【摘要】：中國國際法理論界和實踐界長期高度重視國際法基本原則的地位和作用,一些國外的學者也曾對此進行專門闡述。然而,在國際法的實踐、特別是國際司法實踐中,國際法的基本原則卻很少被專門提及,處于一種迷失狀態(tài)。通過國際法的基本原則與《國際法院規(guī)約》規(guī)定的"一般法律原則"的對比,可以看出國際法基本原則存在著在法律淵源的列表中未能被正式規(guī)定的缺憾;通過對國際法的基本原則與近期被高度重視的"強行法"的比較,可以發(fā)現(xiàn)國際法基本原則的純政治血統(tǒng)是其在國際法整體上趨向?qū)I(yè)化、技術(shù)化進程中被邊緣化的主要原因。道德驅(qū)動的政治決議與技術(shù)掩蓋的利益導向進行博弈,后者取得了優(yōu)勢。然而,從未來出路看,具有權(quán)衡特征的國際法基本原則在當代國際法體系中具有指引、協(xié)調(diào)、整合的作用,滿足國際法未來健康發(fā)展進程的需求,故而應賦予和提升國際法基本原則的地位,中國作為國際法的后發(fā)國家應繼續(xù)高度重視并倡導國際法的基本原則。
[Abstract]:The theoretical and practical circles of international law in China attach great importance to the status and function of the basic principles of international law for a long time, and some foreign scholars have expounded it specially. However, in the practice of international law, especially in the practice of international justice, the basic principles of international law are seldom mentioned and are in a state of loss. Through the comparison between the basic principles of international law and the "general principles of law" stipulated in the Statute of the International Court of Justice, it can be seen that the basic principles of international law have the defect that they have not been formally stipulated in the list of sources of law; Through the comparison between the basic principles of international law and the recent "jus cogens", it can be found that the pure political origin of the basic principles of international law is the main cause of its tendency towards specialization and marginalization in the process of technicalization of international law as a whole. Moral-driven political decisions play with technology-masked interest-oriented, the latter gaining an advantage. However, from the perspective of the way forward, the fundamental principles of international law, characterized by trade-offs, play a guiding, coordinating and integrated role in the contemporary system of international law in order to meet the needs of the future healthy development of international law, Therefore, we should give and promote the status of the basic principles of international law. China, as a latecomer of international law, should continue to attach great importance to and advocate the basic principles of international law.
