我國(guó)商品房預(yù)告登記管理問(wèn)題研究

【摘要】:近年來(lái),隨著房地產(chǎn)市場(chǎng)的不斷發(fā)展,由房地產(chǎn)糾紛引發(fā)的社會(huì)矛盾也隨之增多。隨著2007年10月1日《物權(quán)法》的實(shí)施商品房預(yù)告登記被運(yùn)用到了商品房的管理當(dāng)中。商品房預(yù)告登記管理制度作為房地產(chǎn)市場(chǎng)管理的一項(xiàng)基本制度,對(duì)于規(guī)范商品房預(yù)售(購(gòu))交易雙方的行為,保障預(yù)購(gòu)房人的合法權(quán)益,促進(jìn)房地產(chǎn)市場(chǎng)平穩(wěn)健康發(fā)展具有十分重要的意義。 本文在閱讀大量國(guó)內(nèi)外關(guān)于預(yù)告登記管理文獻(xiàn)資料的基礎(chǔ),通過(guò)分析預(yù)告登記的管理現(xiàn)狀,列舉預(yù)告登記管理存在的主要問(wèn)題。結(jié)合我國(guó)預(yù)告登記管理制度運(yùn)行狀況,從管理學(xué)、產(chǎn)權(quán)理論等理論角度出發(fā),提出解決我國(guó)預(yù)告登記管理制度存在的問(wèn)題對(duì)策 我國(guó)預(yù)告登記管理制度建立才幾年來(lái),從運(yùn)行的整體狀況來(lái)看,效果良好,也為我國(guó)的商品房發(fā)展提供了一個(gè)很好的管理服務(wù)體系。但存在的問(wèn)題也不容忽視,諸如預(yù)告登記適用的范圍太狹窄;預(yù)告登記管理人員素質(zhì)參差不齊;預(yù)告登記管理的法律效力的局限性;預(yù)告登記的賠償制度不明確等問(wèn)題。如何在新形勢(shì)下,以《物權(quán)法》的頒布實(shí)施為契機(jī),加快解決我國(guó)預(yù)告登記管理制度存在問(wèn)題的步伐,使預(yù)告登記更好的服務(wù)于我國(guó)現(xiàn)代化建設(shè),更好的服務(wù)于中華民族的偉大復(fù)興,成為保障商品房市場(chǎng)健康發(fā)展的重要工具。本文主要從我國(guó)商品房預(yù)告登記管理的現(xiàn)狀論述,并就我國(guó)預(yù)告登記管理存在的問(wèn)題進(jìn)行了挖掘。最后提出了包括從健全立法、改進(jìn)管理方法和提高工作人員綜合素質(zhì)三方面的對(duì)策和建議。
[Abstract]:In recent years, with the continuous development of the real estate market, the social contradictions caused by the real estate disputes have also increased. With the implementation of the Real right Law on October 1, 2007, the advance registration of commercial housing has been applied to the management of commercial housing. As a basic system for the management of the real estate market, the system of management of advance registration of commercial housing protects the legitimate rights and interests of pre-buyers in order to regulate the behavior of both parties to the pre-sale (purchase) transaction of commercial housing, It is of great significance to promote the steady and healthy development of the real estate market. On the basis of reading a large number of documents on the management of advance notice registration at home and abroad, this paper analyzes the present situation of the management of advance notice registration, and lists the main problems existing in the management of advance notice registration. According to the operating situation of the management system of advance notice registration in our country, from the angle of management and property right theory, this paper puts forward some countermeasures to solve the problems existing in the management system of advance notice registration in our country, which has only been established in the past few years. From the overall operation of the situation, the effect is good, but also for the development of commercial housing in China to provide a good management service system. However, the existing problems can not be ignored, such as too narrow scope of application of advance notice registration, uneven quality of management personnel of advance notice registration, limitation of legal effect of advance notice registration management, unclear compensation system of advance notice registration and so on. Under the new situation, taking the promulgation and implementation of the property Law as a turning point, how to speed up the steps of solving the problems existing in the management system of notice registration in our country, so as to make the notice registration serve the modernization construction of our country better, Better serve the great rejuvenation of the Chinese nation and become an important tool to ensure the healthy development of the commercial housing market. This paper mainly discusses the present situation of the management of commercial house notice registration in our country, and excavates the problems existing in the management of the notice registration in our country. Finally, the countermeasures and suggestions are put forward from three aspects: perfecting legislation, improving management method and improving staff's comprehensive quality.
