外資銀行監(jiān)管法律問題研究

【摘要】:隨著我國的改革開放,外資銀行也大量進(jìn)入中國,外資銀行對其所在國特別是發(fā)展中國家的經(jīng)濟(jì)發(fā)展既起了一定的積極作用,但同時也給這些國家?guī)硐麡O影響。怎樣合法有效的對外資銀行進(jìn)行監(jiān)管成為了現(xiàn)階段比較緊迫的問題。 第一部分,闡明了外資銀行對所在國是既有積極作用又有消極影響的,強(qiáng)調(diào)了加強(qiáng)監(jiān)管的必要性。 第二部分,分別以新加坡、美國和德國為例,證明了發(fā)達(dá)國家對外資銀行監(jiān)管內(nèi)容有一些共同點:都有一套比較完善的適合自身特點的法規(guī)體系,對外資銀行設(shè)立條件、業(yè)務(wù)范圍、享受的權(quán)利、義務(wù)等方面都作出了明確規(guī)定,而且法律的執(zhí)行相當(dāng)嚴(yán)格;注重利用法律法規(guī)建立防范各類風(fēng)險的機(jī)制,并以此為核心形成了一整套完整的技術(shù)監(jiān)管手段體系,即預(yù)防性的事前監(jiān)管、銀行檢查或稽核、保護(hù)性的事后救助監(jiān)管。 第三部分,分析巴塞爾協(xié)議及其修訂稿——新資本協(xié)議,她是國際銀行監(jiān)管最重要的系統(tǒng)規(guī)則。新資本協(xié)議較之舊資本協(xié)議的最大創(chuàng)新之處,在于不將資本監(jiān)管視野局限在資本充足性監(jiān)管上,而是最低資本、外部監(jiān)管評估和市場約束三大支柱三管齊下,并特別強(qiáng)調(diào)三大支柱應(yīng)互為摯肘,低水平或局部地實施某一個或某兩個支柱均不足以確保銀行經(jīng)營的穩(wěn)健性。我國暫時還未完全按新資本協(xié)議的要求來進(jìn)行監(jiān)管,但是在可預(yù)見的將來,新資本協(xié)議在我國的實施也是必然和必要的。 第四部分,我國目前外資銀行監(jiān)管方面還存在以下問題:立法層次低,監(jiān)管法規(guī)缺位;立法原則不明確:監(jiān)管法律體系不完善;監(jiān)管主體不完善;立法與WTO規(guī)則有差距;與巴塞爾委員會的相關(guān)要求有差距。 我們應(yīng)該在下面幾個角度和方面來著力改進(jìn)我國外資銀行監(jiān)管法律現(xiàn)狀:外資銀行的市場準(zhǔn)入監(jiān)管;外資銀行的業(yè)務(wù)運作及風(fēng)險管理;完善外資銀行市場退出監(jiān)管機(jī)制;建立外資銀行行業(yè)公會;明確金融監(jiān)管者的職責(zé)和權(quán)限,完善監(jiān)管程序;制定專門的《外資銀行法》,健全監(jiān)管法律體系;我們應(yīng)根據(jù)巴塞爾新資本協(xié)議框架并借鑒西方發(fā)達(dá)國家的經(jīng)驗來加強(qiáng)我國對外資銀行的法制監(jiān)管,避免國際金融風(fēng)險危及到國Qg金融體系的安全與穩(wěn)定。
[Abstract]:With the reform and opening up of China, foreign banks have also entered China in large numbers. Foreign banks not only play a positive role in the economic development of their host countries, especially in developing countries, but also have a negative impact on these countries at the same time. How to supervise foreign banks legally and effectively has become an urgent problem at this stage. In the first part, the author clarifies that foreign banks have both positive and negative effects on the host country, and emphasizes the necessity of strengthening supervision. The second part, taking Singapore, the United States and Germany as examples, respectively, proves that developed countries have some common points in the content of supervision of foreign banks: they all have a relatively perfect system of laws and regulations suitable for their own characteristics, and conditions for the establishment of foreign banks. The scope of business, enjoyment of rights, obligations, and other aspects have been clearly defined, and the implementation of the law is very strict; pay attention to the use of laws and regulations to establish mechanisms to prevent all kinds of risks, Based on this, a complete set of technical supervision means system is formed, that is, preventive prior supervision, bank inspection or audit, protective ex post rescue supervision. The third part analyzes the Basel Accord and its revision, the New Capital Accord, which is the most important system rule of international bank supervision. The biggest innovation of the new capital agreement compared with the old capital agreement is that the view of capital supervision is not confined to the supervision of capital adequacy, but the three pillars of minimum capital, external supervision evaluation and market constraint. In particular, it is emphasized that the three pillars should be mutually binding, and the low or partial implementation of one or two pillars is not sufficient to ensure the stability of the banking operation. At present, China has not completely complied with the requirements of the new capital agreement, but in the foreseeable future, the implementation of the new capital agreement in our country is necessary and necessary. In the fourth part, the following problems still exist in the supervision of foreign banks in our country: low level of legislation, absence of regulations, unclear principles of legislation: imperfect legal system of supervision, imperfect subject of supervision, disparity between legislation and WTO rules; There is a gap with the requirements of the Basel Committee. We should try our best to improve the legal situation of foreign bank supervision in the following aspects: market access supervision of foreign banks, business operation and risk management of foreign banks, improvement of market exit supervision mechanism of foreign banks; To establish a foreign bank trade association; to clarify the duties and powers of financial regulators, to improve the regulatory procedures; to formulate a special "Foreign Bank Law", and to improve the regulatory legal system; According to the framework of the new Basel Capital Accord and the experience of the western developed countries, we should strengthen the legal supervision of foreign banks in China so as to avoid international financial risks endangering the security and stability of the QG financial system of our country.
