【摘要】： 結(jié)果加重犯在國內(nèi)外有著眾多的立法例,學(xué)界對(duì)其有無未遂問題爭議很大。這些爭議主要源自對(duì)結(jié)果加重犯內(nèi)部結(jié)構(gòu)的不同認(rèn)識(shí),特別是對(duì)其基本犯與加重結(jié)果的罪過形式的不同理解。筆者認(rèn)為,從普遍的視角來看,判斷一個(gè)或一類犯罪是否具有未遂形態(tài),應(yīng)從該犯罪的自身結(jié)構(gòu)出發(fā),結(jié)合犯罪未遂的相關(guān)理論,看其是否具備犯罪未遂所要求的條件,具備則說明其存在未遂形態(tài),反之則不存在。同理,分析結(jié)果加重犯有無未遂形態(tài),也應(yīng)該從其自身結(jié)構(gòu)出發(fā),看其結(jié)構(gòu)框架下是否存在犯罪未遂所要求的條件�；诖�,筆者不揣淺薄,試從結(jié)果加重犯及犯罪未遂理論著手,并借鑒學(xué)者們的觀點(diǎn),對(duì)結(jié)果加重犯未遂問題進(jìn)行探討,拋磚引玉,認(rèn)為結(jié)果加重犯可以存在未遂,其未遂的成立條件包括三個(gè):一是基本犯為復(fù)行為犯;二是行為人對(duì)加重結(jié)果具有直接故意;三是加重結(jié)果因行為人意志以外的原因沒有出現(xiàn)。
[Abstract]:Results aggravated crime has many legislative cases at home and abroad, and there is a great controversy in academic circles about whether it has attempted or not. These controversies mainly stem from the different understanding of internal structure of consequential aggravated offense, especially the different understanding of its basic offense and the guilty form of aggravated result. The author thinks, from the general angle of view, judging whether a crime or a kind of crime has attempted form, should proceed from the structure of the crime itself, combine the relevant theory of attempted crime, see whether it has the conditions required by attempted crime. Having it means that it exists in the form of attempt, otherwise it does not exist. In the same way, if the analysis results aggravate the pattern of unattempted crime, we should start from its own structure and see whether there are the conditions required for attempted crime under its frame. Based on this, the author tries to start with the theory of aggravated consequential crime and attempted crime, and draws lessons from scholars' views, discusses the problem of attempted consequential aggravated crime, and thinks that there can be attempt in aggravated consequential offense. There are three conditions for the establishment of the attempt: one is that the basic crime is a complex crime; the other is that the perpetrator has the direct intention to aggravate the result; the third is that the aggravating result has not appeared because of reasons other than the will of the actor.
