【摘要】：在法律范疇,商業(yè)秘密是作為知識(shí)產(chǎn)權(quán)法的一個(gè)重要術(shù)語(yǔ)而存在的。由于商業(yè)與秘密的字樣組合,使許多影視界從業(yè)人員誤認(rèn)為商業(yè)秘密就是在商業(yè)競(jìng)爭(zhēng)中保持不敗之地的獲勝秘訣。法治化社會(huì)的進(jìn)程,不僅包括法律條文和執(zhí)行程序的完善和提升,也反映在影視業(yè)對(duì)于法律元素細(xì)節(jié)的追求和運(yùn)用。影視業(yè)喜歡引用法學(xué)上的專用術(shù)語(yǔ)來(lái)與時(shí)俱進(jìn),希望達(dá)到吸引大眾的導(dǎo)讀效果,這無(wú)疑是一種進(jìn)步。但是,由于專業(yè)領(lǐng)域的不同以及習(xí)慣式引用,影視業(yè)在引用的法律概念及其構(gòu)成要件的理解上時(shí)有誤解,這種引用不僅與專業(yè)性術(shù)語(yǔ)的本意產(chǎn)生差異,也對(duì)觀眾產(chǎn)生誤導(dǎo)甚至是錯(cuò)誤的曲解引導(dǎo)。本文僅就經(jīng)常遇到曲解的"商業(yè)秘密"這一法律術(shù)語(yǔ)和誤用進(jìn)行剖析,以期引導(dǎo)。
[Abstract]:In the field of law, trade secret exists as an important term in intellectual property law. Because of the combination of trade and secret, many film and television practitioners mistake the trade secret as the winning secret of keeping an invincible position in the commercial competition. The process of ruling by law not only includes the perfection and promotion of the legal provisions and executive procedures, but also reflects the pursuit and application of the details of the legal elements in the film and television industry. The film and television industry likes to use the legal terminology to keep pace with the times, hoping to attract the public to read, this is undoubtedly a progress. However, due to the differences in professional fields and customary citations, the film and television industry misunderstands the legal concept and its constituent elements of citation, which is not only different from the original intention of professional terms. It also misleads and even misinterprets the audience. This paper analyzes the legal term and misuse of "trade secret", which is often misinterpreted, in order to guide it.
