【摘要】：先行付款制度是作為調(diào)整國(guó)際航空運(yùn)輸某些規(guī)定的1999年《蒙特利爾公約》對(duì)華沙公約體系現(xiàn)代化和一體化的創(chuàng)新因素之一。該制度在國(guó)際航空運(yùn)輸立法的新時(shí)期具有先進(jìn)性和前瞻性,對(duì)保護(hù)航空旅客運(yùn)輸事故中的受害者權(quán)益具有一定的法律作用。但是,該制度制定十多年來(lái)從理論到實(shí)踐當(dāng)中還存在一些不盡人意的地方,具有軟法性質(zhì),實(shí)則是一個(gè)空虛的法律架構(gòu),因而有必要對(duì)此制度做必要的考量和檢討,以利于我國(guó)正確運(yùn)用和在國(guó)內(nèi)法中加以合理規(guī)定。
[Abstract]:The advance payment system is one of the innovative factors for the modernization and integration of the Warsaw Convention system under the 1999 Montreal Convention, which regulates certain provisions of international air transport. This system is advanced and forward-looking in the new period of international air transport legislation, and has certain legal function to protect the rights and interests of the victims in air passenger transport accidents. However, since the establishment of this system for more than a decade, there are still some unsatisfactory aspects from theory to practice. It has a soft law nature and is in fact an empty legal framework. Therefore, it is necessary to make the necessary consideration and review of this system. In order to facilitate the correct use of our country and in the domestic law to be reasonable provisions.
