【摘要】：互聯(lián)網(wǎng)的國(guó)際治理迄今尚處于失序狀態(tài),一方面是美國(guó)一方主導(dǎo)的"多利益攸關(guān)方"治理模式,另一方面是廣大發(fā)展中國(guó)家立基于維互聯(lián)網(wǎng)安全的治理觀,兩者的沖突致使國(guó)際治理陷入困境�；ヂ�(lián)網(wǎng)的國(guó)際秩序亟待法治,軟法因?yàn)樽陨砀�容易被簽署、更迅捷地進(jìn)入到實(shí)施階段、更靈活地適應(yīng)互聯(lián)網(wǎng)治理的需要等獨(dú)特優(yōu)勢(shì),能夠在互聯(lián)網(wǎng)國(guó)際治理中展其所長(zhǎng),最大限度地凝聚各方共識(shí)并發(fā)揮導(dǎo)向及中轉(zhuǎn)的功能。軟法在互聯(lián)網(wǎng)國(guó)際治理中產(chǎn)生實(shí)效的根源在于民主協(xié)商的對(duì)話機(jī)制和廣泛參與的合作機(jī)制。
[Abstract]:The international governance of the Internet has so far been in a state of disarray. On the one hand, it is the "multi-stakeholder" governance model led by the United States side; on the other hand, the vast number of developing countries have a view of governance based on Internet security. The conflict between the two has led to a dilemma in international governance. The international order of the Internet is in urgent need of the rule of law. Soft law, because it is easier to sign itself, more quickly enters the implementation stage, and adapts more flexibly to the needs of Internet governance, can develop its advantages in Internet international governance. To maximize the consensus of all parties and play the role of guidance and transit. The root of the effectiveness of soft law in Internet international governance lies in the dialogue mechanism of democratic consultation and the cooperation mechanism of extensive participation.
