民國時期工會法律制度研究

【摘要】:我國工會法的產(chǎn)生在理論方面受三民主義以及西方馬克思工會理論、韋伯夫婦社會主義工會理論和伯爾曼多元工會理論的影響,對工會立法中的政治價值、經(jīng)濟價值和社會價值非常注重;在實踐方面受國際工會組織督促和西方國家立法的傳播的影響,加之我國自身工人運動發(fā)展的迫切需要,民國時期工會立法勢在必行。 民國時期我國工會立法歷程可分為三個階段:1912年至1924年,工會立法初成時期,此階段工會立法經(jīng)歷從無到有,1912年《暫行工會條例》第一次系統(tǒng)規(guī)定了工會的組織條件和審批程序,工會的職務和監(jiān)管,工會會員、職員、會費及工會財產(chǎn)的保護措施等,對工會的法律規(guī)制初步形成,1924修訂《工會條例》擴大了工會會員的范圍,擴大了工會的職責權利并提高會費并加強工會財產(chǎn)的保護。1925年至1942年工會立法的發(fā)展時期,這時期通過不斷發(fā)展,工會立法上升到國家法立法層面,1929年《工會法》的頒布標志著工會立法進入新的階段,該部工會法提高了工會的設立門檻,增加了對工會團體協(xié)約權和罷工權的限制,增加了工會、工會職員及會員的行為禁止條款,同時擴大了主管機關的權力。可見這一時期工會立法的重心已從賦予和保護工會權利向限制工會權利轉移。1943年至1949年,工會法進入嬗變時期,短短幾年頒布了三部《工會法》。這時期立法的嬗變反應當時南京國民政府對發(fā)展工會組織的迫切要求。此時工會立法更加成熟,工會法律規(guī)定更具體,并增加了總工會和聯(lián)合會的規(guī)定。同時,民國時期工會法在立法過程中呈現(xiàn)立法目的多樣性,立法超前性和波動性等特征。 民國時期工會法中最重要的內容莫過于對勞工結社權、團體協(xié)約權和罷工權的規(guī)定了,本文重點對民國時期工會法律規(guī)范中此三者權利的實踐進行研究。勞工結社權是工會組織和進行一切活動的基礎;團體協(xié)約權是工會維護工人權利的重要方式;罷工權則是保障工會各項權利得到尊重的重要手段。
[Abstract]:The emergence of trade union law in our country is influenced by the three people's principles, the Western Marxist trade union theory, the Weber's socialist trade union theory and Berman's multiple trade union theory, and the political value of the trade union legislation. Economic value and social value are very important; In practice, influenced by the supervision of international trade union organizations and the spread of legislation in western countries, in addition to the urgent needs of the development of China's own workers' movement, trade union legislation during the period of the Republic of China is imperative. During the period of the Republic of China, the process of trade union legislation in China can be divided into three stages: from 1912 to 1924, during the initial stage of trade union legislation, trade union legislation experiences from scratch to existence. In 1912, the Provisional Trade Union regulations for the first time set out the conditions for the organization and approval of trade unions, the duties and supervision of trade unions, members of trade unions, staff members, membership fees and measures for the protection of trade union property. Preliminary formation of the legal regulations on Trade unions the Trade Union regulations were amended in 1924 to expand the scope of trade union membership. The rights and duties of trade unions were expanded and membership fees were increased and the protection of trade union property was strengthened. The period of development of trade union legislation from 1925 to 1942 was a period of continuous development. Trade union legislation rose to the level of national law legislation. In 1929, the promulgation of the Trade Union Law marked a new stage of trade union legislation, and the Ministry Trade Union Law raised the threshold for the establishment of trade unions. Restrictions on the rights of trade union groups to treaty and to strike have been increased, and prohibitions on the conduct of trade unions, trade unionists and members have been added. At the same time, the power of the competent authorities has been expanded. It can be seen that the focus of trade union legislation in this period has shifted from giving and protecting trade union rights to restricting trade union rights. From 1943 to 1949, the Trade Union Law entered a period of evolution. In just a few years, three trade union laws were promulgated. The evolution of legislation in this period reflected the urgent need of the Nanjing National Government to develop trade union organizations. At that time, trade union legislation was more mature and trade union laws and regulations were more specific. At the same time, during the period of the Republic of China, the trade union law presented the characteristics of diversity of legislative purpose, legislative advance and fluctuation, and so on. The most important content of the trade union law in the Republic of China was the regulation of the right of labor association, the right of association and the right to strike. This paper focuses on the practice of these three rights in the legal norms of trade unions during the period of the Republic of China. The right of labor association is the basis for trade unions to organize and carry out all their activities; Group treaty right is an important way for trade unions to protect workers' rights. The right to strike is an important means to ensure that trade union rights are respected.
