【摘要】：面對(duì)當(dāng)前全球共同面臨的氣候變化和能源危機(jī)問題,綠色技術(shù)被認(rèn)為是實(shí)現(xiàn)未來低碳長遠(yuǎn)發(fā)展的有效工具,綠色知識(shí)產(chǎn)權(quán)制度作為促進(jìn)綠色科技創(chuàng)新和技術(shù)進(jìn)步的有效制度,被認(rèn)為是應(yīng)對(duì)氣候變化與能源危機(jī)的有效手段。目前國內(nèi)外學(xué)者關(guān)于綠色知識(shí)產(chǎn)權(quán)的研究主要集中在對(duì)綠色專利的探討上。包括綠色技術(shù)和綠色專利的界定、綠色專利制度的構(gòu)建、綠色專利加速審查與強(qiáng)制許可制度,以及綠色專利跨國轉(zhuǎn)移方面的研究等。而且研究視角和研究方法也較為局限,多偏向于法律領(lǐng)域的定性研究,研究層次基本集中在國家層面,很少進(jìn)行區(qū)域?qū)用娴难芯�。因�?構(gòu)建區(qū)域綠色知識(shí)產(chǎn)權(quán)發(fā)展戰(zhàn)略,將綠色知識(shí)產(chǎn)權(quán)作為整體概念,進(jìn)行系統(tǒng)性的定性與定量相結(jié)合的研究很有必要。本文以安徽省作為研究對(duì)象,從當(dāng)前安徽省面臨的嚴(yán)峻氣候環(huán)境出發(fā),結(jié)合國家倡導(dǎo)的綠色發(fā)展理念,綜合運(yùn)用文獻(xiàn)分析、耦合分析、回歸分析、層次分析、專家咨詢等分析方法,對(duì)安徽省綠色知識(shí)產(chǎn)權(quán)發(fā)展的戰(zhàn)略路徑進(jìn)行了系統(tǒng)性的研究。文章首先對(duì)安徽省綠色知識(shí)產(chǎn)權(quán)發(fā)展的全球化背景、研究目的和意義、研究方法、內(nèi)容與創(chuàng)新點(diǎn)作了詳細(xì)探討。隨后對(duì)國內(nèi)外學(xué)者的研究動(dòng)態(tài)作了述評(píng),并詳細(xì)闡述了知識(shí)產(chǎn)權(quán)戰(zhàn)略、綠色知識(shí)產(chǎn)權(quán)、綠色發(fā)展理論的相關(guān)內(nèi)涵及特點(diǎn)。然后,通過耦合分析方法,對(duì)安徽省綠色知識(shí)產(chǎn)權(quán)與低碳經(jīng)濟(jì)發(fā)展的相互作用關(guān)系作了解析。在安徽省綠色知識(shí)產(chǎn)權(quán)發(fā)展現(xiàn)狀的研究基礎(chǔ)上,采用定性分析初步確定安徽省綠色知識(shí)產(chǎn)權(quán)發(fā)展的影響因素,接著綜合運(yùn)用了主成分分析方法與多元回歸方法,研究安徽省16個(gè)地級(jí)市的樣本數(shù)據(jù),重點(diǎn)分析了各個(gè)因素與綠色知識(shí)產(chǎn)權(quán)發(fā)展的相關(guān)性。隨后文章運(yùn)用層次分析法,在前文的影響因素分析結(jié)果的基礎(chǔ)上,結(jié)合專家咨詢法,確定各因素的判斷矩陣,并運(yùn)用yaahp 10.4分析軟件進(jìn)行具體的權(quán)重計(jì)算,得出各個(gè)影響因素的重要性排序。最終根據(jù)主要影響因素選擇出適合安徽省綠色知識(shí)產(chǎn)權(quán)發(fā)展的戰(zhàn)略路徑。最后,文章得出的結(jié)論為:當(dāng)前安徽省綠色知識(shí)產(chǎn)權(quán)發(fā)展存在的不足較多,且知識(shí)產(chǎn)權(quán)人才、資金投入、政策法規(guī)是影響其發(fā)展的主要因素,因此安徽省應(yīng)明確戰(zhàn)略目標(biāo),建立健全綠色知識(shí)產(chǎn)權(quán)人才培養(yǎng)體系及資金投入政策,并完善相關(guān)政策法規(guī)和管理服務(wù)機(jī)制,充分協(xié)調(diào)各種資源和政策來助力安徽省綠色知識(shí)產(chǎn)權(quán)的快速發(fā)展,促進(jìn)綠色技術(shù)的推廣和應(yīng)用,并最終提升安徽省在低碳經(jīng)濟(jì)舞臺(tái)上的競爭力。
[Abstract]:In the face of the current global climate change and energy crisis, green technology is considered to be an effective tool for the future low-carbon long-term development. The green intellectual property system is an effective system to promote green scientific and technological innovation and technological progress. It is considered to be an effective means to deal with climate change and energy crisis. At present, scholars at home and abroad mainly focus on the research of green patent. It includes the definition of green technology and green patent, the construction of green patent system, the system of accelerated examination and compulsory licensing of green patent, and the research on transnational transfer of green patent. And the research perspective and research methods are also relatively limited, more inclined to qualitative research in the field of law, the level of research is basically focused on the national level, rarely on the regional level. Therefore, it is necessary to construct the development strategy of regional green intellectual property, take green intellectual property as the whole concept, and carry on systematic qualitative and quantitative research. This paper takes Anhui Province as the research object, starting from the severe climate environment facing Anhui Province, combining the concept of green development advocated by the state, synthetically using literature analysis, coupling analysis, regression analysis, hierarchical analysis, This paper systematically studies the strategic path of the development of green intellectual property in Anhui province by means of expert consultation and other analytical methods. Firstly, the paper discusses the globalization background, research purpose and significance, research method, content and innovation of the development of green intellectual property in Anhui province. Then the research trends of domestic and foreign scholars are reviewed, and the relevant connotation and characteristics of intellectual property strategy, green intellectual property and green development theory are expounded in detail. Then, the interaction between green intellectual property and the development of low carbon economy in Anhui Province is analyzed by coupling analysis method. On the basis of the research on the present situation of the development of green intellectual property in Anhui Province, this paper uses qualitative analysis to determine the influencing factors of the development of green intellectual property in Anhui Province, and then uses the principal component analysis method and the multiple regression method synthetically. This paper studies the sample data of 16 prefectural cities in Anhui Province, and analyzes the correlation between each factor and the development of green intellectual property. Then the paper uses analytic hierarchy process (AHP) to determine the judgment matrix of each factor on the basis of the analysis results of influencing factors and expert consultation method, and uses yaahp 10.4 analysis software to calculate the specific weight of each factor. The order of importance of each influencing factor is obtained. Finally, according to the main influencing factors, choose the strategic path suitable for the development of green intellectual property in Anhui province. Finally, the paper draws the conclusion that there are many shortcomings in the development of green intellectual property in Anhui Province, and intellectual property talents, capital investment, policies and regulations are the main factors that affect the development of the green intellectual property rights, so Anhui Province should make clear the strategic objectives. To establish and improve the personnel training system and capital investment policy of green intellectual property, and to perfect the relevant policies, regulations and management service mechanisms, and to fully coordinate all kinds of resources and policies to help the rapid development of green intellectual property in Anhui Province. Promote the promotion and application of green technology, and ultimately enhance the competitiveness of Anhui Province on the stage of low-carbon economy.
