【摘要】：哈貝馬斯的交往理性理論為研究我國國有企業(yè)家職務犯罪的防治提供了嶄新的思路。國有企業(yè)家職務犯罪難以根除,只能控制在可容忍的范圍內,在確立這一理念的基礎上,構建理性交往平臺,通過自我反思和平等商談對話的方式尋求防治國有企業(yè)家職務犯罪的前提條件和制度導向,最后通過全民參與、對權力重新合理設置及加強權力運行的監(jiān)控等具體措施來防治國有企業(yè)家職務犯罪。
[Abstract]:Habermas' theory of communication rationality provides a new way to study the prevention and cure of state-owned entrepreneur's duty crime. It is difficult for state-owned entrepreneurs to eradicate job-related crimes, so they can only be controlled within the scope of tolerance, and on the basis of the establishment of this concept, a rational communication platform can be constructed. Through self-reflection and dialogue on an equal footing to seek preconditions and institutional guidance for the prevention and control of job-related crimes of state-owned entrepreneurs, and finally through the participation of the whole people, To prevent and cure the state-owned entrepreneur's duty crime, we should re-set the power reasonably and strengthen the supervision of the power operation.
