孤兒作品合理使用法律問題研究

【摘要】:孤兒作品并不是一個(gè)法律概念,僅僅是對(duì)ORPHAN WORKS字面翻譯所得。早期我國學(xué)者使用"無主作品"指代這種難以找到權(quán)利人,難以行使著作權(quán)的作品。本文為求統(tǒng)一,一致以孤兒作品進(jìn)行闡述。"互聯(lián)網(wǎng)+"使得孤兒作品不僅僅以書本的方式呈現(xiàn),更多的是利用技術(shù)優(yōu)勢(shì)以一種數(shù)據(jù)存儲(chǔ)的方式擺脫束之高閣的命運(yùn)。文化軟實(shí)力的競(jìng)爭(zhēng)也使各國更注重孤兒作品的價(jià)值彰顯,如何避免資源漏洞完成文化傳承卻又不侵犯相關(guān)人的權(quán)利已成為各國不可回避的難題。本文內(nèi)容上從五個(gè)部分研究孤兒作品合理使用法律問題。第一章是緒論,從Google侵權(quán)案引出孤兒作品,然后簡(jiǎn)要介紹國內(nèi)外學(xué)者對(duì)于孤兒作品問題的研究現(xiàn)狀,并且指出本文的研究范圍與研究方法。第二章是孤兒作品概述,因?yàn)槲覈淮嬖?孤兒作品"這一法律術(shù)語,便先是提出其他國家孤兒作品的概念作為參考。然后是對(duì)孤兒作品使用過程中的核心問題進(jìn)行概括。最后從我國《著作權(quán)法》、著作權(quán)相關(guān)條例以及《著作權(quán)修訂草案送審稿》中關(guān)于孤兒作品法律的規(guī)定來展示我國孤兒作品的法律現(xiàn)狀。第三章是借鑒國外知識(shí)產(chǎn)權(quán)規(guī)定較發(fā)達(dá)的國家的實(shí)踐經(jīng)驗(yàn)。包括美國、歐盟、加拿大、日本等國對(duì)孤兒作品的保護(hù)模式,對(duì)其適合我國國情的包括指定專門主體管理、例外限制圖書館、增設(shè)補(bǔ)償增減之訴,以及糾紛解決時(shí)ADR、ODR模式加以重點(diǎn)分析,引以為鑒。第四章是針對(duì)我國孤兒作品的法律現(xiàn)狀,結(jié)合別國成功實(shí)踐得出的完善建議。包括從建立"淘寶"式集體管理、完善公益合理使用、細(xì)化付酬式補(bǔ)償機(jī)制、建立多元的糾紛解決機(jī)制等多角度對(duì)我國孤兒作品的法律規(guī)定進(jìn)行完善。第五章是對(duì)全篇文章的歸納總結(jié)。對(duì)本文的重點(diǎn)再次重申以加深印象。
[Abstract]:Orphan works are not a legal concept, but a literal translation of ORPHAN WORKS. In the early years, Chinese scholars referred to the works which were difficult to find the owner and to exercise the copyright. For the sake of unity, this article is expounded by orphans' works. " The Internet "makes orphan works not only appear in the form of books, but also use the advantage of technology to get rid of the fate of shelving in a way of data storage." The competition of cultural soft power also makes countries pay more attention to the value of orphaned works. How to avoid resource loopholes to complete cultural heritage without infringing the rights of related people has become an unavoidable problem. The content of this paper from five parts of the Orphan works reasonable use of legal issues. The first chapter is the introduction, which draws the orphan works from the case of Google infringement, then briefly introduces the domestic and foreign scholars' research status of orphans' works, and points out the scope and research methods of this paper. The second chapter is an overview of orphans' works, because there is no legal term "orphan works" in China, we first put forward the concept of orphans' works in other countries as a reference. Then it generalizes the core problems in the process of using orphan works. Finally, the present legal situation of orphan works in China is demonstrated from the provisions of the copyright Law, the relevant regulations of copyright and the revised draft of copyright submitted for review. The third chapter is to draw lessons from the practical experience of foreign countries with more developed intellectual property provisions. Including the American, European Union, Canada, Japan and other countries to the protection model of orphan works, including the designated special subject management, the exception of the library, the addition of compensation increase or decrease to the national conditions of our country. And the ADRN ODR model of dispute resolution to focus on analysis, learn from. The fourth chapter is based on the legal situation of orphans in China, combined with the successful practice of other countries to improve the recommendations. Including the establishment of "Taobao" type of collective management, improve the rational use of public goods, fine pay compensation mechanism, the establishment of multiple dispute resolution mechanism and other aspects to improve the legal provisions of orphan works in China. The fifth chapter is the summary of the whole article. The emphasis of this article is reiterated again to deepen the impression.
