【摘要】：網(wǎng)絡(luò)環(huán)境下,公民隱私、個人信息被侵害的情況愈演愈烈,各國在通過傳統(tǒng)隱私權(quán)的擴張解釋等方式對隱私權(quán)進行保護的同時,紛紛轉(zhuǎn)向建立新的制度對個人信息的特別保護。我國法律也走過了從隱私、隱私權(quán)到個人信息的制度發(fā)展,法律呈現(xiàn)出以個人信息保護為主、隱私權(quán)保護為輔的趨勢�！毒W(wǎng)絡(luò)安全法》的出臺一定程度上完善了個人信息保護法律制度。但是個人信息法律保護還存在法律地位不明確、歸責(zé)原則和構(gòu)成要件缺乏規(guī)定、損失如何計算等具體問題,這些都需要進一步完善。
[Abstract]:Under the network environment, the situation of citizen privacy and personal information being infringed is becoming more and more serious. Countries protect the right of privacy through the expansion and interpretation of the traditional privacy right at the same time. One after another, we turned to the establishment of a new system for the special protection of personal information. Our laws have also gone through the institutional development from privacy, privacy to personal information. The introduction of the Network Security Law has improved the legal system of personal information protection to a certain extent. However, the legal protection of personal information still has unclear legal status, and the principle of imputation and the constitutive elements are not provided for. How to calculate the loss and other specific problems, these need to be further improved.
