【摘要】:近年來,車輛掛靠經(jīng)營(yíng)已成為運(yùn)輸行業(yè)廣泛存在的一種特殊現(xiàn)象,在這種經(jīng)營(yíng)模式下發(fā)生的勞動(dòng)爭(zhēng)議也隨之頻繁。但目前對(duì)于這種經(jīng)營(yíng)模式下出現(xiàn)的勞動(dòng)爭(zhēng)議,尤其是界定勞動(dòng)者與用人單位是否存在勞動(dòng)關(guān)系的問題,學(xué)界還存在較大的爭(zhēng)議,難以達(dá)成共識(shí)。實(shí)踐中,審判者在審理此類案件時(shí)也只能憑借自身對(duì)案件的理解進(jìn)行自由裁量,造成各地法院對(duì)同一類事實(shí)的案件出現(xiàn)不同的觀點(diǎn)和判決,使當(dāng)事人對(duì)于判決結(jié)果無法信服,不僅侵犯了當(dāng)事人的合法權(quán)益,而且嚴(yán)重違背了法律的公平和正義。因此,有必要在理論上對(duì)此類案件進(jìn)行分析探討,以求盡快達(dá)成共識(shí),維護(hù)法律的統(tǒng)一性。 本文正文主要分為三個(gè)部分。第一部分主要介紹了張某與A公司之間有關(guān)車輛掛靠經(jīng)營(yíng)中勞動(dòng)爭(zhēng)議案件的基本案情以及本案爭(zhēng)議的兩個(gè)焦點(diǎn)問題,一是受聘司機(jī)與被掛靠單位是否存在勞動(dòng)關(guān)系的問題,二是法律責(zé)任應(yīng)如何承擔(dān)的問題。第二部分主要是對(duì)本案的爭(zhēng)議問題進(jìn)行深入地分析和探討,首先重點(diǎn)分析本案中勞動(dòng)關(guān)系的認(rèn)定問題,主要從勞動(dòng)關(guān)系認(rèn)定的理論分析、車輛掛靠經(jīng)營(yíng)法律關(guān)系分析以及本案勞動(dòng)關(guān)系的認(rèn)定問題分析三個(gè)方面進(jìn)行討論研究;其次分析法律責(zé)任的承擔(dān)問題,也包括兩個(gè)方面,即在認(rèn)定存在勞動(dòng)關(guān)系的情況下法律責(zé)任如何承擔(dān)和認(rèn)定不存在勞動(dòng)關(guān)系的情況下法律責(zé)任如何承擔(dān)的問題。第三部分闡述了本案的判決結(jié)果及由本案引發(fā)的法律思考。由本案一、二審法院不同的判決結(jié)果及處理情況,引發(fā)討論處理此類案件所亟待解決的法律問題,針對(duì)該法律問題,提出兩個(gè)方面的建議:一是明確認(rèn)定勞動(dòng)關(guān)系的標(biāo)準(zhǔn),二是完善車輛掛靠經(jīng)營(yíng)立法。 本文通過對(duì)一個(gè)具體且具有典型性的車輛掛靠經(jīng)營(yíng)中勞動(dòng)爭(zhēng)議糾紛案例進(jìn)行分析,重點(diǎn)研究了該案例爭(zhēng)議的焦點(diǎn)問題,從而提出了該案例以及類似案件體現(xiàn)出的法律問題和對(duì)此的相關(guān)建議,希望對(duì)我國(guó)今后此類案件的審理提供一些理論上的參考和依據(jù)。
[Abstract]:In recent years, vehicle linking operation has become a special phenomenon in the transportation industry, and the labor disputes in this mode also occur frequently, but for the current labor disputes under this mode of operation. In particular, to define whether there is a labor relationship between the laborer and the employing unit, there are still a lot of disputes in academic circles, so it is difficult to reach a consensus. In practice. Judges in such cases can only rely on their own understanding of the case for discretion, resulting in local courts on the same type of fact cases appear different views and judgments. Not only infringes the legitimate rights and interests of the parties, but also seriously violates the fairness and justice of the law. Therefore, it is necessary to analyze and explore this kind of cases in theory. In order to reach a consensus as soon as possible and maintain the unity of the law. The main body of this paper is divided into three parts. The first part mainly introduces the basic facts of the labor dispute case between Zhang and A company and the two focal points of the dispute. The first is whether there is a labor relationship between the employed driver and the affiliated unit, and the second is how to bear the legal liability. The second part is mainly about the in-depth analysis and discussion of the dispute in this case. First of all, it focuses on the identification of labor relations in this case, mainly from the theoretical analysis of labor relations. The analysis of the legal relationship of the vehicle linking operation and the determination of the labor relations in this case are discussed and studied in three aspects. Secondly, it analyzes the problem of legal liability, including two aspects. That is, how to assume the legal liability in the case of the existence of labor relations and how to assume the legal liability in the case where there is no labor relationship. The third part expounds the result of the judgment and the law triggered by the case. Law of thought. In this case. This paper puts forward the legal problems and relevant suggestions of this case and similar cases, and hopes to provide some theoretical references and basis for the trial of such cases in the future in our country.
