【摘要】：科教興國戰(zhàn)略背景下，高校作為我國高新技術(shù)的重要產(chǎn)出基地之一，受到國家越來越多的重視，得到的資金投入不斷增加。知識經(jīng)濟時代的到來，使得高校對技術(shù)成果的保護力度不斷加大，高校專利申請數(shù)量的急速攀升已成為不爭的事實，這無疑成為我國知識產(chǎn)權(quán)保護制度發(fā)展歷程中的可喜進步，但是，在這一成就背后存在著一大問題卻不容忽視——高校專利轉(zhuǎn)化率普遍偏低，遠遠落后于美國、日本等發(fā)達國家�；�于學者對我國高校專利轉(zhuǎn)化的法律環(huán)境缺乏系統(tǒng)研究的現(xiàn)狀，本文在對我國高校專利轉(zhuǎn)化涉及到的法律障礙進行分析的基礎之上，提出一些粗淺的完善建議。 本文共分四個部分。第一部分對高校專利轉(zhuǎn)化進行了概述。概括出高校專利轉(zhuǎn)化的概念、特征，并簡要介紹了高校專利的主要轉(zhuǎn)化模式，為后文的分析及論述奠定了理論基礎。 第二部分從四個方面對我國高校專利轉(zhuǎn)化的立法現(xiàn)狀進行了具體分析，包括高�？蒲腥藛T的獎酬規(guī)定、高校與企業(yè)之間簽訂專利轉(zhuǎn)化合同的法律障礙、高校專利轉(zhuǎn)化機構(gòu)的規(guī)范以及高校科研基金的規(guī)范，通過對現(xiàn)行法律條文的分析，歸納出我國高校專利轉(zhuǎn)化法律中存在的問題。 第三部分通過對高校專利轉(zhuǎn)化率較高的美國、日本等國外立法實踐的研究分析，歸納出這些國家的相關法律規(guī)范，，為我國相關法律環(huán)境完善提供借鑒。 第四部分對我國高校專利轉(zhuǎn)化法律環(huán)境的完善提出一些建議，主要針對第二部分立法現(xiàn)狀中存在的問題進行一一完善。最后結(jié)語部分總結(jié)了文章的研究內(nèi)容并提出了研究展望。
[Abstract]:Under the strategic background of rejuvenating the country through science and education, colleges and universities, as one of the important output bases of high and new technology in our country, are paid more and more attention by the country, and the capital input is increasing constantly. With the arrival of the knowledge economy era, the protection of technological achievements in colleges and universities has been strengthened continuously, and the rapid increase in the number of patent applications has become an indisputable fact, which undoubtedly has become a gratifying progress in the development of intellectual property protection system in China. However, there is a big problem behind this achievement: the conversion rate of university patent is generally low, which lags far behind the developed countries, such as the United States and Japan. Based on the scholars' lack of systematic research on the legal environment of patent transformation in colleges and universities in China, this paper analyzes the legal obstacles involved in the patent transformation of colleges and universities in China, and puts forward some superficial suggestions to improve the legal environment of patent transformation in colleges and universities in China. This paper is divided into four parts. The first part summarizes the patent transformation in colleges and universities. This paper summarizes the concept and characteristics of patent transformation in colleges and universities, and briefly introduces the main transformation modes of patent in colleges and universities, which lays a theoretical foundation for the analysis and discussion of the following articles. The second part has carried on the concrete analysis from four aspects to our country university patent transformation legislation present situation, including the university scientific research personnel reward stipulation, the university and the enterprise signed the patent conversion contract legal barrier, Through the analysis of the current legal provisions, this paper summarizes the problems existing in the law of patent transformation in colleges and universities in China by analyzing the norms of patent conversion institutions in colleges and universities as well as the norms of scientific research funds in colleges and universities. The third part through the higher conversion rate of patent in the United States, Japan and other foreign legislative practice research and analysis, summed up the relevant legal norms of these countries, for our country to provide reference for the improvement of the relevant legal environment. The fourth part puts forward some suggestions on the perfection of the legal environment of patent transformation in colleges and universities in China, mainly aiming at the problems existing in the second part of the legislation. Finally, the conclusion summarizes the research content and puts forward the research prospect.
