【摘要】:在信息技術(shù)的發(fā)展和支撐下,為了滿足小額借款者的借款需求和小額投資者的投資需求,一種以網(wǎng)絡(luò)信息技術(shù)為基礎(chǔ)的P2P (peer-to-peer)網(wǎng)絡(luò)借貸市場(chǎng)應(yīng)運(yùn)而生。該市場(chǎng)的出現(xiàn)不僅為借貸雙方提供了更加高效、便捷的渠道,同時(shí)也是對(duì)傳統(tǒng)借貸市場(chǎng)的重要補(bǔ)充。 從2005年全球第一家從事P2P網(wǎng)絡(luò)借貸業(yè)務(wù)的平臺(tái)建立以來,P2P網(wǎng)絡(luò)借貸市場(chǎng)相繼在多個(gè)國家出現(xiàn)并得到了迅速發(fā)展。P2P網(wǎng)絡(luò)借貸市場(chǎng)于2007年進(jìn)入中國,近兩年在互聯(lián)網(wǎng)金融發(fā)展的帶動(dòng)下,P2P網(wǎng)絡(luò)借貸市場(chǎng)的發(fā)展和創(chuàng)新都非常迅速。然而,從P2P網(wǎng)絡(luò)借貸市場(chǎng)在各國的發(fā)展情況來看,系統(tǒng)層面、平臺(tái)層面以及借貸參與者層面的市場(chǎng)風(fēng)險(xiǎn)已經(jīng)逐漸開始顯現(xiàn)。與之同時(shí),由于法律法規(guī)、信用體系等多方面的原因,P2P網(wǎng)絡(luò)借貸市場(chǎng)在中國的創(chuàng)新又將該市場(chǎng)的風(fēng)險(xiǎn)更多地集中于平臺(tái)經(jīng)營與操作層面。近兩年,中國的P2P網(wǎng)絡(luò)借貸市場(chǎng)中,頻頻出現(xiàn)P2P網(wǎng)絡(luò)借貸平臺(tái)倒閉、提現(xiàn)困難以及經(jīng)營者卷款跑路的情況,說明P2P網(wǎng)絡(luò)借貸市場(chǎng)的發(fā)展發(fā)生了扭曲,P2P網(wǎng)絡(luò)借貸市場(chǎng)的優(yōu)勢(shì)不能得到體現(xiàn)。因此,如何通過合理的監(jiān)管糾正P2P網(wǎng)絡(luò)借貸市場(chǎng)中存在的問題成為監(jiān)管者、從業(yè)者以及研究者共同關(guān)注的問題。然而,對(duì)于一個(gè)還在起步發(fā)展階段的新興市場(chǎng),既要對(duì)其風(fēng)險(xiǎn)和問題進(jìn)行一定的控制,又要保護(hù)P2P網(wǎng)絡(luò)借貸市場(chǎng)的創(chuàng)新能力,使其能夠健康的、可持續(xù)的發(fā)展,因而,行業(yè)自律被監(jiān)管當(dāng)局作為中國P2P網(wǎng)絡(luò)借貸市場(chǎng)的主要監(jiān)管方式。所以,建立適度的行業(yè)自律機(jī)制從而激勵(lì)參與主體的自律行為,對(duì)于P2P網(wǎng)絡(luò)借貸市場(chǎng)的發(fā)展和監(jiān)管具有非常重要的意義。更進(jìn)一步,自律機(jī)制的建立本質(zhì)上依賴于監(jiān)管措施的制定。因而,如何實(shí)施合理、有效的監(jiān)管措施以激勵(lì)參與主體的行業(yè)自律行為,從而建立起有效的行業(yè)自律機(jī)制就變得及其重要。 根據(jù)文獻(xiàn)研究可見,鑒于P2P網(wǎng)絡(luò)借貸市場(chǎng)的特征,靈活而具有前瞻性的監(jiān)管方式為學(xué)者們所推崇,行業(yè)自律為主的監(jiān)管方式也被大多數(shù)學(xué)者所提倡。但是自律畢竟是由P2P網(wǎng)絡(luò)借貸平臺(tái)的行為直接反映的,而在P2P網(wǎng)絡(luò)借貸市場(chǎng)的研究中對(duì)P2P網(wǎng)絡(luò)借貸平臺(tái)自律行為選擇及約束的研究很少。盡管在其他行業(yè)中有部分研究參與主體自律行為的文獻(xiàn),但由于P2P網(wǎng)絡(luò)借貸市場(chǎng)中還沒有統(tǒng)一、規(guī)范的行業(yè)自律機(jī)制,因此對(duì)其借鑒作用有限。同時(shí),自律收益是影響主體自律行為選擇的根本動(dòng)力,政府的監(jiān)管和懲戒則是P2P網(wǎng)絡(luò)借貸平臺(tái)自律行為選擇的外部約束,只有當(dāng)這兩個(gè)方面的條件都具備時(shí),行業(yè)自律才能得以實(shí)現(xiàn)。然而,在P2P網(wǎng)絡(luò)借貸平臺(tái)發(fā)展過程中,對(duì)自律行為產(chǎn)生的影響以及監(jiān)管當(dāng)局的監(jiān)管措施對(duì)自律行為的約束作用的理論研究較少。對(duì)此,本文以行業(yè)自律機(jī)制建設(shè)為目的,分析了P2P網(wǎng)絡(luò)借貸平臺(tái)自律行為選擇的影響因素以及平臺(tái)自律行為選擇與政府監(jiān)管策略之間的相互關(guān)系和影響,通過剖析不同類型P2P網(wǎng)絡(luò)借貸平臺(tái)、不同發(fā)展階段P2P網(wǎng)絡(luò)借貸平臺(tái)以及政府監(jiān)管者不同的監(jiān)管策略之間的相互影響,為制定以行業(yè)自律機(jī)制建設(shè)為目標(biāo)的、符合中國實(shí)際情況的P2P網(wǎng)絡(luò)借貸市場(chǎng)監(jiān)管措施提供了理論依據(jù)和對(duì)策性建議。 本文的主體有三部分:第一部分主要包括第二章和第三章,對(duì)研究框架進(jìn)行構(gòu)建;第二部分是對(duì)研究問題的理論分析,主要包括第四、五、六章;第三部分是對(duì)比分析與借鑒研究,主要體現(xiàn)在第七章。 第一章為本文的緒論部分,主要介紹了論文的選題背景和意義,然后,結(jié)合現(xiàn)實(shí)情況,提出本文的研究目的及研究方法。最后,基于研究目的,給出研究框架和主要研究內(nèi)容。 第二章主要是對(duì)監(jiān)管理論的概述以及P2P網(wǎng)絡(luò)借貸市場(chǎng)研究現(xiàn)狀的評(píng)述。在對(duì)金融監(jiān)管相關(guān)概念進(jìn)行定義后,簡述了行業(yè)自律與政府監(jiān)管的關(guān)系。然后從市場(chǎng)發(fā)展特征、借貸雙方行為特征研究以及P2P網(wǎng)絡(luò)借貸市場(chǎng)的風(fēng)險(xiǎn)與監(jiān)管三個(gè)方面對(duì)當(dāng)前國內(nèi)外P2P網(wǎng)絡(luò)借貸市場(chǎng)研究現(xiàn)狀進(jìn)行了綜述,指出當(dāng)前研究的特點(diǎn)與范圍。 第三章對(duì)P2P網(wǎng)絡(luò)借貸市場(chǎng)的發(fā)展現(xiàn)狀及監(jiān)管現(xiàn)狀進(jìn)行了分析。從市場(chǎng)發(fā)展模式、市場(chǎng)特征對(duì)P2P網(wǎng)絡(luò)借貸市場(chǎng)的發(fā)展現(xiàn)狀進(jìn)行了梳理,然后從系統(tǒng)層面、平臺(tái)層面、借貸雙方層面對(duì)P2P網(wǎng)絡(luò)借貸市場(chǎng)的風(fēng)險(xiǎn)進(jìn)行了分析,同時(shí)對(duì)我國P2P網(wǎng)絡(luò)借貸市場(chǎng)的監(jiān)管現(xiàn)狀以及面臨的挑戰(zhàn)進(jìn)行了討論。 第四章開始是本文的理論研究部分,對(duì)P2P網(wǎng)絡(luò)借貸平臺(tái)自律行為選擇的動(dòng)機(jī)進(jìn)行了分析,得到了影響P2P網(wǎng)絡(luò)借貸平臺(tái)自律行為選擇的因素,同時(shí)分類討論了在監(jiān)管者不同的監(jiān)管策略下,P2P網(wǎng)絡(luò)借貸平臺(tái)自律行為選擇的變化。 在第四章的研究基礎(chǔ)上,第五章進(jìn)一步分類分析了主要影響因素對(duì)P2P網(wǎng)絡(luò)借貸平臺(tái)自律行為選擇所產(chǎn)生的影響。本章首先根據(jù)P2P網(wǎng)絡(luò)借貸平臺(tái)的內(nèi)在差異,將P2P網(wǎng)絡(luò)借貸平臺(tái)分為自律平臺(tái)和機(jī)會(huì)主義平臺(tái),分析自律選擇影響因素對(duì)不同平臺(tái)的影響,以及兩種平臺(tái)之間自律行為選擇的相互影響。同時(shí),討論了在不同政府監(jiān)管策略下,P2P網(wǎng)絡(luò)借貸平臺(tái)的自律選擇變化。 P2P網(wǎng)絡(luò)借貸平臺(tái)在不同的發(fā)展階段,由于面對(duì)不同的行為選擇收益,也可能會(huì)產(chǎn)生自律行為選擇的變化。所以,在第五章的研究基礎(chǔ)上,第六章針對(duì)不同發(fā)展階段P2P網(wǎng)絡(luò)借貸平臺(tái)的自律行為選擇進(jìn)行了分析,系統(tǒng)地分析了通過學(xué)習(xí)和模仿,不同發(fā)展階段的P2P網(wǎng)絡(luò)借貸平臺(tái)的自律行為選擇相互影響,及其對(duì)行業(yè)自律水平變化的影響。由于政府監(jiān)管者對(duì)新進(jìn)入P2P網(wǎng)絡(luò)借貸平臺(tái)的可控性更強(qiáng),本章還對(duì)不同政府監(jiān)管策略對(duì)新進(jìn)入市場(chǎng)的P2P平臺(tái)的自律行為選擇的影響進(jìn)行了深入地分析。在均衡結(jié)果分析的基礎(chǔ)上,對(duì)政府監(jiān)管者的監(jiān)管措施及其對(duì)行業(yè)自律水平的調(diào)整辦法進(jìn)行了歸納。 第七章立足于從不同國家P2P網(wǎng)絡(luò)借貸市場(chǎng)監(jiān)管措施的對(duì)比分析中找出P2P網(wǎng)絡(luò)借貸市場(chǎng)的監(jiān)管要素。該部分結(jié)合前文的研究結(jié)論,比較了美國、英國和法國P2P網(wǎng)絡(luò)借貸市場(chǎng)的監(jiān)管現(xiàn)狀,提煉出對(duì)我國P2P網(wǎng)絡(luò)借貸市場(chǎng)的監(jiān)管啟示。 第八章對(duì)本文的主要結(jié)論、理論貢獻(xiàn)及實(shí)踐價(jià)值進(jìn)行了總結(jié),提出了當(dāng)前研究存在的不足和未來研究的方向。 本文結(jié)合P2P網(wǎng)絡(luò)借貸市場(chǎng)發(fā)展現(xiàn)狀和特征,力圖通過較為嚴(yán)密的演繹分析,采用理論與實(shí)際相結(jié)合、靜態(tài)與動(dòng)態(tài)分析相結(jié)合、對(duì)比分析與借鑒相結(jié)合的研究方法,對(duì)制定有利于提高我國P2P網(wǎng)絡(luò)借貸市場(chǎng)行業(yè)自律水平、建立行業(yè)自律機(jī)制的政府監(jiān)管措施提供理論依據(jù)和對(duì)策建議?v觀全文,本研究主要的創(chuàng)新和貢獻(xiàn)包括以下幾個(gè)方面: 第一,本文結(jié)合P2P網(wǎng)絡(luò)借貸市場(chǎng)的特征,推導(dǎo)出P2P網(wǎng)絡(luò)借貸平臺(tái)自律選擇與政府監(jiān)管者的監(jiān)管策略選擇的相互影響及其影響因素,包括聲譽(yù)收益、監(jiān)管成本、自律成本等。對(duì)于處在行業(yè)自律機(jī)制建設(shè)過程中的P2P網(wǎng)絡(luò)借貸市場(chǎng)的監(jiān)管及監(jiān)管措施的制定提供了借鑒。 第二,圍繞P2P網(wǎng)絡(luò)借貸平臺(tái)自律選擇與政府監(jiān)管者的監(jiān)管策略選擇的相互影響及其影響因素這個(gè)核心問題,從不同維度,系統(tǒng)地對(duì)不同P2P網(wǎng)絡(luò)借貸平臺(tái)自律選擇及內(nèi)在相互影響分別進(jìn)行了靜態(tài)與動(dòng)態(tài)分析。具體表現(xiàn)在以下三個(gè)方面: 首先,本文從P2P平臺(tái)個(gè)體差異的角度,將其分為自律平臺(tái)和機(jī)會(huì)主義平臺(tái),并針對(duì)不同的平臺(tái)類型,對(duì)不同的自律行為選擇影響因素分別進(jìn)行了討論,并總結(jié)出在不同自律水平下,政府監(jiān)管者的策略選擇對(duì)不同類型P2P平臺(tái)自律行為選擇的影響。同時(shí),本文更為清晰地分析了政府監(jiān)管者不同的懲罰措施對(duì)不同類型P2P平臺(tái)自律行為選擇產(chǎn)生影響的本質(zhì)原因,為政府監(jiān)管者了解和調(diào)整政府監(jiān)管策略以維護(hù)行業(yè)自律的良好秩序、建立有效的自律行為約束機(jī)制提供了理論依據(jù)。 其次,在時(shí)間維度上,不同發(fā)展階段的差異也可能使P2P平臺(tái)在自律行為的選擇上產(chǎn)生差異。因此,本文創(chuàng)新性地將P2P平臺(tái)的自律選擇進(jìn)行了進(jìn)一步地演化分析,將P2P平臺(tái)分為在位P2P平臺(tái)和新進(jìn)入P2P平臺(tái)分別進(jìn)行分析。不同類別P2P平臺(tái)自律行為的選擇比例實(shí)際上也直接反映了P2P網(wǎng)絡(luò)借貸市場(chǎng)的行業(yè)自律水平。在此基礎(chǔ)上,本文不僅對(duì)在位P2P平臺(tái)和新進(jìn)入P2P平臺(tái)自律行為選擇的相互影響進(jìn)行了分析,而且根據(jù)影響行為選擇的參數(shù)之間關(guān)系的變化,對(duì)不同類別P2P平臺(tái)自律行為選擇比例之間的演化關(guān)系進(jìn)行了分析。這些分析反映了隨著P2P平臺(tái)之間的不斷學(xué)習(xí)和模仿,P2P網(wǎng)絡(luò)借貸市場(chǎng)自律水平在不同情況下的演化過程。這種演化分析不僅是對(duì)市場(chǎng)主體自律行為選擇理論研究的一種補(bǔ)充,同時(shí)也為政府監(jiān)管者在不同市場(chǎng)環(huán)境下對(duì)P2P網(wǎng)絡(luò)借貸市場(chǎng)行業(yè)自律水平進(jìn)行調(diào)節(jié),以形成有效的自律機(jī)制提供了參考。 最后,從參數(shù)關(guān)系變化的角度,本文詳細(xì)分析了不同情況下新進(jìn)入P2P平臺(tái)的自律行為選擇與政府監(jiān)管者的監(jiān)管策略選擇之間的相互影響。事實(shí)上,不同的參數(shù)關(guān)系也就意味著不同的聲譽(yù)評(píng)級(jí)、管理成本和監(jiān)管成本。那么當(dāng)某種因素對(duì)新進(jìn)入P2P平臺(tái)的自律選擇產(chǎn)生影響時(shí),政府監(jiān)管者可以根據(jù)本文的分析結(jié)果采取相應(yīng)的約束措施,調(diào)整新進(jìn)入P2P平臺(tái)群體的自律水平,從而達(dá)到維護(hù)和監(jiān)督P2P網(wǎng)絡(luò)借貸市場(chǎng)行業(yè)自律水平的目的。同時(shí)演化分析的框架,對(duì)于其他行業(yè)自律行為選擇與政府監(jiān)管可以提供一定的參考,較以往的文獻(xiàn)研究更具有理論和現(xiàn)實(shí)意義。 總體來看,這部分內(nèi)容對(duì)P2P網(wǎng)絡(luò)借貸平臺(tái)的內(nèi)在差異、發(fā)展階段差異下的自律行為選擇進(jìn)行了靜態(tài)和動(dòng)態(tài)的推演分析,系統(tǒng)地解析了P2P網(wǎng)絡(luò)借貸平臺(tái)自律行為選擇與政府監(jiān)管者策略選擇在動(dòng)態(tài)演進(jìn)中的相互影響,這些創(chuàng)新構(gòu)成了本研究的重要特色所在。 第三,本文結(jié)合理論研究結(jié)論和國外P2P網(wǎng)絡(luò)借貸市場(chǎng)監(jiān)管現(xiàn)狀,歸納出了P2P網(wǎng)絡(luò)監(jiān)管的要素和啟示,并對(duì)我國以行業(yè)自律為主的P2P網(wǎng)絡(luò)借貸市場(chǎng)的監(jiān)管措施提出了建議。 限于P2P網(wǎng)絡(luò)借貸市場(chǎng)監(jiān)管數(shù)據(jù)獲取的限制,本研究在理論假設(shè)和實(shí)證檢驗(yàn)方面還存在不足。同時(shí)由于P2P網(wǎng)絡(luò)借貸市場(chǎng)與互聯(lián)網(wǎng)金融市場(chǎng)、實(shí)體經(jīng)濟(jì)發(fā)展以及銀行體系的發(fā)展都有密切的關(guān)系,面向行業(yè)自律機(jī)制的監(jiān)管措施如何與上述外部發(fā)展環(huán)境相適應(yīng),這也是未來進(jìn)行進(jìn)一步研究的方向。 [Abstract]:In the development of information technology and support, in order to meet the needs of borrowers borrowing needs and small investors investment demand, a network of information technology based on P2P (peer-to-peer) network lending market emerged. The market not only for both lenders and borrowers to provide a more efficient and convenient channels, is also an important supplement to the the traditional lending market.
Since 2005 the world's first in the P2P network lending platform, P2P lending market have appeared in a number of countries and has been the rapid development of.P2P lending market in Chinese in 2007, nearly two years in the financial development of the Internet driven, P2P network through the development and innovation of the credit markets are very rapidly. According to the literature research shows that in the view of the feature of P2P lending market, flexible and forward-looking supervision way for scholars are respected, industry self-discipline supervision is advocated by most scholars. But after all, self-discipline is a direct reflection by the P2P network lending platform behavior, and in the P2P lending market. Little research self-discipline behavior choice and constraints on the P2P network lending platform. Although in other industries some participants of self-discipline of literature, but because the P2P network lending market is not unified, standardized self-discipline mechanism, so the reference is limited. The main body of this paper has three parts: the first part mainly includes the second chapter and the third chapter, the research framework; the second part is the analysis of problems of the theory, including fourth, fifth, six chapters; the third part is the comparative analysis of research and reference, mainly embodied in the seventh chapter.
The first chapter is the introduction of this paper. It mainly introduces the background and significance of the topic selection. Then, combined with the actual situation, it puts forward the purpose and research method of this paper. Finally, based on the purpose of the study, the research framework and main research contents are given.
The second chapter is the review of regulatory theory and P2P network lending market research. The definition of related concepts of financial supervision, the relationship between industry self-regulation and government supervision. Then from the three aspects of market development characteristics, behavior characteristics of both lending and P2P lending market risk and supervision of overview of the current domestic and foreign P2P lending market research situation, points out the characteristics and the scope of the current study.
The third chapter analyzes the P2P network lending market development and supervision of the status quo. From the market development model, summarizes the development status of the market characteristics of P2P lending market, and then from the system level, platform level, debit layer face the risk P2P lending market is analyzed, at the same time the regulatory status of network lending the market of P2P in China and the challenges are discussed.
The fourth chapter is the part of theoretical research, selection of P2P network lending platform self-discipline behavior are analyzed, the influencing factors of P2P network lending platform self-discipline behavior choice, and discussed in different regulators supervision strategy, change of P2P network lending platform self-discipline behavior choice.
Based on the research on the fourth chapter, the fifth chapter further analyzes the classification of main factors that affect the production of P2P network lending platform self-discipline behavior choice. Firstly, according to the inherent differences between the P2P network lending platform, the P2P network lending platform is divided into self platform and opportunity "platform, analysis of the impact factors on the different choice of self-discipline the platform, the mutual influence between the self-discipline behavior choice and two platform. The eighth chapter summarizes the main conclusions, theoretical contribution and practical value of this paper, and puts forward the shortcomings of the current research and the direction of future research.
In combination with the present situation and features of the development of P2P network lending market, through rigorous deductive analysis, combination of theory and practice, the combination of static and dynamic analysis, comparative analysis of a combination of research methods and reference, to make China's P2P network lending market self-discipline level, and provide a theoretical basis and countermeasures suggestions and measures of government supervision of the establishment of industry self-regulation mechanisms. As a whole, the innovation and contribution of this research mainly includes the following aspects:
First, combining with the characteristics of the P2P network lending market, mutual influence the choice of derived P2P network lending platform self choice and government supervision strategy and its influencing factors, including reputation gains, regulatory costs, cost and so on. For the development of self-discipline supervision and regulation measures of P2P lending market in the industry self-discipline mechanism in the process of the construction of the to provide a reference.
Second, the core problem of the mutual influence on P2P network lending platform self choice and government supervision strategy and its influencing factors, from different dimensions, system self selection and internal interaction of different P2P network lending platform were carried out static and dynamic analysis. The specific performance in the following three aspects:
First of all, this article from the perspective of individual differences in P2P platform, which can be divided into self-discipline platform and opportunism platform, and for different types of platforms, self-discipline of different factors are discussed and summed up in different level of self-discipline, government regulators strategy influence the choice of different types of P2P platform of self-discipline at the same time, this paper clearly analyzes the government regulators different punishment essential reasons influencing the selection of different types of P2P platform of self-discipline and good order for government regulators to understand and adjust the government supervision of Guan Celve in order to maintain the industry self-discipline, self-discipline to establish effective restraint mechanism to provide a theoretical basis.
Secondly, in the dimension of time, different stages of development may also make a difference in the P2P platform self-discipline behavior selection. Therefore, this paper innovatively self-discipline choose P2P platform for the further evolution analysis, the P2P platform is divided into the reign of the P2P platform and the new platform to enter the P2P were analyzed. The proportion of choice different types of P2P platform self-discipline behavior actually reflects directly the P2P lending market self-discipline level. On this basis, this paper not only analyzes in the P2P platform and P2P platform to enter the new discipline behavior choice affect each other, and according to the relationship between parameters influence behavior selection, the evolutionary relationship between different categories of the P2P platform of self-discipline ratio are analyzed. The analysis shows as the P2P platform between the continuous learning and imitation, P2P lending market discipline The evolution of the level in different situations. This is not only the evolution of a supplementary study of the theory of market discipline, but also for the government regulators self-discipline level to P2P lending market in different market conditions to adjust, to form an effective self regulatory mechanism to provide reference.
Finally, from the relationship between the change of parameters, this paper analyzes the mutual influence between the choice of regulatory strategies under different conditions in the choice of P2P platform and the new government self-discipline regulators. In fact, the relationship between different parameters also means different reputation rating, management cost and supervision cost. So when some factors the influence of the new P2P platform into self-discipline, government regulators can take corresponding measures according to the constraints of the analysis results of this paper, a new adjustment into the P2P platform group self-discipline level, so as to achieve the maintenance and supervision of P2P lending market self-discipline level. At the same time evolution analysis framework for other industry self-regulation and government behavior selection regulators can provide a reference, compared with the previous literature is more theoretical and practical significance.
As a whole, this part makes a static and dynamic deduction of the inherent differences of P2P network lending platform and self-discipline behavior choice under different development stages, and systematically analyzes the P2P network lending platform's self-discipline behavior choice and government regulators' policy.
