【摘要】:房地產(chǎn)業(yè)是國民經(jīng)濟(jì)發(fā)展的高貢獻(xiàn)產(chǎn)業(yè),房地產(chǎn)業(yè)的繁榮和房地產(chǎn)價格的上升是社會經(jīng)濟(jì)發(fā)展的重要表現(xiàn),但是如果房地產(chǎn)價格的升高與社會經(jīng)濟(jì)發(fā)展程度和居民收入水平不能同步適應(yīng),則會損害國民經(jīng)濟(jì)的健康發(fā)展。而且房地產(chǎn)價格問題直接關(guān)系居民對“住”的基本生存要求,是社會民生的重要問題,必須予以重視,并進(jìn)行深入研究,以理論指導(dǎo)實(shí)踐。房地產(chǎn)價格問題是涉足法律、經(jīng)濟(jì)學(xué)、管理學(xué)等多學(xué)科的復(fù)雜問題,在此前提下從法律的角度出發(fā),研究探討房地產(chǎn)價格監(jiān)管所涉及的相關(guān)概念、法理依據(jù)以及房地產(chǎn)價格法律監(jiān)管的法律主體和監(jiān)管對象等方面的內(nèi)容,并且在進(jìn)行理論分析和問題分析的基礎(chǔ)上,得出對加強(qiáng)我國房地產(chǎn)價格監(jiān)管的法律思考,以期能在實(shí)踐中得到更好的應(yīng)用和發(fā)揮,最終實(shí)現(xiàn)房地產(chǎn)價格的平穩(wěn)發(fā)展。 房地產(chǎn)價格的法律監(jiān)管包括房地產(chǎn)價格法律監(jiān)督和房地產(chǎn)價格法律管理兩大方面的內(nèi)容,通過對二者的含義解析,以及對房地產(chǎn)價格法律監(jiān)管與房地產(chǎn)價格宏觀調(diào)控兩者進(jìn)行辨析,確定研究重點(diǎn)應(yīng)立于范圍層次更為廣泛的房地產(chǎn)價格法律監(jiān)管之上。然而任何法律問題的研究和解決都離不開法學(xué)理論的支持,通過對房地產(chǎn)價格監(jiān)管的法學(xué)理論依據(jù)的分析,其中包括宏觀調(diào)控法學(xué)手段及原則理論、市場監(jiān)管法學(xué)理論、法經(jīng)濟(jì)學(xué)博弈論理論以及法社會學(xué)法律功能論理論等方面,,可以為房地產(chǎn)價格監(jiān)管法律問題的研究提供更為深刻的理解和法源支持。房地產(chǎn)價格監(jiān)管法律問題的研究重點(diǎn)應(yīng)當(dāng)集中于房地產(chǎn)價格監(jiān)管的相關(guān)法律主體和監(jiān)管對象的法律分析等方面,逐步深入論題并發(fā)現(xiàn)問題。具體而言,對房地產(chǎn)價格監(jiān)管法律主體的分析,主要集中在房地產(chǎn)價格監(jiān)管的決策主體、執(zhí)行主體及相關(guān)法律法規(guī)制定主體三個方面,通過對房地產(chǎn)價格監(jiān)管各主體的構(gòu)成、職能、監(jiān)管作為等方面的總結(jié)剖析,可發(fā)現(xiàn)其在房地產(chǎn)價格監(jiān)管過程中存在的問題,包括監(jiān)管決策主體法律權(quán)責(zé)與監(jiān)管機(jī)制不完善、缺乏對監(jiān)管主體的執(zhí)行監(jiān)督與管理以及房地產(chǎn)價格監(jiān)管政策法律化進(jìn)程滯緩等。而在對房地產(chǎn)價格監(jiān)管對象的法律分析上,主要以對房地產(chǎn)價格產(chǎn)生影響的因素作為貫穿全章之線索,并反之將其作為對房地產(chǎn)價格監(jiān)管的對象和手段予以闡釋分析,從對房地產(chǎn)價格產(chǎn)生影響的因素這一角度入手,對涉及房地產(chǎn)價格的土地出讓手段、房地產(chǎn)資本信貸手段、房地產(chǎn)市場供需以及房地產(chǎn)稅費(fèi)制度等方面的監(jiān)管,從法律的角度進(jìn)行詳細(xì)梳理,在此過程中對房地產(chǎn)價格監(jiān)管對象的各個方面存在的問題和可取之處進(jìn)行了雙向分析,在今后我國房地產(chǎn)價格監(jiān)管的過程中對可取之處予以延續(xù)和改進(jìn),對出現(xiàn)的如土地的行政壟斷、立法轉(zhuǎn)化的遲滯以及規(guī)范性文件效力層級低等各方面問題予以糾正和彌補(bǔ)。最后,提出加強(qiáng)對我國房地產(chǎn)價格法律監(jiān)管的建議,結(jié)合前文的層層深入分析以及在整理分析過程中發(fā)現(xiàn)的問題,從強(qiáng)化土地出讓、金融稅制和加強(qiáng)住房保障等房地產(chǎn)價格監(jiān)管手段方面,對房地產(chǎn)價格法律監(jiān)管進(jìn)行深入思考總結(jié),提出加強(qiáng)土地利益分配管理、明確政府法律責(zé)任以及在推動土地入市交易的過程中加強(qiáng)監(jiān)管力度的思考;另一方面,也要積極建立健全房地產(chǎn)價格監(jiān)管監(jiān)察法律機(jī)制,建立從中央到地方的縱向監(jiān)管與部門間、地方政府間橫向聯(lián)合的縱橫交錯的房地才價格監(jiān)管法律機(jī)制,完善房地產(chǎn)市場執(zhí)法監(jiān)督機(jī)制,提高房地產(chǎn)價格法律監(jiān)管的效率,維護(hù)房地產(chǎn)市場價格的平衡穩(wěn)定。
[Abstract]:The real estate industry is a high contribution industry to the development of national economy. The prosperity of real estate industry and the rising of real estate price are important manifestations of the social and economic development. But if the price of real estate is not adapted to the social economic development and the income level of the residents, it will damage the healthy development of the national economy. Moreover, the real estate price will be damaged. The question of the lattice is directly related to the basic living requirements of the residents, which is an important issue for the people's livelihood. It must be paid attention to, and the research is carried out in depth to guide the practice. The real estate price is a complex problem in many disciplines such as law, economics, management and so on. Under this premise, the real estate is studied and discussed from the legal point of view. The related concepts involved in price regulation, legal basis, legal subject and supervision object of real estate price regulation, and on the basis of theoretical analysis and problem analysis, the legal thinking of strengthening the supervision of real estate prices in China is drawn up in order to get better application and play in practice. The final realization of the steady development of real estate prices.
The legal supervision of real estate price includes two aspects of the legal supervision of real estate price and the legal management of real estate price. Through the analysis of the meaning of the two, and the discrimination between the real estate price legal supervision and the macro-control of the real estate price, it is determined that the research emphasis should be on the more extensive real estate price in the scope. However, the study and solution of any legal problems can not be separated from the support of the legal theory, through the analysis of the legal basis of the real estate price regulation, including the macro regulation and control law means and principles, the theory of market supervision, the game theory of law economics and the legal function of law sociology. On the other hand, we can provide a more profound understanding and legal support for the research on the legal issues of real estate price regulation. The focus of the research on the legal issues of real estate price regulation should focus on the legal subjects of the real estate price regulation and the legal analysis of the supervision objects. The analysis of the legal subject of real estate price supervision is mainly focused on three aspects of the decision-making body of the real estate price supervision, the subject of execution and the main body of relevant laws and regulations. Through the summary and analysis of the composition, function and supervision of the main bodies of the real estate price supervision, it can be found that in the process of supervising the real estate price, it can be found to be stored in the process of real estate price regulation. The problems include the imperfect legal authority and supervision mechanism, the lack of supervision and management of the subject of supervision and the delay in the legal process of the real estate price regulation. In the process of the real estate price regulation in the future, the redeeming and improvement are carried out in the process of the real estate price regulation in China. In the end, we put forward some suggestions to strengthen the legal supervision of the real estate price in China. On the other hand, it is necessary to strengthen the management of the distribution of land interests, clear the legal responsibility of the government and strengthen the supervision in the process of promoting the trade of land into the market. On the other hand, we should also actively establish and improve the supervision and supervision of the real estate price, and establish the legal mechanism from the central to the local.
