【摘要】:國(guó)際投資是當(dāng)代世界各國(guó)經(jīng)濟(jì)交往的常見(jiàn)形式,但在實(shí)踐過(guò)程中也產(chǎn)生了大量的投資爭(zhēng)議。為了解決外國(guó)投資者和東道國(guó)之間的投資爭(zhēng)議,“解決投資爭(zhēng)端國(guó)際中心”(以下簡(jiǎn)稱“ICSID”或“中心”)機(jī)制應(yīng)運(yùn)而生。仲裁裁決的承認(rèn)和執(zhí)行是ICSID機(jī)制有效性的重要保障,而國(guó)家豁免是橫亙?cè)诓脹Q執(zhí)行過(guò)程中的最大阻礙。事實(shí)上,實(shí)踐中已經(jīng)出現(xiàn)了主權(quán)國(guó)家援引國(guó)家豁免拒絕執(zhí)行ICSID裁決的案例,但《解決國(guó)家和他國(guó)國(guó)民間投資爭(zhēng)端公約》(以下簡(jiǎn)稱《華盛頓公約》或《公約》)現(xiàn)有框架下的解決辦法卻不盡如人意。因此,本文的研究目的即是對(duì)ICSID裁決的執(zhí)行機(jī)制進(jìn)行研究,論述私人投資者在面對(duì)主權(quán)國(guó)家援引國(guó)家豁免拒絕執(zhí)行ICSID裁決時(shí)該如何保護(hù)自己的權(quán)益。同時(shí),鑒于我國(guó)與ICSID的聯(lián)系日益密切,ICSID裁決如何在我國(guó)承認(rèn)與執(zhí)行也是本文重點(diǎn)研究的內(nèi)容。通過(guò)以上研究,筆者認(rèn)為:國(guó)家豁免的存在的確對(duì)ICSID裁決的執(zhí)行構(gòu)成了一定的威脅。但從現(xiàn)實(shí)層面上講,對(duì)ICSID執(zhí)行制度進(jìn)行完善具有很大的難度,私人投資者在與主權(quán)國(guó)家進(jìn)行談判時(shí)又多處于劣勢(shì)地位,所以在國(guó)家層面上保護(hù)本國(guó)投資者和海外財(cái)產(chǎn)就顯得尤為重要。因此,我國(guó)不宜一再堅(jiān)持絕對(duì)豁免立場(chǎng),應(yīng)該加強(qiáng)對(duì)限制豁免的研究并積極立法,主動(dòng)成為推動(dòng)國(guó)際法發(fā)展的先驅(qū),而不是一味被動(dòng)地應(yīng)對(duì)國(guó)際社會(huì)中的各種挑戰(zhàn)。
[Abstract]:International investment is a common form of economic exchanges in the contemporary world, but a large number of investment disputes arise in the process of practice. In order to solve the investment disputes between foreign investors and host countries, the "International Center for the settlement of Investment disputes" (hereinafter referred to as "ICSID" or "Center") came into being. The recognition and enforcement of arbitral awards is an important guarantee for the effectiveness of the ICSID mechanism, and the state immunity is the biggest obstacle in the enforcement of the award. In fact, in practice, there have been cases in which sovereign states have invoked State immunity to refuse to enforce ICSID rulings. However, the existing framework of the Convention on the settlement of Private Investment disputes between States and other countries (hereinafter referred to as the Washington Convention or the Convention) is not satisfactory. Therefore, the purpose of this paper is to study the enforcement mechanism of ICSID adjudication, and to discuss how private investors should protect their rights and interests when the sovereign state invokes the immunity of the state to refuse to execute the ICSID award. At the same time, in view of the increasingly close relationship between China and ICSID, how to recognize and enforce the ICSID decision in China is also the focus of this paper. Through the above research, the author thinks that the existence of state immunity does pose a certain threat to the enforcement of ICSID ruling. However, from a practical point of view, it is very difficult to improve the implementation system of ICSID, and private investors are often at a disadvantage when negotiating with sovereign states. So it is particularly important to protect domestic investors and overseas property at the national level. Therefore, our country should not insist on the absolute immunity position again and again, should strengthen the research on the restricted immunity and actively legislate, and become the pioneer of promoting the development of international law, instead of passively facing all kinds of challenges in the international community.
