【摘要】:同工同酬是勞動(dòng)法體系中的一項(xiàng)重要原則,我國(guó)現(xiàn)行法律規(guī)定,被派遣勞動(dòng)者享有與用工單位的勞動(dòng)者同工同酬的權(quán)利。勞務(wù)派遣中存在同工不同酬的問題不僅損害了被派遣勞動(dòng)者的合法權(quán)益,也不利于我國(guó)勞務(wù)派遣制度的健康發(fā)展。如果不盡快采取有效措施解決這一問題,必然會(huì)對(duì)構(gòu)建和諧穩(wěn)定的勞動(dòng)關(guān)系帶來負(fù)面影響。被派遣勞動(dòng)者迫于就業(yè)壓力等原因,在由用工單位、勞務(wù)派遣單位和被派遣勞動(dòng)者三方組合的勞動(dòng)關(guān)系中處于非常明顯的弱勢(shì)地位,本文結(jié)合勞務(wù)派遣中被派遣勞動(dòng)者同工同酬權(quán)利保護(hù)的特殊性,對(duì)保護(hù)被派遣勞動(dòng)者享有同工同酬權(quán)的理論基礎(chǔ)和法律依據(jù)進(jìn)行了梳理;從被派遣勞動(dòng)者的工資薪酬、保險(xiǎn)福利、休息休假、經(jīng)濟(jì)補(bǔ)償?shù)确矫娣治霰慌汕矂趧?dòng)者同工同酬權(quán)保護(hù)的不足及其危害和成因;從勞動(dòng)立法及司法、政府政策及行政監(jiān)管、工會(huì)建設(shè)、勞動(dòng)者自身等方面探究保護(hù)對(duì)策的完善:關(guān)鍵是提高司法精度有效落實(shí)法律規(guī)定的執(zhí)行,使勞務(wù)派遣用工只能在臨時(shí)性、輔助性、替代性的工作崗位上實(shí)施。地方政府應(yīng)當(dāng)加強(qiáng)對(duì)勞務(wù)派遣濫用的監(jiān)管,使勞務(wù)派遣用工回歸到勞動(dòng)合同用工的補(bǔ)充形式上來。創(chuàng)新工會(huì)組織的組建及入會(huì)形式,以適應(yīng)勞務(wù)派遣中被派遣勞動(dòng)者“雇”與“用”相分離的特點(diǎn),發(fā)揮工會(huì)組織對(duì)勞動(dòng)者的保護(hù)作用。被派遣勞動(dòng)者自身應(yīng)當(dāng)積極抱團(tuán)采取維權(quán)行動(dòng),維護(hù)同工同酬的合法權(quán)益。
[Abstract]:Equal pay is an important principle of labor law system, China's current law, the dispatched workers labor units and workers enjoy equal pay for equal work. There are unequal pay labor problems not only harm the interests of the dispatched workers, is not conducive to the healthy development of labor dispatch in China. If not as soon as possible to take effective measures to solve this problem, will bring the negative influence on the construction of harmonious and stable labor relations. The reason for the dispatched workers under the pressure of employment, in the labor units, in a very vulnerable position of labor dispatching units and dispatched workers combination of three parties in the labor relations, combining with the particularity of the workers for the protection of the rights of dispatched, in the theoretical and legal basis for the protection of the right to enjoy equal pay for the dispatched workers Out from the dispatched workers; salary, insurance and welfare, rest and vacation, analysis of the lack of dispatched workers equal pay for equal rights protection and its harm and causes of economic compensation and other aspects; from the labor legislation and judicial construction, government policy and administrative supervision, labor unions, etc. its inquiry protection measures: the key is perfect to improve the accuracy of the effective implementation of judicial law enforcement, the labor dispatch can only be temporary, auxiliary, the implementation of substitute jobs. The local government should strengthen the supervision of the abuse of labor dispatch, the labor dispatch return to the supplementary form of labor contract. The establishment and innovation of trade union organization membership form in order to adapt to the characteristics of the labor dispatch, the dispatched workers "hire" separation and "use", play a protective role of trade unions of workers dispatched laborers. The activist should actively take action to maintain the legitimate rights and interests of equal pay for equal work.
