我國(guó)強(qiáng)制性環(huán)境污染責(zé)任保險(xiǎn)發(fā)展研究

【摘要】:隨著當(dāng)前我國(guó)經(jīng)濟(jì)的快速增長(zhǎng),環(huán)境污染問(wèn)題也日益成為人們關(guān)注的焦點(diǎn)。環(huán)境污染具有潛伏時(shí)間長(zhǎng)、危害廣、損失大等特點(diǎn),而環(huán)境污染責(zé)任保險(xiǎn)作為一種穩(wěn)定、有效的環(huán)境污染風(fēng)險(xiǎn)分擔(dān)和補(bǔ)償機(jī)制,在減輕污染企業(yè)負(fù)擔(dān)、保護(hù)受害人利益、加強(qiáng)社會(huì)公共管理方面發(fā)揮著巨大的作用。但是,在我國(guó)推行環(huán)境污染責(zé)任保險(xiǎn)的過(guò)程中,,由于法律制度不完善、產(chǎn)品缺乏、保險(xiǎn)費(fèi)率及承保范圍不合理等原因的存在使得以自愿性環(huán)境污染責(zé)任保險(xiǎn)的推行模式屢屢受阻。實(shí)踐教訓(xùn)告訴我們:要想順利推行環(huán)境污染責(zé)任保險(xiǎn),必須選擇強(qiáng)制性的環(huán)境污染責(zé)任保險(xiǎn)模式。 黨的十八大報(bào)告強(qiáng)調(diào):“要把生態(tài)文明建設(shè)放在突出地位,融入經(jīng)濟(jì)建設(shè)、政治建設(shè)、文化建設(shè)、社會(huì)建設(shè)的各方面及全過(guò)程,努力建設(shè)美麗中國(guó),實(shí)現(xiàn)中華民族永續(xù)發(fā)展”。強(qiáng)制性環(huán)境污染責(zé)任保險(xiǎn)的推行是實(shí)現(xiàn)生態(tài)文明建設(shè)的重要舉措,是影響經(jīng)濟(jì)社會(huì)全面、協(xié)調(diào)、可持續(xù)發(fā)展的重要因素。因此,應(yīng)發(fā)揮其在推行“五位一體”建設(shè)、實(shí)現(xiàn)“中國(guó)夢(mèng)”中的積極作用。 本文的研究方法主要通過(guò)定性分析的方法,從理論聯(lián)系實(shí)際、比較分析及綜合分析的角度對(duì)強(qiáng)制性環(huán)境污染責(zé)任保險(xiǎn)進(jìn)行分析。全文共分為五個(gè)部分,第一部分主要通過(guò)對(duì)具體經(jīng)濟(jì)理論的闡述分析我國(guó)在環(huán)境污染責(zé)任保險(xiǎn)推行過(guò)程中采用強(qiáng)制性模式的理論依據(jù);第二部分主要從我國(guó)面臨的嚴(yán)峻環(huán)境污染問(wèn)題及其帶來(lái)的巨大挑戰(zhàn),及環(huán)境污染責(zé)任保險(xiǎn)推行的強(qiáng)制性優(yōu)勢(shì)分析我國(guó)實(shí)施強(qiáng)制性環(huán)境污染責(zé)任保險(xiǎn)的必要性;第三部分主要分析我國(guó)環(huán)境污染責(zé)任保險(xiǎn)的發(fā)展現(xiàn)狀及推行過(guò)程中出現(xiàn)的問(wèn)題;第四部分主要分析國(guó)外典型國(guó)家(美、德、法)及國(guó)內(nèi)強(qiáng)制性責(zé)任保險(xiǎn)---以交強(qiáng)險(xiǎn)為例實(shí)施環(huán)境污染責(zé)任保險(xiǎn)的情況及對(duì)我國(guó)實(shí)施強(qiáng)制性環(huán)境責(zé)任保險(xiǎn)的借鑒;第五部分提出加快我國(guó)強(qiáng)制性環(huán)境污染責(zé)任保險(xiǎn)發(fā)展的建議,這部分主要從外部支持與內(nèi)在動(dòng)力角度說(shuō)明加強(qiáng)實(shí)施強(qiáng)制性的保障及強(qiáng)制性推行阻力的減少,從而實(shí)現(xiàn)加快強(qiáng)制性環(huán)境污染責(zé)任保險(xiǎn)協(xié)調(diào)發(fā)展。
[Abstract]:With the rapid economic growth in China, environmental pollution has become the focus of attention. Environmental pollution has the characteristics of long latent time, wide harm and great loss. As a stable and effective mechanism for sharing and compensating environmental pollution risks, environmental pollution liability insurance can lighten the burden of polluting enterprises and protect the interests of the victims. Strengthening social public administration plays a great role. However, in the process of carrying out environmental pollution liability insurance in China, due to the imperfection of the legal system, there is a lack of products. The existence of unreasonable insurance rate and coverage makes the implementation mode of voluntary environmental pollution liability insurance often hindered. The practice lesson tells us: in order to carry out the environmental pollution liability insurance smoothly, we must choose the compulsory environmental pollution liability insurance mode. The report of the 18th CPC National Congress stressed: "We should put the construction of ecological civilization in a prominent position, integrate all aspects and processes of economic construction, political construction, cultural construction, and social construction, strive to build a beautiful China, and realize the sustainable development of the Chinese nation." The implementation of compulsory liability insurance for environmental pollution is an important measure to realize the construction of ecological civilization and an important factor affecting the comprehensive, coordinated and sustainable development of economy and society. Therefore, it should play an active role in the construction of "five-in-one" and the realization of "Chinese Dream". The research method of this paper mainly through the qualitative analysis method, from the theory unifies the practice, the comparison analysis and the synthesis analysis angle carries on the analysis to the compulsory environmental pollution liability insurance. The paper is divided into five parts. The first part mainly analyzes the theoretical basis of the compulsory mode in the implementation of environmental pollution liability insurance in China through the elaboration of specific economic theory. The second part mainly analyzes the necessity of implementing compulsory environmental pollution liability insurance in our country from the severe environmental pollution problem and the great challenge it brings, and the mandatory advantages of implementing the liability insurance for environmental pollution. The third part mainly analyzes the development status and problems in the process of implementing the liability insurance for environmental pollution in China, the fourth part mainly analyzes the typical foreign countries (America, Germany, Germany, Germany, Germany, Germany). Law) and domestic compulsory liability insurance-take traffic insurance as an example to carry out environmental pollution liability insurance and draw lessons from the implementation of compulsory environmental liability insurance in China; The fifth part puts forward the suggestion of speeding up the development of compulsory environmental pollution liability insurance in China. This part mainly explains from the angle of external support and internal motive force to strengthen the enforcement of compulsory protection and reduce the resistance of mandatory implementation.
