論國際民商事條約的適用——以國際民商事條約與國際私法的關(guān)系為視角

【摘要】：國際條約以"轉(zhuǎn)化"及"納入"的方式在一國發(fā)生法律效力。在"轉(zhuǎn)化"方式下,國際民商事實體性條約是以國內(nèi)法的形式出現(xiàn),以國際私法的指引而得到適用。在"納入"方式下,國際民商事實體性條約的適用有"非國際私法模式"和"國際私法模式"兩種。中國《民法通則》第142條第2款和《聯(lián)合國國際貨物銷售合同公約》第1條第1款(b)項屬于"法際私法",解決國內(nèi)不同法律之間的適用關(guān)系,它只有在"國際私法模式"下才得以適用。
[Abstract]:International treaties have legal effect in a country by means of "transformation" and "incorporation". Under the mode of "transformation", the de facto treaties of international civil and commercial affairs appear in the form of domestic law and are applied under the guidance of private international law. Under the "incorporation" mode, the application of international civil and commercial de facto treaties can be divided into "non-private international law model" and "international private law model". Article 142, paragraph 2, of the General principles of the Civil Code of China and article 1, paragraph 1, (b), of the United Nations Convention on contracts for the International Sale of goods are "private law" to resolve the applicable relationship between different domestic laws, It can be applied only under the Model of Private International Law.
