【摘要】：自20世紀(jì)90年代以來(lái),我國(guó)人民法院的民事審判法庭在審判活動(dòng)中遇到許多案件并不是單純的民事案件,而是由民事糾紛與行政糾紛交叉問(wèn)題引起的案件。這類(lèi)案件以河南省焦作市房地產(chǎn)糾紛案件為典型案件,也正是由于這個(gè)案件,才引起人們對(duì)民行交叉問(wèn)題的高度重視。由民事糾紛與行政糾紛交叉問(wèn)題引起的案件已經(jīng)出現(xiàn),并且隨著行政權(quán)的不斷擴(kuò)張,此類(lèi)案件已呈不斷上升趨勢(shì),我國(guó)審判工作面臨著新的難題和重大挑戰(zhàn)。文章主要從三個(gè)部分來(lái)論述民事糾紛與行政糾紛交叉問(wèn)題的解決機(jī)制。在分析其深刻的社會(huì)背景與司法環(huán)境的基礎(chǔ)上,結(jié)合域外的解決機(jī)制,針對(duì)我國(guó)的客觀實(shí)際情況,提出了構(gòu)建出適合于我國(guó)國(guó)情的民事糾紛與行政糾紛交叉問(wèn)題的解決機(jī)制,包括構(gòu)建的指導(dǎo)思想、原則以及具體的程序等。
[Abstract]:Since the 1990s, the civil trial court of the people's court of our country has encountered many cases not only civil cases, but also cases caused by the intersection of civil disputes and administrative disputes. This kind of case takes the real estate dispute case of Jiaozuo City in Henan Province as a typical case, and it is precisely because of this case that people attach great importance to the intersection of people's actions. Cases caused by the intersection of civil disputes and administrative disputes have emerged, and with the continuous expansion of administrative power, such cases have been on the rise. The trial work in our country is faced with new problems and major challenges. This article mainly discusses the settlement mechanism of civil dispute and administrative dispute from three parts. On the basis of analyzing its profound social background and judicial environment, combined with the extra-territorial settlement mechanism, and in view of the objective actual situation of our country, this paper puts forward a solution mechanism which is suitable for the civil dispute and the administrative dispute that is suitable for the national conditions of our country. Including the construction of the guiding ideology, principles and specific procedures and so on.
