職務(wù)發(fā)明的獎酬制度研究

【摘要】:目前,世界經(jīng)濟(jì)增長正快速轉(zhuǎn)變?yōu)橹R創(chuàng)新導(dǎo)向型發(fā)展模式,知識產(chǎn)權(quán)正日益成為經(jīng)濟(jì)增長的主要推動力,在世界主要創(chuàng)新型國家中,以職務(wù)發(fā)明為核心的科學(xué)技術(shù)創(chuàng)新能力、知識產(chǎn)權(quán)管理能力日益成為決定國家經(jīng)濟(jì)增長潛力和綜合競爭能力的關(guān)鍵因素。職務(wù)發(fā)明的強(qiáng)弱之所以能成為一國發(fā)明創(chuàng)新能力的體現(xiàn),關(guān)鍵在于職務(wù)發(fā)明制度是平衡單位和發(fā)明人、設(shè)計(jì)人利益的保障,是優(yōu)化社會智力資源分配的重要手段。建立完善的職務(wù)發(fā)明制度并非一朝一夕可以完成的,就目前的立法現(xiàn)狀來看,包含兩個(gè)步驟:第一個(gè)步驟是立法明晰產(chǎn)權(quán),立法要確立職務(wù)發(fā)明與非職務(wù)發(fā)明的區(qū)別,重點(diǎn)明晰職務(wù)發(fā)明認(rèn)定問題,為下一個(gè)步驟的開展奠定基礎(chǔ);第二個(gè)步驟是對職務(wù)發(fā)明的獎勵(lì)立法,是立法保護(hù)職務(wù)發(fā)明人的智力成果以及予以激勵(lì)。 本文首先通過介紹獎勵(lì)在專利制度中的特殊地位,為職務(wù)發(fā)明獎勵(lì)的立法做理論和歷史鋪墊。專利制度的誕生可以說是一種激勵(lì)手段的常規(guī)化,一種特殊的獎勵(lì),在立法后續(xù)的發(fā)展中,獎勵(lì)一直都是專利立法不可或缺的一個(gè)重要組成部分。在職務(wù)發(fā)明立法中,獎勵(lì)更是成為其立法的兩大核心內(nèi)容之一。之后,本文試從知識產(chǎn)權(quán)立法目的、手段以及法理等角度出發(fā),論證職務(wù)發(fā)明獎勵(lì)立法的必要性、合理性,尋找職務(wù)發(fā)明獎勵(lì)立法的理論根源。在理論論證之后,本文具體介紹我國建國以來職務(wù)發(fā)明立法的歷史沿革,對比美、日、德等科技發(fā)達(dá)國家的職務(wù)發(fā)明立法和職務(wù)發(fā)明獎勵(lì)制度在這些國家的具體實(shí)踐情況,從而為我國職務(wù)發(fā)明立法完善提供一些理論和實(shí)踐依據(jù)。 最后,結(jié)合上述論證和法律材料,為我國完善職務(wù)發(fā)明獎勵(lì)立法提出一些建議。具體來說,我國職務(wù)發(fā)明獎勵(lì)權(quán)屬于知識產(chǎn)權(quán)范疇,因而具有財(cái)產(chǎn)和人身雙重屬性。因此,在研究職務(wù)發(fā)明獎勵(lì)立法時(shí),尤其要結(jié)合人身權(quán)利的特征來具體分析獎勵(lì)立法的權(quán)力屬性、權(quán)利構(gòu)成、權(quán)利獎勵(lì)程序以及救濟(jì)途徑等方面。文章最后還將結(jié)合我國家知識產(chǎn)權(quán)局2012年頒布的《職務(wù)發(fā)明條例草案》(征求意見稿)1的具體內(nèi)容,為完善我國職務(wù)發(fā)明獎勵(lì)制度,激勵(lì)我國科技發(fā)明創(chuàng)新,提供一些不成熟的參考意見。
[Abstract]:At present, the growth of the world economy is rapidly changing into a knowledge-innovation-oriented development model, and intellectual property rights are increasingly becoming the main driving force of economic growth. In the major innovative countries in the world, the scientific and technological innovation capability with the core of job invention as the core is becoming more and more important. Intellectual property management ability has increasingly become the key factor to determine the national economic growth potential and comprehensive competitiveness. The key reason why the strength and weakness of duty invention can reflect the innovation ability of a country lies in the fact that the duty invention system is the guarantee of balancing the interests of the unit and the inventor and the designer, and is an important means to optimize the distribution of social intellectual resources. The establishment of a perfect system of job invention can not be completed overnight. In view of the current legislative situation, there are two steps: the first step is to legislate to clarify the property right, and the legislation should establish the difference between the official invention and the non-duty invention. It lays a foundation for the next step, the second step is the legislation to reward the job invention, which is to protect the intellectual achievements of the job inventor and to encourage them. This paper first introduces the special position of the award in the patent system, and lays the theoretical and historical foundation for the legislation of the duty invention award. The birth of patent system can be said to be a regular incentive means, a special reward, in the subsequent development of legislation, the award has been an indispensable part of patent legislation. In the legislation of duty invention, reward is one of the two core contents of the legislation. After that, this paper tries to demonstrate the necessity and rationality of the legislation on the award of job invention from the point of view of the purpose, means and legal principle of intellectual property right, and to find the theoretical root of the legislation of reward for duty invention. After theoretical argumentation, this paper specifically introduces the history and evolution of the post invention legislation since the founding of the people's Republic of China, and compares the practice of the duty invention legislation and the duty invention reward system in these countries in the developed countries such as the United States, Japan, Germany and other scientific and technological developed countries. So as to provide some theoretical and practical basis for the legislative perfection of duty invention in China. Finally, based on the above argumentation and legal materials, some suggestions are put forward for perfecting the legislation of duty invention award in our country. Concretely speaking, the right of reward for duty invention belongs to the category of intellectual property, so it has the dual attribute of property and person. Therefore, when studying the legislation of reward for invention of duty, it is necessary to analyze the power attribute, the constitution of right, the procedure of right reward and the way of relief of reward legislation, especially according to the characteristics of personal right. At the end of the article, the article will combine with the specific contents of the draft regulations on Job inventions promulgated by the State intellectual property Office in 2012 (draft No 1 for soliciting opinions), in order to perfect the reward system for job inventions in our country and encourage scientific and technological inventions and innovations in our country. Provide some immature advice.
