【摘要】:目前,新生代農(nóng)民工已經(jīng)占了農(nóng)民工總數(shù)的60%以上,并且這個比例將逐年增長,他們的就業(yè)困境和生存困境必將對我國的社會穩(wěn)定帶來新的挑戰(zhàn)。正如全國總工會所言,“中國新生代農(nóng)民工的訴求和問題的積累已經(jīng)開始顯露出對我國政治社會穩(wěn)定、經(jīng)濟可持續(xù)發(fā)展、農(nóng)民工家庭幸福及其個人發(fā)展的負面影響,這就使有針對性地解決新生代農(nóng)民工問題成為國家發(fā)展中事關(guān)大局的緊迫問題! 為此本文選取了促進新生代農(nóng)民工就業(yè)的法律問題作為研究對象,試圖從分析新生代農(nóng)民工的特點和就業(yè)困境入手,從就業(yè)法制環(huán)境的建立和完善等方面提出對策和建議,以期促進新生代農(nóng)民工的就業(yè)。 論文主要以新生代農(nóng)民工就業(yè)情況、就業(yè)相關(guān)法律政策為依托,旨在研究我國當下采取的一系列促進新生代農(nóng)民工就業(yè)的措施及其問題,初步構(gòu)建保護新生代農(nóng)民工就業(yè)的法律制度。 論文第一章主要就論文緣起,國內(nèi)外研究現(xiàn)狀做一綜述,并就此研究的意義和研究的方法做一說明。 論文第二章主要闡述新生代農(nóng)民工概念的界定;分析新生代農(nóng)民工的就業(yè)特點,新生代農(nóng)民工對職業(yè)選擇已有明顯的行業(yè)傾向性,對勞動權(quán)益的訴求有較大提高。分析新生代農(nóng)民工在就業(yè)中碰到的問題,如勞動權(quán)益未得到充分保障等。 論文第三章主要分析我國《就業(yè)促進法》、《勞動合同法》等勞動領(lǐng)域立法對農(nóng)民工就業(yè)的積極意義。 論文第四章主要論述因新生代農(nóng)民工勞動權(quán)益未得到保障而導(dǎo)致的勞動關(guān)系不和諧,并進而引發(fā)社會穩(wěn)定問題。 論文第五章分析造成新生代農(nóng)民工就業(yè)問題的原因,主要分析制度上的原因。 論文第六章提出完善促進新生代農(nóng)民工就業(yè)法律環(huán)境的建議,重點是完善《就業(yè)促進法》和《勞動合同法》的有關(guān)規(guī)定。 論文第七章是本論文的總結(jié)部分,我國應(yīng)該以新的思路促進新生代農(nóng)民工就業(yè)。
[Abstract]:At present, the new generation of migrant workers has accounted for more than 60% of the total number of migrant workers, and this proportion will increase year by year, social stability will bring new challenges to Employment Predicament and their survival dilemma in our country. As the National Federation of trade unions said, "Chinese the new generation of migrant workers' aspirations and problems have begun to reveal the accumulation of China's political and social stability and sustainable development of economy, the negative impact of migrant workers family happiness and personal development, which makes the targeted to solve the problems of the new generation of migrant workers has become urgent problems related to the overall situation of national development"
The paper chooses the law to promote the new generation of migrant workers employment as the research object, trying to start from the characteristics and analysis of the new generation of migrant workers employment difficulties, puts forward the countermeasures and suggestions from employment to establish and perfect legal environment and other aspects, in order to promote the new generation of migrant workers employment.
Based on the employment situation and employment related laws and policies of the new generation of migrant workers, this paper aims to study a series of measures and problems to promote the employment of the new generation of migrant workers in China, and initially build a legal system to protect the employment of the new generation of migrant workers.
The first chapter of the thesis is a summary of the origin of the paper, the current research status at home and abroad, and the significance of this study and the method of research.
The second chapter mainly elaborates the definition of the concept of the new generation of migrant workers; analysis of the employment characteristics of the new generation of migrant workers, the new generation of migrant workers to choose occupation has an obvious tendency of industry, labor rights and interests are greatly improved. The analysis of the new generation of migrant workers in employment encounter problems, such as labor rights have not been fully guaranteed.
The third chapter of the paper mainly analyzes the positive significance of the legislation of Employment Promotion Law and labor contract law on the employment of migrant workers in China.
The fourth chapter of the paper mainly discusses the disharmony of labor relations caused by the unguaranteed labor rights and interests of the new generation of migrant workers, and then causes social stability.
The fifth chapter of the paper analyzes the reasons for the employment of the new generation of migrant workers, and mainly analyzes the reasons for the system.
The sixth chapter of the paper puts forward some suggestions to improve the legal environment for the employment of the new generation of migrant workers. The key is to improve the relevant provisions of the Employment Promotion Law and the labor contract law.
The seventh chapter of the paper is the summary of this paper. Our country should promote the employment of the new generation of migrant workers with new ideas.
