黑龍江特色農(nóng)產(chǎn)品地理標(biāo)志保護(hù)問題研究

【摘要】:我國特色農(nóng)產(chǎn)品地理標(biāo)志保護(hù)制度起步較晚,上世紀(jì)80年代,國家相關(guān)職能部門才開始制定地理標(biāo)志保護(hù)制度的相關(guān)規(guī)則。近年來,政府越來越認(rèn)識到地理標(biāo)志保護(hù)制度對于我國這樣一個知識產(chǎn)權(quán)法律制度不大健全的發(fā)展中國家的重要性,也認(rèn)識到作為傳統(tǒng)的農(nóng)業(yè)大國,我國潛在著巨大的農(nóng)產(chǎn)品地理標(biāo)志資源。黑龍江省地處典型寒地黑土的中心區(qū),由于地理因素和文化傳統(tǒng)的差異,初級產(chǎn)品、農(nóng)副土特產(chǎn)品十分豐富,孕育了豐富的優(yōu)質(zhì)特色農(nóng)產(chǎn)品。黑龍江省的特色農(nóng)產(chǎn)品在發(fā)展過程中,地理標(biāo)志保護(hù)制度具有明顯的推動作用,對于經(jīng)濟(jì)的發(fā)展也有一定的促進(jìn)作用。黑龍江省工商局在原有特色農(nóng)產(chǎn)品地理標(biāo)志保護(hù)法律法規(guī)框架內(nèi),不斷出臺細(xì)化的特色管理細(xì)則,進(jìn)一步加大對于黑龍江省特色農(nóng)產(chǎn)品地理標(biāo)志的保護(hù)力度。黑龍江省工商、質(zhì)監(jiān)、農(nóng)業(yè)等各相關(guān)部門明確各自管理登記責(zé)任,初步形成了地理標(biāo)志產(chǎn)品的一套培育方法:為了提高特色農(nóng)產(chǎn)品申報地理標(biāo)志的成功率,生產(chǎn)過程中要嚴(yán)格按照要求執(zhí)行,選擇適當(dāng)?shù)姆绞酱_保獨特品質(zhì)優(yōu)勢。通過多種方式進(jìn)行傳播和宣揚,如新聞、報紙和廣播等,大多數(shù)企業(yè)對于地理標(biāo)志都是從開始的觀望態(tài)度,陸續(xù)變成主動去接觸,部分農(nóng)民逐漸意識到通過地理標(biāo)志可以給自身帶來巨大收益。但由于對地理標(biāo)志缺乏保護(hù)意識,長期被大量濫用、假冒,嚴(yán)重影響了產(chǎn)品的經(jīng)濟(jì)效益和市場聲譽。該論文運用比較研究法、歸納總結(jié)法等研究方法,把黑龍江省特色農(nóng)產(chǎn)品地理標(biāo)志保護(hù)作為研究對象,運用《商標(biāo)法》、《TRIPS協(xié)定》等相關(guān)理論,分析了黑龍江省特色農(nóng)產(chǎn)品地理標(biāo)志保護(hù)的現(xiàn)狀,揭示了黑龍江省在特色農(nóng)產(chǎn)品地理標(biāo)志保護(hù)上存在保護(hù)力度不夠強(qiáng)大,保護(hù)手段單一;法律制度不夠完善,監(jiān)管部門有失協(xié)調(diào);質(zhì)量標(biāo)準(zhǔn)執(zhí)行不力,假冒偽劣現(xiàn)象嚴(yán)重;品牌開發(fā)力度不夠,經(jīng)營規(guī)模過于分散;缺乏創(chuàng)立品牌意識,產(chǎn)品商品化程度低的問題,分析了產(chǎn)生問題是由于法律法規(guī)不健全、生產(chǎn)者監(jiān)管不力、政府監(jiān)管不到位、農(nóng)民素質(zhì)及保護(hù)意識不夠等方面原因造成的。結(jié)合國內(nèi)外農(nóng)產(chǎn)品地理標(biāo)志保護(hù)經(jīng)驗,提出要完善相關(guān)立法,增強(qiáng)制度保護(hù);行政部門統(tǒng)一監(jiān)管,明確職責(zé)權(quán)限;提高農(nóng)民素質(zhì),增強(qiáng)保護(hù)意識;強(qiáng)化政府責(zé)任、加強(qiáng)市場監(jiān)管;發(fā)揮行業(yè)協(xié)會作用,加大宣傳力度的對策。為其相關(guān)政策的發(fā)展,相關(guān)農(nóng)業(yè)法律法規(guī)的完善、增強(qiáng)特色農(nóng)產(chǎn)品競爭力、解決“三農(nóng)”問題以及實現(xiàn)農(nóng)業(yè)區(qū)域發(fā)展目標(biāo)、保護(hù)自然資源和傳統(tǒng)文化遺產(chǎn)、實現(xiàn)農(nóng)業(yè)產(chǎn)業(yè)化提供參考依據(jù)和助力支持。
[Abstract]:The protection system of geographical indications for agricultural products with Chinese characteristics started relatively late. In the 1980s, the relevant functional departments of the country began to formulate the relevant rules of the protection system of geographical indications. In recent years, governments have become increasingly aware of the importance of the system of geographical indication protection for a developing country such as ours, which has a weak legal system on intellectual property rights, and of being a traditional agricultural country, There is a huge potential geographical indication resource of agricultural products in our country. Heilongjiang Province is located in the center of the typical cold black soil. Due to the differences of geographical factors and cultural traditions, the primary products and special agricultural products are very rich, giving birth to a wealth of high-quality and characteristic agricultural products. In the process of development of characteristic agricultural products in Heilongjiang Province, the system of geographical indication protection plays an obvious role in promoting the development of economy. Within the framework of the original laws and regulations on the protection of geographical indications of agricultural products with special characteristics, the Bureau of Industry and Commerce of Heilongjiang Province has continuously issued detailed rules of characteristic management to further strengthen the protection of geographical indications of agricultural products with characteristics in Heilongjiang Province. The relevant departments in Heilongjiang Province, such as industry and commerce, quality supervision, agriculture and other relevant departments, have made clear their respective management and registration responsibilities, and have preliminarily formed a set of cultivation methods for geographical indication products: in order to improve the success rate of applying geographical indications for agricultural products with special characteristics, In the production process, strictly according to the requirements, select appropriate ways to ensure unique quality advantages. Through a variety of means of dissemination and promotion, such as news, newspapers and radio, most enterprises have changed from a wait-and-see attitude towards geographical indications to active contacts. Some farmers have come to realize that geographical indications can bring huge benefits to themselves. However, due to the lack of protection consciousness to geographical indications, it has been abused and counterfeit for a long time, which has seriously affected the economic benefits of products and market reputation. This paper uses comparative research method, summing up method and other research methods, taking the protection of geographical indications of agricultural products with characteristics in Heilongjiang Province as the research object, using the relevant theories such as Trademark Law, TRIPS Agreement, etc. This paper analyzes the present situation of the geographical indication protection of characteristic agricultural products in Heilongjiang Province, and reveals that the protection of the geographical indications of characteristic agricultural products in Heilongjiang Province is not strong enough, the means of protection are single, the legal system is not perfect enough, There is a lack of coordination between the regulatory authorities; the poor implementation of quality standards and the serious phenomenon of fake and shoddy; the insufficient strength of brand development, the excessive dispersion of business scale, the lack of brand awareness and the low degree of commercialization of products, The problems are caused by imperfect laws and regulations, weak supervision by producers, inadequate supervision by the government, inadequate quality of farmers and insufficient consciousness of protection. Based on the experience of agricultural products geographical indication protection at home and abroad, the paper puts forward that the relevant legislation should be perfected, the system protection should be strengthened, the administrative department should unify the supervision and control, the duty and authority should be defined, the quality of farmers should be improved, the consciousness of protection should be enhanced Strengthen the market supervision; give play to the role of industry associations, increase publicity measures. For the development of its related policies, the perfection of relevant agricultural laws and regulations, the enhancement of the competitiveness of characteristic agricultural products, the solution of the "three rural areas" and the realization of agricultural regional development goals, and the protection of natural resources and traditional cultural heritage, The realization agriculture industrialization provides the reference basis and the assistance support.
