的對一些機(jī)制與體制限制予以突破,從而實(shí)現(xiàn)風(fēng)險的預(yù)防及化解,同時對金融變革實(shí)行推進(jìn),從而為金融體系的構(gòu)建、金融風(fēng)險化解以及金融生產(chǎn)力的發(fā)揮奠定良好基礎(chǔ)。在互聯(lián)網(wǎng)金融監(jiān)管方面,主要是對于金融變革的強(qiáng)化,建立健全金融監(jiān)管法律法規(guī)體系與制度,對金融監(jiān)管職責(zé)做出科學(xué)安排,同時緊抓制度,通過對金融監(jiān)管資源配置的優(yōu)化,以及金融創(chuàng)新、風(fēng)險防范關(guān)系的把控,令金融風(fēng)險具備全覆蓋特征,從而實(shí)現(xiàn)系統(tǒng)性金融風(fēng)險的規(guī)避和解決。只有將金融監(jiān)管的"頂層設(shè)計"和金融市場的"自主創(chuàng)新"結(jié)合起來,才能不斷克服互聯(lián)網(wǎng)金融發(fā)展過程中的各種問題和困難,實(shí)現(xiàn)風(fēng)險防范、深化改革間關(guān)系的良好處理,利用政府監(jiān)管職能對市場配置資源的決定性作用進(jìn)行充分發(fā)揮,在提升金融體系效率的同時,促進(jìn)互聯(lián)網(wǎng)金融市場的進(jìn)一步發(fā)展。本文內(nèi)容,除緒論和結(jié)論外,正文包括五個部分:第一部分,分析了相關(guān)概念和基本理論。首先進(jìn)行了政府職能、互聯(lián)網(wǎng)金融、互聯(lián)網(wǎng)金融監(jiān)管風(fēng)險以及互聯(lián)網(wǎng)金融模式等相關(guān)概念的介紹及定義明確;同時基于互聯(lián)網(wǎng)金融監(jiān)管體系,對互聯(lián)網(wǎng)金融風(fēng)險管理理論依據(jù)實(shí)行了探究與分析,存在三個部分,一為科斯定理理論、二為市場失靈理論、三則是政府職能理論。第二部分,主要對政府在互聯(lián)網(wǎng)風(fēng)險方面的監(jiān)管要求進(jìn)行了介紹。先是互聯(lián)網(wǎng)金融風(fēng)險類別的調(diào)查與闡述;再到政府對互聯(lián)網(wǎng)金融實(shí)行監(jiān)管必要性的探究;并針對政府監(jiān)管互聯(lián)網(wǎng)金融風(fēng)險,提出了相應(yīng)的要求及方法。第三部分,主要對國內(nèi)目前互聯(lián)網(wǎng)金融風(fēng)險的監(jiān)管情況展開了探討。先概述了國內(nèi)互聯(lián)網(wǎng)金融模式和各類監(jiān)管機(jī)構(gòu),有進(jìn)一步對互聯(lián)網(wǎng)金融監(jiān)管變革現(xiàn)狀進(jìn)行了介紹;除此之外,本章節(jié)還通過案例研究與闡述,實(shí)現(xiàn)了政府在互聯(lián)網(wǎng)金融風(fēng)險監(jiān)管方面存在的弊端及問題。第四部分,重點(diǎn)進(jìn)行了政府在互聯(lián)網(wǎng)金融風(fēng)險監(jiān)管借鑒方面的介紹。以澳大利亞、日本、美國等為例,對其互聯(lián)網(wǎng)金融監(jiān)管思路實(shí)行了探究與分析,并獲取到了相應(yīng)結(jié)論。即法規(guī)先行,行為與審慎監(jiān)管并重;公平監(jiān)管,維護(hù)借貸雙方利益;且就要實(shí)現(xiàn)多元化、集約化以及合理監(jiān)管的并存。第五部分,針對政府在互聯(lián)網(wǎng)金融監(jiān)管職能方面的問題,提出了相應(yīng)的解決方案與建議。它們分別是:明確監(jiān)管主體;加強(qiáng)金融監(jiān)管協(xié)調(diào);完善法律制度建設(shè);完善對社會征信體系的建設(shè);建設(shè)數(shù)據(jù)系統(tǒng),加強(qiáng)信息披露;建立消費(fèi)者權(quán)益保護(hù)制度,形成完善的互聯(lián)網(wǎng)金融監(jiān)管體系。
[Abstract]:Internet banking presents a rapid development trend in the new century, and gradually become the indispensable part of the traditional financial industry, there are many contributions, such as wealth management mode of diversification, Small and micro businesses financing support and help the development of the real economy and so on. But in the financial development of the Internet at the same time, some local financial risks began to produce, and continue to increase, and has attracted extensive attention from all walks of life. In fact, there are some contagious financial risks, if the local financial risk, and there is no reasonable or to deal with the case, will cause the global systemic risk. So it is necessary to strengthen the theoretical research, provide scientific guidance in order to improve the function of governmental finance supervision. In this role, the Internet financial supervision is becoming more and more distributed, however, before it reaches the ideal hypothesis, the market still has all kinds of non effective factors, resulting in the Internet financial supervision the situation that does not have the possibility of limitations. In this regard, we should understand that, as a financial innovation and risk control of Internet banking, there is a certain contradiction and dependence, to be strong to financial innovation, also exist to improve risk control ability and level requirements, and the supervision of the Internet to strengthen the financial risk prevention, through, realizing the balance of the two state to control and maintain. The third part, mainly on the current regulatory situation of Internet financial risk is discussed. With the elaborate case study, realized the drawbacks and problems existing in the government regulation of Internet financial risk. In the fourth part, the focus of the government in the Internet financial risk supervision from the aspects of the introduction. In Australia, Japan, the United States, for example, the Internet financial regulatory ideas carried out research and analysis, and access to the corresponding conclusion.
