【摘要】:平等的就業(yè)權(quán)是勞動(dòng)者的基本權(quán)利,也是社會(huì)正義的保證,是體面勞動(dòng)的一部分。我國(guó)政府已經(jīng)深刻認(rèn)識(shí)到了消除就業(yè)和職業(yè)歧視的重要性,并于2006年正式批準(zhǔn)國(guó)際勞工組織《消除就業(yè)和職業(yè)歧視公約》(第111號(hào)公約)這一國(guó)際促進(jìn)就業(yè)機(jī)會(huì)和待遇平等的最核心公約,表示中國(guó)已樹立推進(jìn)平等就業(yè)權(quán)的決心。 《公約》簽署后,中國(guó)政府出臺(tái)了一系列與推進(jìn)平等就業(yè)有關(guān)的法律、法規(guī)和政策,包括《勞動(dòng)合同法》和《就業(yè)促進(jìn)法》等。但是從法律實(shí)施效果和社會(huì)狀況來(lái)看,我國(guó)消除就業(yè)歧視還有很長(zhǎng)的路要走!豆s》約定的履約義務(wù)尚未完全實(shí)現(xiàn)。 鑒于我國(guó)鮮有學(xué)者站在《公約》角度上探討我國(guó)法律制度和《公約》要求的差距,本文有意從《公約》入手解析《公約》的內(nèi)容和規(guī)定的義務(wù),進(jìn)而討論我國(guó)就業(yè)歧視法制建設(shè)的不足;并試圖通過(guò)比較在反就業(yè)歧視方面工作突出的國(guó)家和地區(qū)的制度狀況,為我國(guó)反就業(yè)歧視法律體系和社會(huì)制度建設(shè)提出建議。
[Abstract]:Equal employment right is the basic rights of workers, but also the guarantee of social justice, is a part of the decent work. Our government has a profound understanding of the importance of eliminating discrimination in employment and occupation, and approved by the International Labour Organization "the elimination of discrimination in respect of employment and occupation" in 2006 officially (Convention No. 111st) of the international promotion equality of opportunity and treatment in employment of the most core conventions, said Chinese has set to promote equal employment rights determination.
< > after signing the Convention, China government issued a series of related laws and promote equal employment, regulations and policies, including the "labor contract law" and "Employment Promotion Law". But from the legal effect and social situation, elimination of China still has a long way to go. Convention "agreed obligations the employment discrimination is not yet fully implemented.
In view of China's few scholars stand in the angle of convention > < < the law system of our country and the gap between the requirements of this Convention ", the content and the intention from the provisions of the Convention Convention > < < > of the obligation, and then discuss China's lack of Employment Discrimination Legal System construction; and tries to system status in anti discrimination in employment aspects of the work of prominent countries and regions, for the construction of discrimination legal system and social system of China's anti employment recommendations.
