【摘要】：社會(huì)養(yǎng)老保險(xiǎn)基金個(gè)人賬戶基金作為社會(huì)養(yǎng)老保險(xiǎn)基金中重要的組成部分，，是支撐社會(huì)養(yǎng)老保險(xiǎn)制度的經(jīng)濟(jì)資源，也是社會(huì)養(yǎng)老保險(xiǎn)制度得以穩(wěn)步運(yùn)行的物質(zhì)基礎(chǔ)，其能否安全運(yùn)行關(guān)系到我國(guó)社會(huì)保障事業(yè)的成功，也關(guān)系到國(guó)家穩(wěn)定和經(jīng)濟(jì)安全。2012年4月份人力資源和社會(huì)保障部表示人社部將會(huì)同有關(guān)部門繼續(xù)對(duì)養(yǎng)老保險(xiǎn)基金的投資運(yùn)營(yíng)模式、管理機(jī)制、政策措施等進(jìn)行深入研究，抓緊制定基本養(yǎng)老保險(xiǎn)基金投資管理辦法，促進(jìn)基金保值增值，維護(hù)廣大參保人的切身權(quán)益。這無(wú)疑是養(yǎng)老保險(xiǎn)基金投資多元化的一個(gè)信號(hào)。個(gè)人賬戶作為社會(huì)養(yǎng)老保險(xiǎn)基金中最具有活力和靈活性的基金，其投資運(yùn)營(yíng)與監(jiān)管相關(guān)法律問(wèn)題亟待規(guī)范。從個(gè)人賬戶基金的性質(zhì)、特點(diǎn)入手，分析適應(yīng)個(gè)人賬戶基金性質(zhì)與特點(diǎn)的投資運(yùn)營(yíng)模式及相應(yīng)的法律監(jiān)管制度。反觀我國(guó)個(gè)人賬戶基金監(jiān)管立法滯后、監(jiān)管分散化，管理機(jī)構(gòu)獨(dú)立性不強(qiáng)和行政監(jiān)管職能不清的現(xiàn)實(shí)，并考慮到金融體系系統(tǒng)性風(fēng)險(xiǎn)、信息不對(duì)稱帶來(lái)的風(fēng)險(xiǎn)和道德風(fēng)險(xiǎn)等嚴(yán)峻挑戰(zhàn)，明確了各主體的權(quán)利義務(wù)；同時(shí)考慮到我國(guó)現(xiàn)實(shí)的金融環(huán)境，監(jiān)管模式在現(xiàn)階段應(yīng)選擇嚴(yán)格限量監(jiān)管，并從投資運(yùn)營(yíng)模式的選擇上以及融資機(jī)構(gòu)的準(zhǔn)入條件上具體對(duì)個(gè)人賬戶基金的投資運(yùn)營(yíng)進(jìn)行監(jiān)管限制，最后從完善法規(guī)的方面對(duì)個(gè)人賬戶基金的投資運(yùn)營(yíng)監(jiān)管進(jìn)行法律體系方面的完善。
[Abstract]:As an important part of the social pension insurance fund, the personal account fund of the social pension insurance fund is the economic resource to support the social endowment insurance system, and it is also the material foundation for the steady operation of the social pension insurance system. Its safe operation is related to the success of social security in our country. It is also related to national stability and economic security. In April 2012, the Ministry of Human Resources and Social Security said that the Ministry of Human Resources and Social Security, together with relevant departments, would continue to conduct in-depth studies on the investment and operation mode, management mechanism, policy and measures of pension insurance funds. We should formulate measures for the investment management of basic pension insurance funds, promote the maintenance and increase of the value of funds, and safeguard the immediate rights and interests of the broad masses of insured persons. This is undoubtedly a signal that endowment insurance fund investment diversification. As the most dynamic and flexible fund in the social pension insurance fund, the personal account needs to be regulated urgently. Starting with the nature and characteristics of the personal account fund, this paper analyzes the investment operation mode and the corresponding legal supervision system adapted to the nature and characteristics of the individual account fund. On the contrary, the legislation of personal account fund in our country is lagging behind, the supervision is decentralized, the independence of management organization is not strong and the function of administrative supervision is not clear, and considering the systemic risk of financial system, The severe challenges of information asymmetry, such as risk and moral hazard, make clear the rights and obligations of each subject; At the same time, considering the real financial environment in our country, the regulatory model should be strictly limited at this stage. And from the choice of the investment operation mode and the access conditions of the financing institution, the supervision and restriction of the investment and operation of the personal account fund are carried out. In the end, we perfect the legal system of the investment and operation supervision of personal account fund from the aspect of perfecting the regulations.
