第三方支付平臺的法律監(jiān)管研究

【摘要】:互聯(lián)網(wǎng)技術(shù)的不斷更新和電子商務(wù)的快速成長,極大的沖擊了實體購物的傳統(tǒng)消費模式,電子商務(wù)買賣模式以其方便性、快捷性等優(yōu)勢進(jìn)入人們的視野。與此同時,一種全新的交易經(jīng)營模式——第三方支付也應(yīng)運而生,順勢涌現(xiàn)出了一大批第三方支付平臺。 網(wǎng)絡(luò)第三方支付的誕生解決了交易雙方的信任和效率問題,緩解了傳統(tǒng)交易方式支付過程中交易各方的緊張關(guān)系,是一種新型的貨幣支付模式,讓用戶體驗了新支付方式帶來的便捷感受。作為獨立于買賣雙方的獨立第三方,第三方支付平臺為互聯(lián)網(wǎng)交易中的商家和消費者提供了一個交換貨幣的中轉(zhuǎn)站,特別大的便利了商事領(lǐng)域的買賣雙方的交易活動。因而,近年來,第三方支付平臺的數(shù)目和平臺成交額都在顯著增長,支付的范圍也呈現(xiàn)不斷擴大的趨勢。由于我國第三方支付相關(guān)法律、法規(guī)監(jiān)管的缺失,在第三方支付平臺迅猛發(fā)展的同時也引發(fā)出許多法律問題。 從2010年開始,我國結(jié)束了對第三方支付領(lǐng)域無監(jiān)管的真空狀態(tài),中國人民銀行陸續(xù)頒布了《非金融機構(gòu)支付服務(wù)管理辦法》及其《實施細(xì)則》、《支付機構(gòu)客戶備付金存管辦法》等一系列規(guī)范性法律文來規(guī)制第三方支付業(yè)務(wù)中遇到的困難。盡管如此,由于這些規(guī)范性法律文件普遍存在法律位階較低的問題,因此只能在部分程度上解決第三方支付平臺遇到的某些法律問題。第三方支付領(lǐng)域出現(xiàn)的沉淀資金及孳息歸屬、信用卡套現(xiàn)、洗錢、網(wǎng)絡(luò)詐騙、監(jiān)管缺乏體系性等一系列法律問題仍亟待解決。鑒于此,,本文希望通過辨析第三方支付及第三方支付平臺概念的不同,界定出第三方支付平臺的法律性質(zhì),分析我國第三方支付平臺監(jiān)管存在的法律問題。在順應(yīng)我國法治建設(shè)理念的基礎(chǔ)上,借鑒境外先進(jìn)經(jīng)驗,完善第三方支付平臺監(jiān)管法律體系,構(gòu)建一套行之有效的法律制度解決第三方支付法律規(guī)制不足的問題,為現(xiàn)行法律、法規(guī)的完善盡一份綿薄之力,促進(jìn)第三方支付平臺在有法可依的法制環(huán)境下不斷自我完善。
[Abstract]:With the continuous updating of Internet technology and the rapid growth of e-commerce, the traditional consumption mode of physical shopping has been greatly impacted. The e-commerce trading model has entered people's field of vision with its advantages of convenience and rapidity. At the same time, a new transaction mode-third-party payment came into being, and a large number of third-party payment platforms emerged. The birth of the network third-party payment has solved the trust and efficiency problems of both sides of the transaction, alleviated the tension between the parties in the traditional transaction payment process, and is a new kind of currency payment mode. Let the user experience the convenience of the new payment mode. As an independent third party independent of the buyer and seller, the third-party payment platform provides a transit station for merchants and consumers to exchange currency in Internet transactions, which greatly facilitates the transaction activities of both parties in the commercial field. Therefore, in recent years, the number and turnover of third-party payment platforms have increased significantly, and the range of payment has been expanding. Due to the lack of laws and regulations related to third-party payment in China, the third-party payment platform has developed rapidly and caused a lot of legal problems at the same time. Since 2010, China has put an end to the unregulated vacuum in the field of third-party payments. The people's Bank of China has promulgated a series of normative and legal texts to regulate the difficulties encountered in the third party payment business, such as the measures for the Administration of payment Services of Non-Financial institutions and its implementing rules, and the measures for the Management of customer Reserve funds of payment institutions. However, due to the problem of low legal rank in these normative legal documents, some legal problems encountered by third-party payment platforms can only be partially solved. A series of legal problems, such as the ownership of precipitation funds and fruits in the field of third party payment, credit card cash, money laundering, network fraud, lack of systematic supervision and so on, still need to be solved. In view of this, this paper hopes to define the legal nature of third-party payment platform and analyze the legal problems existing in the supervision of third-party payment platform by analyzing the different concepts of third-party payment and third-party payment platform. On the basis of conforming to the construction idea of our country's rule of law, drawing lessons from overseas advanced experience, perfecting the supervision legal system of third-party payment platform, constructing a set of effective legal system to solve the problem of insufficient legal regulation of third-party payment, which is the current law. The improvement of laws and regulations promotes the third-party payment platform to improve itself under the legal environment.
