【摘要】：國(guó)際貨款支付是國(guó)際貿(mào)易過(guò)程的重要環(huán)節(jié),信用證是國(guó)際貿(mào)易中重要的結(jié)算方式之一。遠(yuǎn)期信用證因其具有融資的特性受到進(jìn)口商的青睞而較多地使用于進(jìn)口貿(mào)易。但遠(yuǎn)期信用證結(jié)算在給進(jìn)口商帶來(lái)融資便利的同時(shí),由于各方當(dāng)事人的復(fù)雜關(guān)系和操作的特定流程和特點(diǎn)也給出口商和開證行帶來(lái)了一定風(fēng)險(xiǎn)。因此,遠(yuǎn)期信用證結(jié)算風(fēng)險(xiǎn)的防范成為相關(guān)當(dāng)事人必須面臨的課題。本文在借鑒前人研究成果的基礎(chǔ)上,首先對(duì)四種遠(yuǎn)期信用證以及對(duì)進(jìn)出口商和銀行的利弊進(jìn)行了詳細(xì)的闡述,并對(duì)其比較分析和總結(jié)。其次,對(duì)遠(yuǎn)期信用證的風(fēng)險(xiǎn)進(jìn)行了詳細(xì)的分析。最后,根據(jù)中國(guó)最新的貿(mào)易政策,以實(shí)際操作為前提,從銀行以及進(jìn)出口商等不同當(dāng)事人的角度結(jié)合實(shí)際案例分析,用理論與實(shí)際相結(jié)合的方法進(jìn)行深入分析研究,提出減少風(fēng)險(xiǎn)的防范措施,以期增強(qiáng)信用證各方當(dāng)事人在使用遠(yuǎn)期信用證結(jié)算時(shí)對(duì)風(fēng)險(xiǎn)的防范,確保交易安全,保證國(guó)際貿(mào)易的順利進(jìn)行有所裨益。
[Abstract]:International payment is an important part of international trade, and letter of credit is one of the important settlement methods in international trade.The Usance L / C is used in import trade because of its characteristics of financing.However, the settlement of forward letters of credit not only brings financing convenience to the importer, but also brings some risks to the exporter and issuing bank because of the complicated relationship between the parties and the specific process and characteristics of operation.Therefore, the prevention of the settlement risk of forward letter of credit has become a subject that the parties concerned must face.Based on the previous research results, this paper first elaborates the advantages and disadvantages of four kinds of time letters of credit, and the advantages and disadvantages of importers and exporters and banks, and makes a comparative analysis and summary of them.Secondly, the risk of Usance L / C is analyzed in detail.Finally, according to China's latest trade policy and taking the actual operation as the premise, combining with the actual case analysis from the perspective of different parties such as banks, importers and exporters, this paper makes an in-depth analysis and study with the method of combining theory with practice.This paper puts forward the preventive measures to reduce the risk in order to enhance the risk prevention of the parties to the letter of credit when using the forward letter of credit, to ensure the transaction security and to ensure the smooth progress of the international trade.
