我國“以房養(yǎng)老”法律制度建設(shè)研究

【摘要】:以房養(yǎng)老,也稱為反向抵押貸款,是社會養(yǎng)老保障制度上的重要補(bǔ)充,也是英美國家為解決老齡化問題的利器。它是指擁有房屋所有權(quán)的老年人,將其房屋做抵押向貸款機(jī)構(gòu)借款,同時保留房屋的居住權(quán),貸款本息在合同期屆滿、房屋出售、受益人死亡時,用出售住房所得資金進(jìn)行償還的一種養(yǎng)老模式。其對于緩解社會老齡化危機(jī)、提高老年人物質(zhì)與精神需求、促進(jìn)金融行業(yè)多元化發(fā)展等方面具有積極意義。本文先從“以房養(yǎng)老”基本概念及其特征入手,再結(jié)合我國發(fā)展“以房養(yǎng)老”的社會背景,得出目前我國“以房養(yǎng)老”實(shí)踐中存在的問題。接著,通過對比分析法,將美國、英國的“以房養(yǎng)老”運(yùn)用實(shí)踐及法律風(fēng)險防范措施兩方面進(jìn)行深入剖析,得出針對我國構(gòu)建“以房養(yǎng)老”制度的有益啟示,最后從主體制度、風(fēng)險防范制度、其他配套制度等三個方面構(gòu)建契合于我國的“以房養(yǎng)老”制度。
[Abstract]:Housing for the aged, also known as reverse mortgage, is an important supplement to the social old-age security system, and is also a sharp weapon to solve the aging problem in the United States and the United States. It refers to an elderly person who owns a house, borrows his house as a mortgage from the loan institution, and retains the right of residence of the house. The principal and interest of the loan expire, the house is sold, and the beneficiary dies. An old age model that uses the proceeds from the sale of a house to repay. It is of great significance to alleviate the crisis of aging society, improve the material and spiritual needs of the elderly, and promote the diversified development of financial industry. This paper begins with the basic concept and characteristics of "providing for the aged by Housing", and then combines with the social background of the development of "providing for the aged by Housing" in our country, and concludes the problems existing in the practice of "providing for the aged by Housing" in our country at present. Then, by means of comparative analysis, the author deeply analyzes the practice and legal risk prevention measures of "providing for the aged by Housing" in the United States and Britain, and draws the beneficial enlightenment of constructing the system of "providing for the aged by Housing" in China, finally, from the subject system. Risk prevention system, other supporting system, etc.
