【摘要】:地理標志是一種產(chǎn)地標志,也是質(zhì)量的保證,更是一種重要的知識產(chǎn)權(quán)。世界各國都普遍認識到地理標志與商標一樣,對經(jīng)濟發(fā)展有著越來越重要的推動作用。目前,地理標志的保護也是世界的知識產(chǎn)權(quán)保護的熱點之一。隨著社會生活資料的豐富以及消費市場的蓬勃發(fā)展,消費者面對日益多樣化的消費產(chǎn)品,開始更加注重產(chǎn)品的質(zhì)量、特色。正是這種對質(zhì)量和特色的要求,催生出對產(chǎn)品產(chǎn)地確認的需要。地理標志的有效保護,不僅可以滿足消費者的需要,同時更能使生產(chǎn)者的利益得到保障。 大同縣以“中國黃花之鄉(xiāng)”譽滿天下,同時大同縣黃花菜也是大同市的首個地理標志商標。黃花菜近些年銷量雖然一直增加,但是卻很難像祁東黃花菜一樣,充分利用“地理標志”的金字招牌,開拓全國市場,也一直沒有跳出銷售渠道單一,加工滯后,宣傳乏力的制約。本文選題的目的就在于通過調(diào)查黃花菜地理標志的使用情況,找出問題所在并最終找到解決的方法,讓“大同黃花菜”的品牌價值得到充分展現(xiàn)。 本文主要包括以下四部分:第一部分介紹地理標志保護概述。簡述地理標志保護的重要性、世界地理標志保護的大趨勢以及我國對于地理標志保護的相關(guān)規(guī)定;第二部分是大同縣黃花菜地理標志保護現(xiàn)狀的調(diào)查步驟和內(nèi)容,包括調(diào)查時間,調(diào)查范圍,調(diào)查對象,調(diào)查的基本方法和調(diào)查的內(nèi)容;第三部分介紹大同縣黃花菜地理標志產(chǎn)品保護的調(diào)查結(jié)果。闡述大同縣黃花菜地理標志產(chǎn)品的基本情況,黃花菜生產(chǎn)企業(yè)自身的保護措施以及政府對于黃花菜的保護,并從以上幾個方面進行調(diào)查總結(jié)。最后一部分是大同黃花菜地理標志保護現(xiàn)狀的問題和對策。通過對企業(yè)和政府兩個環(huán)節(jié)的保護情況來指出存在的問題,并提出相應(yīng)的建議和對策。
[Abstract]:Geographical indication is not only a symbol of origin, but also a guarantee of quality. It is also an important intellectual property right. Countries all over the world generally recognize that geographical indications, like trademarks, play an increasingly important role in promoting economic development. At present, the protection of geographical indications is also one of the hot spots of intellectual property protection in the world. With the enrichment of social means of living and the vigorous development of consumer market, consumers begin to pay more attention to the quality and characteristics of products in the face of increasingly diversified consumer products. It is this quality and characteristics of the requirements, the birth of the product origin recognition needs. The effective protection of geographical indications can not only meet the needs of consumers, but also protect the interests of producers. Datong County is well-known as "the hometown of Chinese Yellow Flowers" and Datong County is the first geographical mark of Datong. Although the sales volume of yellow lily has been increasing in recent years, it is very difficult to make full use of the gold-lettered signboard of "geographical indications" and to open up the national market, just like the yellow lily in Qidong. It has not jumped out of the single sales channel and has lagged behind in processing. Lacklustre publicity. The purpose of this paper is to find out the problem and finally find out the solution by investigating the use of the geographical indications of yellow lily, so that the brand value of "Datong lily" can be fully displayed. This paper mainly includes the following four parts: the first part introduces the overview of geographical indication protection. The importance of the protection of geographical indications, the general trend of the protection of the world's geographical indications and the relevant provisions for the protection of geographical indications in China are briefly described. The second part is the investigation steps and contents of the present situation of the protection of the geographical indications of the yellow lily in Datong County. It includes the time, scope, object, basic method and content of investigation. The third part introduces the results of the investigation on the protection of the geographical indications of yellow lily in Datong County. This paper expounds the basic situation of the geographical indication products of the yellow lily in Datong County, the protective measures of the enterprises producing the yellow lily and the protection of the government for the yellow lily, and carries on the investigation and summary from the above several aspects. The last part is the problems and countermeasures of protecting the geographical indications of Datong yellow lily. The existing problems are pointed out through the protection of enterprises and government, and the corresponding suggestions and countermeasures are put forward.
