【摘要】：發(fā)展軍民兩用技術一直是世界各國國防科技政策的重要內容,世界各國也普遍認識到發(fā)展軍民兩用技術對推動國民經(jīng)濟發(fā)展和國防軍隊建設的至關重要性。軍民兩用技術產(chǎn)權的合理配置,可以有效保障各權利主體的利益,激發(fā)國防科技創(chuàng)新的活力。通過研究軍民兩用技術產(chǎn)權配置問題,建立和完善有利于軍民兩用技術創(chuàng)造和運用的政策體系,合理調整國家、軍隊和科技人員的權益結構,確立科學的軍民兩用技術產(chǎn)權配置原則,對推動軍民融合戰(zhàn)略深度發(fā)展和實施國家創(chuàng)新驅動發(fā)展戰(zhàn)略具有重要的理論和現(xiàn)實意義。本文首先厘清了軍民兩用技術產(chǎn)權配置的基本概念和理論,從軍民兩用技術產(chǎn)權配置的基本情況、主要特點、存在的問題與原因分析入手,對我國軍民兩用技術產(chǎn)權配置現(xiàn)狀進行了較深入地研究,并主要以美國為例進行了國際比較;然后應用交易成本理論和不完全契約理論對軍民兩用技術開發(fā)的治理結構和產(chǎn)權配置進行了分析;最后,從樹立軍民兩用技術產(chǎn)權配置觀念、完善制度保障、加強體系建設、推進配套工作等四個方面提出了優(yōu)化軍民兩用技術產(chǎn)權配置的對策建議。
[Abstract]:The development of dual-use technology has always been an important part of the national defense science and technology policy of various countries in the world, and the development of dual-use technology has been generally recognized by all countries in the world as crucial to promoting the development of the national economy and the building of the national defense army. The rational allocation of dual-use technology property rights can effectively protect the interests of all right subjects and stimulate the vitality of national defense science and technology innovation. By studying the allocation of property rights of dual-use technologies, establishing and perfecting a policy system conducive to the creation and application of dual-use technologies, and rationally adjusting the structure of the rights and interests of the state, the armed forces and scientific and technological personnel, It is of great theoretical and practical significance to establish the scientific allocation principle of dual-use technology property right in order to promote the deep development of the military-civilian integration strategy and to implement the national innovation-driven development strategy. This paper first clarifies the basic concept and theory of dual-use technology property right allocation, starting with the basic situation, main characteristics, existing problems and reasons of dual-use technology property right allocation. The present situation of dual-use technology property right allocation in China is deeply studied, and the international comparison is mainly made with the example of the United States. Then, the paper analyzes the governance structure and property right allocation of dual-use technology development by using transaction cost theory and incomplete contract theory. Finally, from setting up the concept of dual-use technology property right allocation, perfecting the system guarantee, strengthening the system construction, the paper analyzes the management structure and property rights allocation of the dual-use technology development by means of transaction cost theory and incomplete contract theory. Four aspects are put forward to optimize the allocation of dual-use technology property rights.
